Article 1 These Regulations are formulated in accordance with the Entry-Exit Animal and Plant Quarantine Law of People's Republic of China (PRC) (hereinafter referred to as the Entry-Exit Animal and Plant Quarantine Law).

Article 2 The following articles shall be quarantined in accordance with the Entry-Exit Animal and Plant Quarantine Law and these Regulations:

(1) Animals and plants, their products and other quarantine objects entering or leaving the country;

(2) containers, packages and bedding materials for animals and plants, their products and other quarantine objects;

(3) Means of transport from animal and plant epidemic areas;

(4) Abandoned ships dismantled at entry;

(5) Other inbound and outbound animal and plant quarantine goods and articles as stipulated by relevant laws, administrative regulations, international treaties or trade contracts.

Article 3 The administrative department of agriculture of the State Council shall be in charge of the national entry-exit animal and plant quarantine.

People's Republic of China (PRC) State Animal and Plant Quarantine Bureau (hereinafter referred to as the State Animal and Plant Quarantine Bureau) is in charge of the national entry-exit animal and plant quarantine work, collects major animal and plant epidemics at home and abroad, and is responsible for international cooperation and exchanges in entry-exit animal and plant quarantine.

The port animal and plant quarantine offices set up by the State Animal and Plant Quarantine Bureau at ports open to the outside world and places where entry-exit animal and plant quarantine services are concentrated shall carry out entry-exit animal and plant quarantine in accordance with the Law on Entry-Exit Animal and Plant Quarantine and the provisions of these Regulations.

Article 4 When a major animal and plant epidemic occurs outside the country (territory) and may be introduced into China, the following emergency preventive measures shall be taken according to the situation:

(a) the State Council can take control measures on the relevant border areas, and when necessary, order the means of transport from animal and plant epidemic areas to be prohibited from entering the country or block the relevant ports;

(2) The administrative department of agriculture of the State Council may publish a list of animals and plants, their products and other quarantine objects prohibited from entering the country;

(3) The relevant port animal and plant quarantine office may take emergency quarantine measures for the imported articles listed in Article 2 of these Regulations that may be contaminated by pests and diseases;

(4) Local people's governments in areas threatened by animal and plant epidemics can immediately organize relevant departments to formulate and implement emergency plans and report to the people's governments at higher levels and the State Animal and Plant Quarantine Bureau. Posts and telecommunications, transportation departments should give priority to the transmission of major animal and plant epidemic reports and inspection materials.

Article 5 Animals and plants, animal and plant products and other quarantine objects for personal use or public use by foreign institutions and personnel enjoying diplomatic and consular privileges and immunities shall be quarantined in accordance with the provisions of the Entry-Exit Animal and Plant Quarantine Law and these Regulations; The port animal and plant quarantine office shall abide by the provisions of relevant laws when conducting inspection.

Article 6 The customs shall cooperate with the port animal and plant quarantine office to supervise the entry and exit animals and plants, animal and plant products and other quarantine objects according to law. The specific measures shall be formulated by the administrative department of agriculture of the State Council jointly with the General Administration of Customs.

Article 7 The list of animal and plant epidemic areas and countries and regions where animal and plant epidemics are prevalent as mentioned in the Entry-Exit Animal and Plant Quarantine Law shall be determined and published by the administrative department of agriculture of the State Council.

Article 8 Units and individuals that have made outstanding achievements in implementing the Entry-Exit Animal and Plant Quarantine Law and these Regulations shall be rewarded.

Chapter II Quarantine Examination and Approval

Article 9 The State Animal and Plant Quarantine Bureau or its authorized port animal and plant quarantine office shall be responsible for the quarantine examination and approval of animals, animal products and prohibited articles listed in the first paragraph of Article 5 of the Entry-Exit Animal and Plant Quarantine Law.

The quarantine examination and approval of imported plant seeds, seedlings and other propagating materials shall be the responsibility of the authorities stipulated in the Regulations on Plant Quarantine.

Tenth meet the following conditions, can go through the formalities for examination and approval of entry quarantine:

(1) There is no major animal and plant epidemic in the exporting country or region;

(2) Conforming to the provisions of China's laws, regulations and rules on animal and plant quarantine;

(3) Conforming to relevant bilateral quarantine agreements (including quarantine agreements and memorandums, etc.). , the same below) signed by China and exporting countries or regions.

