Regulations of Nanjing Municipality on Urban Management
The term "urban management" as mentioned in these Regulations refers to the activities that the government and its relevant departments exercise administrative power according to law to organize, supervise and serve the public affairs and order of the cities listed in the preceding paragraph, which is the basic content of urban governance. Article 3 These Regulations shall apply to the areas where urbanization management is implemented within the administrative area of this Municipality.
The district and county people's governments shall announce the implementation of urbanization management in the areas under their jurisdiction and report to the Municipal People's government for the record. Article 4 Urban governance shall follow the principles of administration according to law, giving priority to services, public participation, joint governance, flexible management and minimal damage, respect social morality, implement national policies and industrial norms, and safeguard public interests. Article 5 The municipal, district and county people's governments shall improve the working mechanism of urban governance in which the government is responsible, the division of labor and cooperation, planning first, and construction management pay equal attention, incorporate urban governance into the national economic and social development plan, formulate urban governance objectives and annual plans, establish appropriate capital investment and guarantee mechanisms, and rationally allocate urban management law enforcement forces. Article 6 The administrative departments of urban management, planning, housing and urban-rural construction, land and resources, environmental protection, public security, transportation, gardens, industry and commerce (hereinafter referred to as the relevant departments of urban management) shall, according to their respective functions and duties, do a good job in urban governance, and may, according to the actual needs of urban governance, delegate administrative power related to urban management according to law and strengthen guidance and supervision. Seventh street offices and town people's governments are responsible for organizing and implementing the specific work of urban governance within their respective jurisdictions, guiding and urging communities (residents' committees and villagers' committees) and relevant units to carry out urban governance-related work. Eighth related development zone management committee and scenic spots, railway stations and other window areas of the management agencies responsible for the daily urban management within their respective jurisdictions, and may be entrusted by the relevant urban management departments to exercise relevant functions and powers. Article 9 The Municipal People's Government shall set up an Urban Governance Committee to organize, guide, supervise and evaluate urban governance, and coordinate the relationship between relevant urban management departments and other government departments.
According to the authorization of the Municipal People's Government, the relevant government departments and units shall abide by and implement the resolutions made by the Urban Governance Committee on important issues of urban governance according to law. Article 10 The Urban Governance Committee is composed of the responsible persons, experts, representatives of citizens, social organizations and other members of the public of the Municipal People's Government and its urban management departments, of which the proportion of members of the public is not less than 50%. The director of the Urban Governance Committee is the mayor.
The meeting of the Urban Governance Committee is held once every quarter, and it can be held temporarily or postponed under special circumstances.
Members of the public should be elected in an open and fair manner. The specific methods and rules of procedure of the Urban Governance Committee shall be formulated separately by the Municipal People's Government and reported to the Standing Committee of the Municipal People's Congress for the record. Article 11 The Urban Governance Committee has an office located in the municipal administrative department of urban management, which is responsible for the daily work of the Urban Governance Committee and performs the following duties:
(a) to organize the supervision and assessment of urban governance, put forward the reward and punishment scheme, and report it to the Urban Governance Committee for approval before implementation;
(2) Organizing, guiding and coordinating public participation in urban governance;
(three) to convene the relevant departments of urban management for joint law enforcement;
(four) to complete other tasks assigned by the Municipal People's government and the urban governance committee. Twelfth all units and individuals have the right to participate in urban governance, and have the obligation to maintain the cleanliness of the city and public order, and have the right to persuade or report acts that damage or destroy the city environment and public order.
People's governments at all levels and their relevant departments shall widely publicize the laws, regulations and rules related to urban governance, guide, encourage and support the public's investment, donation and voluntary service in urban governance, and commend and reward units and individuals that have made remarkable achievements in urban governance. Chapter II Public Participation in Governance Article 13 The public can participate in urban governance activities in various ways, such as expert consultation, symposium, demonstration meeting, hearing, online consultation and questionnaire survey.
Before members of the public participate in the decision-making of urban governance, they should conduct in-depth research on the matters discussed at the meeting in advance, and listen to and collect public opinions.
The government, the Urban Governance Committee and the relevant departments of urban management shall, in accordance with the regulations, disclose the information related to urban governance such as administrative decision-making, administrative law enforcement, administrative adjudication and administrative supervision in a way that is easy for the public to know. When a symposium, demonstration meeting or hearing is held, the time, place and main topics of relevant public meetings shall be informed in writing in advance to provide necessary conditions for public participation, and the opinions put forward by the public shall be carefully studied and reasonable and feasible suggestions adopted.
Encourage urban management departments to innovate mechanisms, attract the public to participate in urban governance, and establish regular and effective communication and contact with social organizations in the form of regular joint meetings.
