Conditions for convening the owners' meeting
Legal analysis: If the property management area meets one of the following conditions, the first owners' meeting can be held: 1. The construction area of the property sold and delivered for use reaches more than 50% of the total construction area of the property management area. 2. Or if the first suite has been delivered for two years, the district real estate department where the property is located shall organize the owners to set up a preparatory group for the owners' meeting in conjunction with the sub-district office and the Township People's Government, and elect the owners' committee. And inform the neighborhood office (township people's government) where the property is located before the meeting; If the owners who account for more than 20% of the total number of owners in the property management area request in writing to hold the first meeting of the owners' general assembly, the neighborhood office (Township People's Government) where the property is located shall organize the convening. Neighborhood offices (Township People's governments) shall, within 30 days after receiving the notice or application, notify the construction unit to submit materials such as the building area of the property, the time of sale of the property, the inventory of the owners, and be responsible for verifying the materials and guiding the establishment of the preparatory group for the first meeting of the owners' congress. The construction unit shall submit the materials within ten days after receiving the notice from the sub-district office (Township People's Government) and assist in the establishment of the preparatory group.
Legal basis: Article 10 of the Property Management Regulations stipulates that the owners in the same property management area shall, under the guidance of the real estate administrative department of the district or county people's government where the property is located, set up the owners' meeting and elect the owners' committee. However, if there is only one owner, or if the number of owners is small and all owners agree unanimously, it is decided not to set up the owners' meeting, and the owners will jointly perform the duties of the owners' meeting and the owners' committee.
