Who owns the land use right, property management right and contract right?

Owners' committee has the right to sign property management contracts. Property management contract is a contract in which the property service provider provides property services to the owner in the property service area, and the owner pays the property fee. When the owners' committee implements the decisions made by the owners' congress, it may sign a property management contract on behalf of the owners with the property service enterprises selected by the owners' congress.

Article 937 of the Civil Code of People's Republic of China (PRC)

A property service contract is a contract in which the property service provider provides the owner with property services such as the maintenance of the building and its ancillary facilities, the management and maintenance of environmental sanitation and related order, and the owner pays the property fee.

Property service providers include property service enterprises and other managers.

Article 15 of the Regulations on Property Management

The owners' committee shall implement the matters decided by the owners' congress and perform the following duties:

(a) to convene a meeting of the owners' congress and report on the implementation of property management;

(two) on behalf of the owners and the owners of the general assembly to hire property services companies to sign property services contracts;

(three) timely understand the opinions and suggestions of the owners and property users, and supervise and assist the property service enterprises to perform the property service contract;

(four) the implementation of the supervision and management system;

(five) other duties entrusted by the owners' congress.
