The term "property service charges" as mentioned in these Measures refers to the fees charged by property management enterprises to the owners for the maintenance, conservation and management of residential, office, industrial, commercial and other buildings, supporting facilities and related sites, and the maintenance of environmental sanitation and order in relevant areas.
Article 7
Property service charges distinguish the nature and characteristics of different properties, and implement government-guided prices and market-regulated prices respectively.
Public property service charges in ordinary residential areas are subject to government-guided prices. Public property service charges in ordinary residential areas refer to the fees charged by property management enterprises for providing services such as cleaning, environmental sanitation, greening maintenance, order maintenance, maintenance and management of houses and supporting facilities and related sites in ordinary residential areas.
Senior apartments, villas and other high-standard residential areas, as well as office buildings, industries, businesses and other categories of property services charges, the implementation of market-adjusted prices.
The special service fee shall be subject to market adjustment price, which shall be agreed by both parties. Special service fee refers to the fees charged by property management enterprises for providing services other than public property service contracts entrusted by individual owners.
The management of vehicle parking service charges in the property management area shall be implemented in accordance with the relevant provisions of the government price department. Among them, the parking service charges in residential areas are formulated by the government and managed by the local government price department. Only when there is a fixed parking lot and carport, and there is someone to look after it, can the parking service fee be charged.
Article 8
Public property service charges in ordinary residential areas subject to government-guided prices shall be determined by the competent price department of the district, city and county (city) people's government in conjunction with the real estate administrative department at the same level, and the corresponding grade benchmark price and its floating range shall be formulated according to factors such as property service grade standards. The grade benchmark price is set according to the property service cost, statutory taxes and fees and the profit of the property management enterprise, and the profit rate generally does not exceed 10% of the property service cost.
Generally, the floating range of the charging standard of each grade shall not exceed 10% of the benchmark price of that grade. The formulation of grade benchmark price should be adjusted in time according to the change of social average cost, and announced to the public once a year.
The specific charging standard shall be agreed by the owner and the property management enterprise in the property service contract according to the specified grade benchmark price and its floating range, and shall be filed with the local government price department and the real estate administrative department. The property service grade standard and grade benchmark price formulated by each district and city and its floating range shall be filed with the Provincial Price Bureau and the Provincial Construction Department in a timely manner.
The property service charges that are regulated by the market shall be agreed by the owners and the property management enterprises in the property service contract.
Article 10
Owners and property management companies can agree on property service fees in the form of contract system or remuneration system. The form to be taken shall be decided by both parties through consultation.
If the public property service fee in ordinary residential areas adopts the contract gratuity system, the contract gratuity charged by the property management enterprise shall not exceed 10% of the property service fee.
Article 12
If the contract system of property service fee is implemented, the composition of property service fee includes property service cost, statutory taxes and fees and profits of property management enterprises.
The implementation of the property service fee reward system, the property service funds received in advance include property service expenditure and property management enterprise remuneration.
The composition of property service cost or property service expenditure generally includes the following parts:
1, salary of management service personnel, social insurance and welfare expenses drawn according to regulations, etc. ;
2, the daily operation and maintenance costs of * * * parts of the property and * * * facilities and equipment;
3, property management area cleaning costs;
4, the property management area greening maintenance costs;
5, property management regional order maintenance costs;
6. Office expenses;
7. Depreciation of fixed assets of property management enterprises;
8. Part of the property, facilities, equipment and public liability insurance fees;
9. Other expenses agreed by the owner.
The cost of overhaul, medium repair, renewal and transformation of the parts and facilities used by the property shall be charged through special maintenance funds and shall not be included in the cost of property services or the expenditure of property services.
