Under what circumstances is it reasonable for the owner to refuse to pay the property fee?
1. The delivery of the house is delayed or the owner fails to accept the house.
Many buyers buy faster houses, and the delivery time is uncertain. Some developers will continue to postpone delivery due to various factors. In this case, the responsibility should be borne by the developer, and the owner can refuse to pay the property fee. Of course, if the owner has not closed the house, the property management company will also charge in advance. This situation can also be refused, but if the owner does not move in after taking over the house, the property management fee will be paid normally.
2. The owner has not signed a contract with the property management company.
The service relationship between the general property and the owner only takes effect after signing the contract, so the property fee needs to be paid after signing the contract. If you don't sign the contract, the owner has the right to refuse to pay the property fee, but generally, you will sign the property contract when you buy or hand over the house, and the buyers themselves should know fairly well to avoid disputes arising from the property contract.
3. Failure to perform the service responsibilities agreed in the contract.
After the owner signed an agreement with the property management company, the contract stipulated what kind of services the property management company needed to provide. However, after moving in, it was found that the property management company did not fulfill its due responsibilities and obligations as agreed, so at this time, as the owner, it has the right to refuse to pay the property fee, requiring the property to behave properly and fulfill the obligations stipulated in the contract again.
4. Expand the charging scope and raise the charging standard without authorization.
For example, the residential property charges 0.8 yuan /m. If the property company raises the property charges to 2 yuan/M without the consent of the owners' committee or all the owners, the charging standard will be raised. At this time, the owner can also choose to refuse to pay, even if he wants to adjust the fee, he can negotiate with the owner.
5. If the house is rented, the property fee stipulated in the contract shall be borne by the lessee.
After the general house is rented, the owner is only responsible for collecting the rent, and it will be stipulated in the lease contract that the relevant expenses of the property shall be borne by the lessee. If the property company collects property fees from the owner at this time, the owner can also refuse to pay.