Tenth quarantine examination and approval procedures should be completed before the signing of trade contracts or agreements.

Article 12 Whoever brings or mails plant seeds, seedlings and other propagating materials into China must apply in advance and go through the quarantine examination and approval procedures; If it cannot be handled in advance due to special circumstances, the carrier or mailer shall go through the quarantine examination and approval procedures at the port, and be allowed to enter the country after being approved by the examination and approval authority and passing the quarantine inspection.

Article 13 Where it is necessary to transport animals across the border, the owner or his agent must submit a written application to the State Animal and Plant Quarantine Bureau in advance, and submit the epidemic certificate issued by the animal and plant quarantine office of the exporting country or region, the certificate issued by the animal and plant quarantine office of the importing country or region allowing animals to enter the country, and explain the intended transit route. The State Animal and Plant Quarantine Bureau will issue an animal transit permit after approval. Article 14 Due to special needs such as scientific research, the owner, owner or his agent must submit a written application to import prohibited articles listed in the first paragraph of Article 5 of the Entry-Exit Animal and Plant Quarantine Law, stating the quantity, purpose, introduction method and epidemic prevention measures after entry, and attach the opinions signed by the animal and plant quarantine office at the customs port.

Article 15 After going through the formalities for examination and approval of entry quarantine, the owner, the owner or his agent shall go through the formalities for examination and approval of entry quarantine again under any of the following circumstances:

(1) Changing the variety or quantity of imported goods;

(2) Changing the exporting country or region;

(3) Changing the port of entry;

(four) beyond the validity period of quarantine examination and approval.

Chapter III Entry Quarantine

Article 16 The statutory quarantine requirements of China mentioned in Article 11 of the Entry-Exit Animal and Plant Quarantine Law refer to the animal and plant quarantine requirements stipulated by the laws and administrative regulations of China and the administrative department of agriculture of the State Council.

Article 17 The State implements a registration system for overseas production, processing and storage units that export animal and plant products to China. The specific measures shall be formulated by the administrative department of agriculture of the State Council.

Article 18 Where animals and plants, animal and plant products and other quarantine objects are imported, the owner or his agent shall apply to the animal and plant quarantine office at the port of entry for inspection before or at the time of entry. Where the goods are quarantined from the customs supervision area, the owner or his agent shall notify the relevant port animal and plant quarantine office when they arrive at the designated place. If the goods belong to the transit customs, the owner or his agent shall declare to the frontier port animal and plant quarantine office when entering the country, and apply for inspection at the destination animal and plant quarantine office upon arrival.

Imported breeding livestock and poultry and their semen and embryos shall be submitted for inspection 30 days before entry; If other animals are imported, they shall apply for inspection 15 days before entry; Imported plant seeds, seedlings and other propagating materials shall be submitted for inspection seven days before entry.

When packing and bedding materials for animals and plants enter the country, the owner or his agent shall declare them to the port animal and plant quarantine office in time, and the port animal and plant quarantine office may quarantine the declared materials according to the specific circumstances. Animal and plant packaging and padding mentioned in the preceding paragraph refers to animal products, plants and plant products directly used as packaging and padding.

Article 19 When applying to the port animal and plant quarantine office for inspection, the inspection application form shall be filled in and the quarantine certificate, certificate of origin, trade contract, letter of credit, invoice and other documents issued by the animal and plant quarantine office of the exporting country or region shall be submitted. If quarantine examination and approval procedures should be handled according to law, a quarantine examination and approval form should also be submitted. If there is no valid quarantine certificate issued by the animal and plant quarantine organ of the exporting country or region, or the quarantine examination and approval procedures are not handled according to law, the port animal and plant quarantine organ may return it or destroy it according to the specific circumstances.

Article 20 When imported animals and plants, animal and plant products and other quarantine objects arrive at the port, the quarantine personnel may quarantine the means of transport and the cargo space, check the conformity of the cargo certificates, and take samples according to the regulations. The carrier, the owner or his agent shall provide the quarantine personnel with the loading list and relevant materials.

