Article 1 In order to regulate the behavior of property service charges in residential quarters, safeguard the legitimate rights and interests of owners and property service enterprises, and promote the healthy development of the property management service industry, these detailed rules are formulated in accordance with the relevant provisions of the Price Law of People's Republic of China (PRC), the Regulations on Property Management in Zhejiang Province and the Measures for the Implementation of Property Service Charge Management in Zhejiang Province (for Trial Implementation), combined with the actual situation of our city.

Article 2 Jinhua Municipal Price Bureau shall, jointly with Jinhua Construction Bureau, manage, coordinate, supervise and guide the property service charges within the urban area according to law.

Article 3 The term "property service charges" as mentioned in these Measures refers to the fees charged by property service enterprises to the owners for the maintenance, conservation and management of houses, supporting facilities and related sites, and for the maintenance of environmental sanitation and order in relevant areas. The contents of its property services shall include:

1, management and maintenance of * * * parts of the property and * * * facilities and equipment;

2. Cleaning of public places in the property management area, collection and removal of domestic garbage, and cleaning of septic tanks;

3. Maintenance and management of public green space, flowers and trees;

4. Maintain * * * public order, and assist in the security work of the management area;

5, all kinds of property file management and decoration management;

6. Other public services agreed by the owners and the realty service enterprise.

Article 4 Property service charges shall follow the principles of reasonableness, openness, and adaptability of fees and service levels.

Fifth according to the type of property, the different stages of property services, the nature and characteristics of the services provided, etc., the property service charges are subject to government guidance and market adjustment.

Ordinary residential quarters (excluding villas and townhouses, etc.). , the same below) the early property service charges are subject to government guidance. After the establishment of the owners' committee, the property service charges for non-residential houses, villas, townhouses and ordinary residential areas shall be subject to market-adjusted prices.

Article 6 Property service charges may be contracted or charged. During the prophase property management, the property service charges are outsourced, and the charging method after the establishment of the owners' committee shall be agreed by the owners' committee and the property service enterprise.

Contract system refers to the way that the owner pays a fixed property service fee to the property service enterprise, and the profit or loss is enjoyed or borne by the property service enterprise. Its service fee consists of property service cost, statutory tax and profit. The contract system can adopt comprehensive service contract and menu sub-service contract.

The gratuity system refers to the way that the owner prepays the property service fee to the property service enterprise, and the property service enterprise extracts the gratuity from the property service fund received in advance according to the agreed proportion or amount, and the rest is used for the expenses agreed in the property service contract, and the balance or insufficient part is enjoyed or borne by the owner. Property service funds received in advance include property service expenditure and remuneration of property service enterprises.

Seventh residential property service charges with government-guided prices shall be subject to a graded charging system, and the charging level shall be assessed by the residential quarters where services are implemented.

The standard of charging grade and the quasi-price and floating range of each grade of charging shall be formulated by the Municipal Price Bureau jointly with the Municipal Construction Bureau according to the service content, service quality, service standard and scale, grade, environment and service facilities of public property services provided by property service enterprises for owners, and announced to the public.

The specific implementation standards of residential property service charges shall be determined by the property service enterprises (or development and construction units) within the prescribed quasi-price and floating range, and shall be clearly defined in the property service contract.

Article 8 For residential quarters with market-regulated prices, the owners' committee and the realty service enterprise shall determine their own specific charging standards in accordance with the relevant provisions, and make them clear in the realty service contract.

According to the regulations, the owners' committee should be set up but not the owners' committee, and the property service charges should be determined by the property service enterprises with reference to the relevant provisions of the previous property service charges, and implemented with the consent of more than half of the owners in the property management area.

Article 9 According to the charging standard, the total construction area of the residential quarters with pre-service property is not less than 20,000 square meters (inclusive). For residential quarters with a total construction area of less than 20,000 square meters, the charging standard shall be determined through consultation between the owners and the property service enterprises. If the two parties fail to reach an agreement through consultation, they may declare the charging standard to the competent price department according to the service cost.

Tenth new residential areas to implement property management, property service enterprises should refer to the standard of property service charges, self-evaluation of the charges, and submit a written application to the competent price department. When applying, information shall be provided in accordance with the requirements of the second paragraph of Article 11 of these Measures, and the competent price department shall determine the temporary charging standard according to the actual situation of residential quarters.

For ordinary residential quarters subject to property management pre-bidding, real estate development enterprises shall report the charging grades and standards to the competent price department according to the scheme of implementing property services in the quarters and the reference scope of the charging grades and standards of property services. The competent price department shall, according to the configuration of residential facilities and equipment and the audited property service plan, verify the quasi-price and floating range of the charging level and standard, and the specific charging standard shall be determined by the real estate development enterprise through bidding within the approved quasi-price and floating range.

