Regulations on the administration of underground parking lots
The underground parking management regulations are as follows: Chapter I General Provisions
Article 1 In order to standardize the management of underground parking spaces in residential areas in this Municipality and make rational use of urban underground space resources, in accordance with the Property Law, Regulations on the Development and Management of Urban Real Estate in the State Council, Regulations on the Management of Property in Anhui Province, Measures for the Implementation of the People's Republic of China (PRC) Civil Air Defense Law in Anhui Province, Measures for the Registration of Houses by the Ministry of Construction, Regulations on the Development and Utilization of Urban Underground Space and other laws and regulations,
Article 2 These Measures shall apply to the planning, construction, sale, ownership registration and use management of underground parking lots in residential areas within the urban area of this Municipality.
The term "underground parking lot" as mentioned in these Measures refers to all kinds of underground places and supporting facilities planned for parking cars in residential areas.
Article 3 Where a civil air defense project built according to law is used for parking spaces, it shall be implemented in accordance with the relevant provisions of civil air defense projects.
Chapter II Planning and Construction
Article 4 Underground parking lots shall be built within the scope of land use rights.
Article 5 The underground parking lot shall be constructed in strict accordance with the contents approved by the planning and management department, with a clear height of not less than 2.20m..
Article 6 The municipal housing and construction department shall indicate the parking space allocation index, the clear height requirement of underground parking spaces, the ownership of property rights and other related contents in the Opinions on Construction Conditions of Real Estate Development Projects, and require the land management department to inform the bidders when transferring the land as one of the conditions for land transfer.
Article 7 When applying for a construction project planning permit, a development enterprise shall specify the project name, construction scale, storey height, parking space division and other related contents of underground parking spaces.
Article 8 Before the underground parking lot starts construction, the development enterprise shall apply for the construction permit according to law.
Ninth after the completion of the underground parking lot, the development enterprise shall organize the completion acceptance in accordance with the provisions, and can only be delivered after passing the acceptance.
Chapter III Sales and Ownership Registration
Tenth underground parking spaces in residential areas should first meet the needs of the owners of residential areas, and the ownership of underground parking spaces should be agreed by the parties through sale, gift or lease.
Unless otherwise agreed in the Opinions on Construction Conditions of Real Estate Development Projects, such provisions shall prevail.
Eleventh in line with the sales conditions of the underground parking lot sales price by the municipal price department for the record.
Twelfth conditions and procedures for the sale of underground parking spaces shall be implemented in accordance with the relevant provisions of the Measures for the Administration of Commercial Housing Sales and the Measures for the Administration of Urban Commercial Housing Pre-sale, and the following documents shall be attached.
(a) the civil air defense project scope certificate issued by the civil air defense project management department;
(two) opinions on the construction conditions of real estate development projects;
(three) the record table of the sales price of underground parking spaces.
Article 13 When a development enterprise sells qualified underground parking spaces, it must post relevant information such as public construction project planning permit, state-owned land use certificate, pre-sale permit for commercial housing, pre-sale plan, model text of sales contract, number of underground parking spaces, sales price and so on at the sales place for the record.
Fourteenth underground parking spaces that meet the sales conditions shall be sold to the owners of residential areas.
Fifteenth underground parking spaces and underground mechanical parking spaces within the scope of civil air defense projects shall not be sold or donated, and shall not be registered for ownership.
Sixteenth according to the proportion of parking spaces in residential areas, a house can only be equipped with one parking space in principle.
Two years after the overall delivery of the community, the owners can buy underground parking spaces.
Seventeenth development enterprises to apply for the initial registration of underground parking spaces, shall submit the following materials:
(1) Application for registration;
(2) the identity certificate of the applicant;
(3) State-owned land use right certificate or other land use documents;
(four) the proof that the underground parking lot construction conforms to the plan;
(five) the record certificate of the completion acceptance of the underground parking lot;
(six) the civil air defense project scope certificate issued by the civil air defense project management department;
(seven) opinions on the construction conditions of real estate development projects;
(8) Technical report on surveying and mapping of underground parking spaces and household plan;
(9) Other materials that should be provided.
Eighteenth housing ownership transfer, underground parking spaces should be transferred, or transferred to other owners of residential areas.
Nineteenth transfer of underground parking spaces, the parties shall apply for registration of transfer after the relevant legal documents come into effect or the fact occurs. To apply for transfer registration, the following materials shall be submitted respectively:
(1) Application for registration;
(2) the identity certificate of the applicant;
(3) The certificate that the transferee is the owner of the community to which the underground parking space belongs;
(four) materials to prove the transfer of ownership of underground parking spaces;
(5) Property right certificate;
(6) Other materials that should be provided.
Twentieth underground parking spaces do not issue warrants separately, and the housing registration agency shall add supplementary contents of underground parking spaces in the attached pages of real estate warrants, and record the parking space information in the housing register.
The registered area of underground parking spaces is calculated according to the actual parking space.
Chapter IV Use Management
Twenty-first development enterprises should give full play to the use function of underground parking spaces. For underground parking spaces that have not been sold or donated, they can be rented out to the owners. Only for sale and not for rent? In the name of refusing to provide parking services for the owners.
Twenty-second development enterprises to rent underground parking spaces, should publicize the number of underground parking spaces, lease methods, rent standards, lease contract demonstration text and other related information.
Twenty-third underground parking space rental, should first meet the needs of the owners of the residential area, and in line with the "Contract Law", the Ministry of Housing and Urban-Rural Development "commercial housing rental management approach" provisions.
Twenty-fourth underground parking lots should be included in the property management of residential areas, and their use functions and building structures should not be changed without authorization.
Twenty-fifth underground parking fees, according to the relevant provisions.
Article 26 when a development enterprise provides underground parking spaces within the scope of civil air defense projects to the owners, it shall inform the users? This parking space belongs to the civil air defense project, and its use and management should follow the relevant laws and regulations of civil air defense? .
Chapter V Supplementary Provisions
Article 27 These Measures shall be implemented as of the date of promulgation. Before the promulgation of these measures, the underground parking spaces that have been completed and accepted may be registered with reference to these measures.