Article 20 When the means of transport loaded with animals arrive at the port, people who get on or off the means of transport or get close to animals shall accept epidemic prevention, disinfection and other on-site preventive measures implemented by the port animal and plant quarantine office.

Twenty-second quarantine officers shall conduct on-site quarantine in accordance with the following provisions:

(1) Animals: Check the clinical symptoms of epidemic diseases. When an animal suspected of being infected or dead is found, the situation shall be ascertained with the cooperation of the owner or escort, and it shall be dealt with immediately. Animal bedding, surplus feed and excreta shall be disinfected by the owner or his agent under the supervision of quarantine personnel.

(2) Animal products: check whether there is corruption and deterioration, and whether the containers and packaging are in good condition. Those that meet the requirements are allowed to be unloaded from the means of transport. If the packaging or container of bulk cargo is found to be damaged, the owner or his agent shall be responsible for sorting before unloading the means of transport. According to the situation, the relevant parts of the means of transport and the containers, outer packaging, padding and polluted places loaded with animal products shall be disinfected. If laboratory quarantine is needed, samples should be taken according to regulations. For animal products that are easy to breed plant pests or hide weed seeds, plant quarantine should be implemented at the same time. (3) Plants and plant products: Check whether the goods and packaging are free of pests and diseases, and take samples as required. When pests and diseases are found and may spread, necessary epidemic prevention measures should be taken in time for goods, means of transport and loading and unloading sites. At the same time, animal quarantine shall be carried out on plant products that come from animal-borne epidemic areas or are easy to carry pathogens of animal infectious diseases and parasitic diseases and are used as animal feed.

(4) Packaging materials and bedding materials for animals and plants: check whether they carry pests and diseases, hide weed seeds, contact with soil, and take samples as required.

(5) Other quarantine objects: check whether the package is intact and whether it is contaminated by pests and diseases. When it is found to be damaged or polluted by pests and diseases, it should be treated with pesticides.

Twenty-third bulk animal and plant products shipped by ships and trains shall be inspected at different levels on the ground; Limited to the storage conditions of ports and stations, if on-site inspection is not possible, it may be unloaded and transported to the designated place for storage with the consent of the port animal and plant quarantine office. In the process of unloading, when an epidemic situation is found through quarantine, the unloading shall be stopped immediately, and the owner or his agent shall disinfect the unloaded and unloaded goods according to the requirements of the port animal and plant quarantine office, take measures to prevent the spread of the epidemic situation, and disinfect the loading and unloading tools and places contaminated by pests and diseases.

Article 24 Imported large and medium-sized livestock shall be quarantined for 45 days at the animal quarantine place set up by the State Animal and Plant Quarantine Bureau. If other animals are imported, they shall be quarantined at the animal quarantine station designated by the port animal and plant quarantine office for 30 days. Measures for the administration of animal quarantine places shall be formulated by the administrative department of agriculture of the State Council.

Article 25 When the same batch of imported animal and plant products is unloaded at different ports, the port animal and plant quarantine office will only quarantine the goods unloaded in Hong Kong. The port animal and plant quarantine office at the port of early discharge shall promptly notify the port animal and plant quarantine offices at other ports of discharge of the quarantine and handling situation. If it is necessary to obtain an exit permit, the port animal and plant quarantine office at the port of discharge shall summarize and issue a quarantine certificate.

When an epidemic situation is found in quarantine at the port of discharge and fumigation and disinfection must be carried out on board, the port animal and plant quarantine office at the port of discharge shall issue a quarantine certificate uniformly and notify the port animal and plant quarantine offices at other ports of discharge in time.

Article 26 Imported animals and plants, animal and plant products and other quarantine objects shall be quarantined in accordance with China's national standards, industrial standards and the relevant provisions of the State Administration of Animal and Plant Quarantine.

Twenty-seventh imported animals and plants, animal and plant products and other quarantine objects that have passed the quarantine inspection, the port animal and plant quarantine office shall affix a seal on the customs declaration form or issue a quarantine release notice; If it is necessary to dispatch quarantine from the customs supervision area at the port of entry, the animal and plant quarantine organ at the port of entry shall issue the Notice of Quarantine Dispatching. The owner or his agent shall go through the formalities of customs declaration and delivery with the seal stamped by the port animal and plant quarantine office or the quarantine release form and quarantine handover form issued by the port animal and plant quarantine office. The customs shall release imported animals and plants, animal and plant products and other quarantine objects with the seal stamped on the customs declaration form by the port animal and plant quarantine office or the Quarantine Release Form and Quarantine Handover Form issued by the customs. Other quarantine organs in China will not quarantine the documents delivered by the transportation and post and telecommunications departments during the delivery period.

