Regulations of Heilongjiang Province on the Work of Township People's Congress

Chapter I General Provisions Article 1 In order to uphold and improve the people's congress system, give full play to the role of grass-roots organs of state power and deputies to people's congresses, and promote the modernization of the national governance system and governance capacity, in accordance with the Constitution of People's Republic of China (PRC), the Organic Law of People's Republic of China (PRC) Local People's Congresses and Local People's Governments at Various Levels, the Election Law of the National People's Congress and Local People's Congresses of the People's Republic of China, the Law of the People's Republic of China on Representatives to National People's Congresses and Local People's Congresses at Various Levels and other relevant laws and regulations, Article 2 The people's congresses of townships (including townships, nationality townships and towns) are grass-roots organs of state power, an important foundation of local state power and an effective form of grassroots democracy. Chapter II Township People's Congresses Article 4 Township people's congresses are composed of representatives directly elected by voters. Article 5 The term of office of the Township People's Congress is five years. Article 6 A township people's congress shall have a full-time chairman and one or two vice-chairmen, who shall be elected by the people's congress at the corresponding level from among the deputies, and the term of office shall be the same as that of the people's congress at the corresponding level. Seventh Township People's Congress shall exercise the following functions and powers:

(1) To ensure the observance and implementation of the Constitution, laws, administrative regulations, local regulations and the resolutions of the people's congresses at higher levels and their standing committees within their respective administrative areas;

(2) adopting and issuing resolutions within the scope of its functions and powers;

(3) To decide on the construction plans of economic, cultural and public undertakings within their respective administrative areas;

(four) to decide on the implementation plan of civil affairs work within their respective administrative areas;

(five) to discuss and decide on major measures for the construction of democracy and the rule of law, as well as major issues involving the overall planning of regional development, urban construction, major livelihood projects and major construction projects;

(six) to elect the presidium of the people's congress at the corresponding level, chairman, vice chairman, township head, deputy township head, mayor and deputy mayor;

(seven) approved by the credentials committee;

(eight) to listen to and consider the work report of the presidium of the people's congress at the corresponding level during the intersessional period;

(nine) to listen to and consider the work report of the Township People's government;

(ten) to review and approve the budget and budget implementation report, budget adjustment plan and final accounts within their respective administrative areas;

(eleven) to supervise the budget and final accounts at the corresponding level;

(twelve) to revoke the inappropriate decisions and orders of the Township People's government;

(13) to protect socialist property owned by the whole people and property collectively owned by working people, to protect citizens' legitimate private property, to maintain social order and to safeguard citizens' personal rights, democratic rights and other rights.

(fourteen) to protect the legitimate rights and interests of various economic organizations;

(fifteen) to protect the rights of ethnic minorities;

(sixteen) to protect women's rights such as equality between men and women, equal pay for equal work and freedom of marriage. Eighth Township People's Congress meeting held at least once a year. When there are no election matters, the duration of the meeting is not less than one day; When there are election matters, the duration is not less than two days.

On the proposal of more than one-fifth of the deputies, a meeting of the people's congress at the corresponding level may be convened temporarily. Article 9 The first meeting of each township people's congress shall be held within two months after the deputies of the current people's congress are elected. Tenth Township People's Congress held a meeting, the township people's government leaders should attend the meeting; Upon the decision of the presidium, the responsible persons of other relevant organs and organizations may attend the meeting as nonvoting delegates. Article 11 When the Township People's Congress is in session, the presidium, the Township People's Government and five or more deputies to the Township People's Congress may jointly put forward proposals within the scope of functions and powers of the people's congress at the corresponding level.

The motion put forward by the presidium and the Township People's Government shall be decided by the presidium and submitted to the people's congress at the corresponding level for deliberation.

The motion put forward jointly by five or more deputies to the Township People's Congress shall be decided by the presidium whether it is included in the agenda of the meeting.

A bill shall have a cause of action, a case basis and a plan.

Before the proposal put on the agenda of the meeting is submitted to the General Assembly for voting, if the sponsor requests to withdraw it, the deliberation of the meeting on the proposal shall be terminated with the consent of the presidium. Article 12 Elections and resolutions of township people's congresses shall be adopted by more than half of all the deputies. Thirteenth candidates for the chairman, vice chairman of the township people's congress and the leaders of the people's government shall be jointly nominated by the presidium of the people's congress at the corresponding level or more than ten representatives. Representatives elected from different constituencies may brew and jointly propose candidates.

The head of a nationality township shall be a citizen of the minority nationality who established the nationality township.

The number of candidates for the chairman of the township people's congress and the chief leaders of the people's government should generally be more than one, and the difference election should be held; If only one candidate is nominated, an equal election can also be held. The number of candidates for vice-chairmen of township people's congresses and deputy leaders of people's governments shall be one to three more than the number of candidates to be elected. When the number of nominated candidates reaches the difference specified in the election method, the presidium shall submit it to the representatives for deliberation and discussion before the election. If the number of nominated candidates exceeds the difference specified in the election method, the presidium shall submit it to the delegates for deliberation and discussion, and then conduct pre-selection. According to the order of the number of votes in the primary election and the difference stipulated in the election method, the official list of candidates is determined and the election is held.

When by-elections are held for the chairmen, vice-chairmen and leaders of township people's congresses, the number of candidates may be greater than or equal to the number of candidates to be elected. The election method shall be decided by the people's congress at the corresponding level.