Eleventh property service charge level evaluation by the district price department in conjunction with the competent department of property organization. Jinhua Economic Development Zone is organized and implemented by the Municipal Price Bureau in conjunction with the municipal and development zone property departments.

When a realty service enterprise declares the level of realty service charges, it shall submit a written application to the competent price department 30 working days before charging. The following information shall be provided when applying:

(1) Business license of enterprise as a legal person;

(2) Qualification certificate of property service enterprise;

(three) the property service contract and residential property service content standards and other related information;

(four) "Jinhua city property service charge level approval form";

(5) Other required information.

Twelfth property service charges according to the residential construction area of the implementation of government guidance; The billing time is calculated from the month after the owner purchases the new commercial residence and handles the handover procedures. If the owner fails to handle the handover procedures within the specified time, it shall be counted from the month following the agreed handover period. The purchase of non-newly-built commercial housing is calculated from the month following the date of transfer of property rights of the house.

The property service fee of the owner's leased property can be paid as agreed by both parties. If it is paid by the lessee, the owner shall bear joint liability.

Thirteenth included in the scope of property management has been completed but not yet sold, or due to the reasons of the development and construction unit is not handed over to the property buyer's house on time, the property service fee shall be paid in full by the development and construction unit. For the property that has been handed over but the owner has not lived, and has been vacant for more than half a year after living, the property service fee shall be paid at 70% of the receivable standard after verification by the property service enterprise. If the house is not vacant during the renovation, the property service fee shall be paid in full according to the prescribed standards.

Fourteenth property service fees (property service expenditure) are composed of the following items:

(1) Managing the salaries, social insurance and welfare benefits of service personnel. ;

(two) the daily operation and maintenance costs of the parts, facilities and equipment used by the property;

(three) the cost of cleaning the property management area;

(four) the cost of greening and maintenance in the property management area;

(5) Maintenance fee for regional order of property management;

(6) office expenses;

(seven) depreciation of fixed assets of property service enterprises;

(eight) * * * property, * * * facilities and equipment and public liability insurance costs;

(nine) other expenses agreed by the owner.

Fifteenth elevators, booster pumps and other high-energy facilities operating electricity, non-public underground motor vehicle parking garage, parking spaces, lighting and ventilation electricity, cleaning, order maintenance and other expenses according to the actual amount allocated to the beneficiary owners. The specific distribution method shall be determined by both parties through consultation.

Sixteenth property management area, water supply, power supply, gas supply, heating, communications, cable television and other units shall charge the relevant fees to the end users. Where the realty service enterprise accepts the entrustment to collect the above fees, both parties shall sign a paid service contract, and the realty service enterprise shall collect the agency service fee from the entrusting party, and shall not collect any additional fees from the owner.

Seventeenth property service enterprises to implement the charging system, property management funds should be established in accordance with the provisions of the system, its income and expenditure should be published regularly, and accept the supervision of all owners; Where the contract fee system is implemented, the revenue and expenditure of the * * * parts of the property, * * facilities and equipment and related sites shall be announced regularly.

Eighteenth property service enterprises in providing property management services, should sign a property service contract with the owners, and effectively provide services that meet the quality and price according to the service items and standards agreed in the contract.

Nineteenth in addition to the provisions of laws, regulations and rules, the realty service enterprise shall not collect the deposit or security deposit from the owners in any name.

Twentieth property service fees shall be collected by the property service enterprises in accordance with the time limit stipulated in the property service contract signed with the owners; If there is no agreement, the early harvest period shall not exceed 12 months.

Article 21 The expenses for overhaul, medium repair, renewal and transformation of the parts and facilities used by the property shall be charged in the special maintenance funds of the property, and shall not be included in the property service cost or property service expenditure. The collection, use and management of property special maintenance funds shall be carried out in accordance with relevant regulations.

Twenty-second property service charges should be clearly marked. The charging items, charging standards, charging scope and service contents shall be announced in a prominent position in the business premises or charging places, and shall be subject to the supervision of the owners and the competent price department.

Twenty-third owners should pay the property service fee in full and on time in accordance with the provisions of the property service contract. If the owners violate the property service contract and fail to pay the property service fee within the time limit, the owners' committee shall urge them to pay within a time limit; Fails to pay, the realty service enterprise can recover according to law.

Twenty-fourth after the owners pay the property service fees to the property service enterprises, unless otherwise stipulated by the state, no department or unit may charge the owners the fees of the same nature and content repeatedly.

Article 25 Unless otherwise stipulated by the competent price department of the government, the fees for special services such as vehicle parking service, decoration garbage removal and agency service involved in the implementation of property management in residential quarters shall be subject to market-adjusted prices.

Twenty-sixth in violation of the provisions of the price behavior, by the Municipal Price Bureau in accordance with the "People's Republic of China (PRC) price law" and "regulations on administrative penalties for price violations" will be punished.

Article 27 These Measures shall come into force as of August 1 day, 2065.