Article 28 If the imported animals and plants, animal and plant products and other quarantine objects fail to pass the quarantine inspection, the port animal and plant quarantine office shall issue a notice of quarantine treatment, and notify the owner or his agent to carry out the disinfection treatment under the supervision and technical guidance of the port animal and plant quarantine office; If foreign claims need to be made, the port animal and plant quarantine office shall issue a quarantine certificate.

Article 29 The State Animal and Plant Quarantine Bureau may, according to quarantine needs and with the consent of the relevant departments of the governments of countries or regions exporting animals and plants and their products, send quarantine personnel to conduct pre-inspection, loading supervision or epidemic investigation at the place of origin.

Thirtieth illegal entry of animals and plants, animal and plant products and other quarantine objects intercepted by the customs and frontier defense departments shall be handed over to the port animal and plant quarantine office for quarantine.

Chapter IV Exit Quarantine

Article 30 The owner or his agent shall provide a trade contract or agreement when going through the exit formalities of animals and plants, their products and other quarantine objects according to law.

Article 32 The port animal and plant quarantine office may register the products that the importing country requires China to register the production, processing and storage units of animals and plants, animal and plant products and other quarantine objects exported to it, and report them to the State Animal and Plant Quarantine Bureau for the record.

Article 33 Where an export animal needs quarantine before leaving the country, it shall be quarantined at a quarantine place designated by the port animal and plant quarantine office. Exporting plants, animal and plant products and other quarantine objects shall be quarantined in warehouses or freight yards; According to the needs, it can also be quarantined in the process of production and processing.

The plants, animal and plant products and other quarantine objects under inspection shall be in sufficient quantity, well packaged, neatly stacked and clearly marked.

Article 34 Quarantine basis for exporting animals and plants, their products and other quarantine objects:

(a) the provisions of the importing country or region and China on animal and plant quarantine;

(2) Bilateral quarantine agreements;

(3) Quarantine requirements stipulated in the trade contract.

Article 35 Animals and plants, animal and plant products and other quarantine objects that have passed the quarantine inspection at the port of departure shall be treated in accordance with the following provisions when they arrive at the exit port:

(1) Animals shall be subject to clinical quarantine or re-inspection by the animal and plant quarantine office at the exit port;

(2) Plants, animal and plant products and other quarantine objects leaving the country with the original means of transport from the place of departure shall be inspected and released by the animal and plant quarantine office at the exit port; If they leave the country by different means of transportation, they will get new certificates;

(3) Plants, animal and plant products and other quarantine objects shall be assembled after they arrive at the port of departure, and if there are different quarantine requirements due to changes in the importing country or region, or if the quarantine validity period exceeds the prescribed time limit, they shall be re-inspected.

Article 36 If the exported animals and plants, animal and plant products and other quarantine objects pass the quarantine inspection by the animal and plant quarantine office at the port of departure, the transportation, post and telecommunications departments shall deliver them by the quarantine certificate issued by the animal and plant quarantine office at the port of departure when they arrive at the exit port, and other domestic quarantine offices will no longer quarantine them.

Chapter V Transit Quarantine

Article 37 When transporting animals and plants, their products and other quarantine objects across the border (including transshipment, the same below), the carrier or escort shall submit the waybill and the certificate issued by the animal and plant quarantine office of the exporting country or region to the animal and plant quarantine office at the port of entry for inspection. When transporting animals across the border, an animal transit permit issued by the State Animal and Plant Quarantine Bureau shall also be submitted.

Article 38 When transit animals arrive at the port of entry, the animal and plant quarantine office at the port of entry shall disinfect the appearance of the means of transport and containers, and conduct clinical quarantine on the animals. Those who pass the quarantine inspection shall be allowed to transit. The animal and plant quarantine organ at the port of entry may send quarantine personnel to the port of exit, and the animal and plant quarantine organ at the port of exit will no longer quarantine.

