Regulations of Guangzhou Municipality on Property Management (202 1 Revision)
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the buildings, structures and their supporting facilities and equipment and related sites in the property service area through self-management or hiring property service personnel, and to maintain environmental sanitation and related order. Article 3 The municipal and district people's governments shall strengthen the leadership and organization of the supervision and management of property management activities, incorporate property management into the social governance system, establish a joint meeting system, and make overall plans to solve major problems of property management.
The District People's Government shall provide full-time property management personnel for the town people's government and sub-district offices, and implement the working funds. Article 4 The municipal housing administrative department shall organize the implementation of these Regulations, be responsible for the supervision and management of property management activities within the administrative area of this Municipality, and perform the following duties:
(a) to formulate policies related to property management in this Municipality and organize their implementation;
(two) the establishment of the city's property management credit system;
(three) to establish and maintain the city's property management information platform;
(four) responsible for the supervision and management of maintenance funds in this Municipality;
(five) to formulate the management statute, the rules of procedure of the owners' congress, the property service contract and other model texts;
(six) the organization of property management related laws and regulations publicity and training;
(seven) to guide and supervise the supervision and management of the district housing administrative departments to carry out property management activities;
(eight) to guide and supervise the city's property service industry associations to carry out industry self-discipline and service work;
(nine) other duties as prescribed by laws and regulations. Fifth district housing administrative departments responsible for the supervision and management of property management activities within their respective administrative areas, specifically perform the following duties:
(a) responsible for the delineation and adjustment of the property service area according to law;
(two) to supervise and manage the property management activities such as bidding, property inspection and the use of maintenance funds;
(three) to establish and improve the database of the owner's decision-making electronic voting system;
(four) to carry out administrative law enforcement of property management according to law;
(five) to guide the town people's government, neighborhood offices and residents' committees to carry out property management related work;
(six) to organize the publicity and training of laws and regulations related to property management within their respective administrative areas;
(seven) other duties as prescribed by laws and regulations. Article 6 Relevant administrative departments of land, planning, finance, market supervision and management, emergency management, public security, fire protection, price, transportation, water affairs, comprehensive law enforcement of urban management, ecological environment, health and health shall, according to their respective functions and duties, do a good job in the supervision and management of property management activities. Article 7 The town people's government, neighborhood offices and residents' committees shall guide and assist the owners to convene the owners' meeting and elect the owners' committee according to law, supervise the owners' meeting and the owners' committee to perform their duties according to law, and coordinate the handling of property management disputes.
The town people's government and subdistrict offices shall incorporate property management into community governance, establish a joint meeting system of property management according to needs, and strengthen the guidance, help and supervision of property management activities.
The residents' committee shall establish a coordination mechanism between the owners, the owners' committee and the property service providers, and assist the town people's government and the sub-district offices to guide and supervise the property management activities in this community.
Party organizations in towns, streets and communities should strengthen the guidance of grassroots party organizations in property service areas, and support owners, owners' congresses, owners' committees, property management committees and property service providers to carry out property management activities according to law. Article 8 Property service industry associations shall, under the guidance and supervision of the housing administrative department, safeguard the legitimate rights and interests of property service providers, and take the following measures to promote the standardized, sustained and healthy development of the industry and improve the level of property services:
(a) to strengthen industry self-discipline, establish and improve the self-discipline and integrity management system of property service providers and their employees;
(two) the development of property service standards and property service charges market reference price;
(three) to mediate disputes over property services and maintain fair competition in the market order;
(four) the implementation of smart property services, advocate the adoption of new technologies and methods by property service providers, promote resource conservation and environmental protection, and improve the level of property services;
(five) the organization of property management related laws and regulations, property service standards, professional services and other industry training, improve the service level of property service providers and their employees;
(six) to supervise the service quality and behavior of property service providers and their employees, and report to the relevant administrative departments when illegal acts are found. Article 9 Housing administrative departments, town people's governments, neighborhood offices, residents' committees, trade associations and other relevant units shall improve the mechanism for handling property management disputes, encourage settlement of property management disputes through conciliation, mediation, arbitration and litigation, and promote the construction of harmonious communities.
