Does the property management company have the right to move the tenant's property out of the rented house?

The defaulting property management company has no right to move the lessee's property out of the rented house.

According to the provisions of Article 22 of the Measures for the Administration of Urban Housing Lease, the lessee must pay the rent on schedule, and if it breaches the contract, it shall pay liquidated damages. Paragraph 4 of Article 24 of this Law also stipulates that if the rent is in arrears for more than six months, the lessor has the right to terminate the contract and take back the house, and the lessee shall compensate for the losses caused thereby.

When the lessee is in arrears with rent, the lessor can not only demand to terminate the contract and recover the arrears of rent, but also demand the lessee to pay liquidated damages and continue to perform the lease contract while recovering the arrears of rent. At the same time, although the lessee is in arrears with the rent, the lease contract is still valid and the rent will be calculated on a monthly basis. Therefore, even if the rent is delayed for a period of time, the lessor still hopes to maintain the lease relationship that may recover the rent. When the lessor thinks that it is no longer necessary to maintain the lease relationship with the lessee according to various circumstances, for example, the lessee can no longer delay the payment of rent, the lessor will exercise the right to terminate the lease contract in advance.