Article 39 The means of transport, packages and containers carrying transit plants, animal and plant products and other quarantine objects must be in good condition. If, after inspection by the port animal and plant quarantine office, it is found that the long-distance means of transport or packaging or loading containers may cause leakage on the way, the carrier or escort shall take sealing measures according to the requirements of the port animal and plant quarantine office; Those who cannot take sealing measures are not allowed to cross the border.

Chapter VI Quarantine of Articles Carried and Mailed

Article 40 Whoever brings or mails plant seeds, seedlings and other propagating materials into China without going through the quarantine examination and approval procedures according to law shall be returned or destroyed by the port animal and plant quarantine office. If the mail is returned, the port animal and plant quarantine office shall indicate the reasons for the return on the mail and delivery form; If the mail is destroyed, the port animal and plant quarantine office shall issue a notice to inform the sender.

Article 40 Whoever brings animals and plants, animal and plant products and other quarantine objects into the country must declare to the customs and accept quarantine inspection by the port animal and plant quarantine office. The customs shall promptly hand over the declared or detained animals and plants, their products and other quarantine objects to the port animal and plant quarantine office for quarantine. Those who have not been quarantined shall not be brought into the country.

Article 42 The port animal and plant quarantine office may conduct inspection at the passenger passages and baggage claim areas of ports, airports and stations. Animals and plants, animal and plant products and other quarantine objects that may be carried but have not been declared may be randomly checked, and bags (boxes) may be opened for inspection when necessary.

Passenger entry-exit checkpoints shall set up animal and plant quarantine stations and signs.

Article 43 Anyone who brings animals into the country must hold a quarantine certificate issued by the animal and plant quarantine organ of the exporting country or region, and be released after passing the quarantine inspection; Those who bring dogs, cats and other pets into the country must also hold vaccination certificates. If there is no quarantine certificate or vaccination certificate, the port animal and plant quarantine machine will shut it down and return it within a time limit or confiscate it and destroy it. If it is returned within a time limit, the carrier must collect and take it out of the country with the interception certificate issued by the port animal and plant quarantine office within the specified time; If it is not collected within the time limit, it will be given up automatically. Those who bring plants, animal and plant products and other quarantine objects into the country and pass the on-site quarantine shall be released on the spot; Where laboratory quarantine or isolation quarantine is necessary, the port animal and plant quarantine office shall issue an interception certificate. Those who pass the interception and quarantine inspection shall be collected by the carrier with the interception certificate of the port animal and plant quarantine office; If it is not collected within the time limit, it will be given up automatically.

It is prohibited to bring or mail animals and plants, animal and plant products and other quarantine objects listed in the catalogue stipulated in Article 29 of the Entry-Exit Animal and Plant Quarantine Law into the country.

Article 44 Animals and plants, animal and plant products and other quarantine objects mailed into China shall be quarantined by the port animal and plant quarantine organ of the International Mail Exchange Bureau (including international mail express companies and other units dealing in international mail, hereinafter referred to as the post office), and the post office shall provide necessary working conditions.

Those who pass the on-site quarantine inspection shall be stamped with the quarantine release stamp by the port animal and plant quarantine office and delivered to the post office. If laboratory quarantine or isolation quarantine is needed, the port animal and plant quarantine office shall handle the handover formalities with the post office; Those who pass the quarantine inspection shall be stamped with the quarantine release stamp and delivered to the post office.

Article 45 Animals and plants, animal and plant products and other quarantine objects brought or mailed into China that fail to pass the quarantine inspection and there is no effective way to carry out disinfection and disinfestation treatment shall be returned or destroyed, and a notice of quarantine treatment shall be issued to the carrier and the sender.

Chapter VII Quarantine of Means of Transport

Article 46 The port animal and plant quarantine office may conduct on-site quarantine on ships, planes and trains from animal and plant epidemic areas. The person in charge of the relevant means of transport shall accept the inquiry of the quarantine personnel and sign the inquiry record, provide the operation log and the cargo loading situation, and open the cabin for quarantine inspection.

The port animal and plant quarantine office shall carry out quarantine inspection on places where animal and plant products such as dining cars, tea rooms, kitchens, storerooms and pantries are stored and used, places where swill and animal and plant wastes are stored, containers and other means of transport mentioned in the preceding paragraph may hide pests and diseases; When necessary, do a good job in epidemic prevention and disinfection.

Article 47 Vessels, planes and trains from animal and plant epidemic areas must be fumigated, disinfected or otherwise disinfected if they find diseases and insect pests listed in the catalogue stipulated in Article 18 of the Entry-Exit Animal and Plant Quarantine Law. Animals and plants, their products and other quarantine objects prohibited from entering the country must be sealed up or destroyed; Those sealed shall not be unsealed and used without the permission of the port animal and plant quarantine office during their stay or operation in China. The swill, animal and plant wastes and their storage places and containers on the means of transport shall be disinfected under the supervision of the port animal and plant quarantine office.

Article 48 Entry vehicles from animal and plant epidemic areas shall be disinfected by the port animal and plant quarantine office. Vehicles loaded with imported animals and plants, animal and plant products and other quarantine objects shall be treated together with the goods if pests and diseases are found after quarantine. Animals in Hong Kong and Macao are shipped empty, and vehicle epidemic prevention and disinfection are implemented.

Article 49 The port animal and plant quarantine office shall carry out quarantine on the scrapped ships that have been dismantled at the entry. If pests and diseases are found, they shall be dealt with under the supervision of the port animal and plant quarantine office. Animals and plants, their products and other quarantine objects prohibited from entering the country shall be destroyed under the supervision of the port animal and plant quarantine office. Article 50 If the person in charge of the imported means of transport from an animal and plant epidemic area passes the quarantine or disinfection treatment, or his agent requests a certificate, the port animal and plant quarantine office shall issue a certificate of quarantine or disinfection of the means of transport.

Article 50 During their stay in China, transport workers and other inbound passengers are not allowed to leave the transport with animals and plants, their products and other quarantine objects. If you need to take it away, you should apply to the port animal and plant quarantine office for inspection.

Article 52 The means of transport carrying animals out of the country shall be disinfected under the supervision of the port animal and plant quarantine office before loading.

Means of transport carrying plants, animal and plant products and other quarantine objects out of the country shall comply with the relevant provisions of the state on animal and plant epidemic prevention and quarantine. If dangerous pests or general pests exceeding the prescribed standards are found, they can be shipped only after disinfection.

Chapter VIII Quarantine Supervision

Article 53 The State Animal and Plant Quarantine Bureau and the port animal and plant quarantine office shall implement a quarantine supervision system for the production, processing and storage of entry and exit animals and plants and their products. The specific measures shall be formulated by the administrative department of agriculture of the State Council.

Article 54 If seeds, seedlings and other propagating materials of entry-exit animals and plants need to be raised and planted in isolation, they shall be subject to quarantine supervision by the port animal and plant quarantine office during the isolation period.

Article 55 Units and personnel engaged in fumigation and disinfection of entry-exit animal and plant quarantine must pass the examination by the port animal and plant quarantine office.

The port animal and plant quarantine office shall supervise and guide the fumigation and disinfection work, and be responsible for issuing the fumigation and disinfection certificate.

Article 56 The port animal and plant quarantine office may, when necessary, monitor the animal and plant epidemic situation in airports, ports, stations, warehouses, processing plants, farms and other places where animals and plants, animal and plant products and other quarantine objects are produced, and the relevant units shall cooperate.

Without the permission of the port animal and plant quarantine office, the monitoring instruments for animal and plant epidemic situation shall not be moved or damaged. Article 57 The port animal and plant quarantine office may, when necessary, affix animal and plant quarantine seals or marks on the means of transport and containers carrying animals and plants, their products and other quarantine objects; Without the permission of the port animal and plant quarantine office, quarantine seals and signs shall not be opened or damaged. The seals and signs of animal and plant quarantine shall be uniformly issued by the State Animal and Plant Quarantine Bureau.

Article 58 Entry animals and plants, animal and plant products and other quarantine objects shall be transported to the bonded area (including bonded factories and bonded warehouses) with containers and packages containing animals and plants, animal and plant products and other quarantine objects. Carry out quarantine inspection at the port of entry according to law; The port animal and plant quarantine office may carry out quarantine supervision according to specific conditions; Those transported out of the country after treatment shall be handled in accordance with the entry-exit animal and plant quarantine law and the relevant provisions of these regulations on exit quarantine.

Chapter IX Legal Liability

Article 59 Whoever commits one of the following illegal acts shall be fined less than 5,000 yuan by the port animal and plant quarantine office:

(1) Failing to apply for inspection or go through the formalities of quarantine examination and approval according to law, or failing to implement the provisions of quarantine examination and approval;

(2) The animals and plants, animal and plant products and other quarantine objects submitted for inspection are inconsistent with the actual situation.

Anyone who commits the acts listed in Item (2) of the preceding paragraph and has obtained the quarantine certificate shall be revoked.

Article 60 Whoever commits one of the following illegal acts shall be fined between 3,000 yuan and 30,000 yuan by the port animal and plant quarantine office:

(1) Unloading or transporting animals and plants, animal and plant products and other quarantine objects entering or passing through the country without the permission of the port animal and plant quarantine office;

(2) Unauthorized transfer or disposal of animals and plants quarantined in isolation places designated by the port animal and plant quarantine office;

(3) Unpacking transit animals and plants, animal and plant products and other quarantine objects without authorization, or unpacking or damaging animal and plant quarantine seals and marks without authorization.

(4) Abandoning the carcasses, excrements, bedding or other wastes of transit animals without authorization, or failing to dispose of swill and animal and plant wastes on the means of transport in accordance with regulations.

Article 60 Units that produce, process and store animals and plants, animal and plant products and other quarantine objects registered in accordance with the provisions of Articles 17 and 32 of these Regulations shall be returned, destroyed or disinfected in accordance with the relevant provisions of these Regulations, and if the circumstances are serious, the port animal and plant quarantine office shall cancel the registration.

Article 62 Anyone who commits one of the following illegal acts shall be investigated for criminal responsibility according to law; If it does not constitute a crime or the circumstances of the crime are minor, and it is unnecessary to be sentenced to punishment according to law, the port animal and plant quarantine office shall impose a fine of not less than 20,000 yuan but not more than 50,000 yuan:

Causing a major animal and plant epidemic,

(2) Forging or altering animal and plant quarantine documents, seals, marks and seals.

Article 63 If the units and personnel engaged in fumigation and disinfection of entry-exit animal and plant quarantine fail to carry out fumigation and disinfection in accordance with the provisions, the port animal and plant quarantine office may cancel their fumigation and disinfection qualifications according to the circumstances.

Chapter X Supplementary Provisions

Article 64 The meanings of the following terms in the Entry-Exit Animal and Plant Quarantine Law and these Regulations:

(1) "Plant seeds, seedlings and other propagating materials" refers to the whole plant or part of cultivated and wild plants that can be propagated, such as plants, seedlings (including test-tube seedlings), fruits, seeds, rootstocks, scions, cuttings, leaves, buds, tubers, stems, bulbs, pollen and cell cultures.

(2) "Loading containers" refer to containers that can be used for many times and are easily polluted by pests and diseases, such as cages, boxes, barrels, baskets, etc., and are used for loading inbound and outbound goods.

(3) "Other pests" refers to all kinds of biological organisms and pathogenic microorganisms that endanger animals and plants except animal infectious diseases, parasitic diseases and plant dangerous sexually transmitted diseases, insects and weeds, and intermediate hosts and vectors of mollusks, rodents, mites, polypods and dangerous pests and diseases.

(4) "Quarantine Certificate" refers to the legally binding documents on the health or hygiene status of animals and plants, their products and other quarantine objects issued by the animal and plant quarantine organ.

Article 65 Expenses or losses arising from quarantine, fumigation, disinfection, return and destruction of animals and plants, their products and other quarantine objects entering or leaving the country shall be borne by the owner or his agent.

Article 66 When the port animal and plant quarantine office needs sampling quarantine according to law, it shall issue a sampling certificate. The owner, the owner or his agent shall retrieve the remaining samples within the prescribed time limit. Failing to retrieve the samples within the prescribed time limit, the port animal and plant quarantine office shall handle them according to the regulations.

Article 67 The quarantine organ for the exit of trade animal products shall be formulated by the State Council according to the application.
