Regulations of Wuxi Municipality on Property Management (202 1 Revision)

Chapter I General Provisions Article 1 In order to regulate property management activities, safeguard the legitimate rights and interests of all parties involved in property management, create a good living and working environment, and promote the construction of a harmonious community, these Regulations are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council, the Regulations on Property Management of Jiangsu Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to property management and its supervision and management activities within the administrative area of this Municipality. Article 3 The municipal, county-level city and district people's governments shall strengthen the leadership and organization of property management, formulate and implement supporting policies, establish a target responsibility mechanism for property management, encourage the adoption of new technologies and methods, and improve the level of property management and service.

Street offices (Town People's Government) shall be clearly responsible for the property management department, equipped with full-time staff, and perform the following duties:

(a) to organize and guide the establishment of the owners' meeting, the election and change of the owners' committee and the establishment of the property management committee;

(two) to guide and supervise the owners' congress, the owners' committee and the property management committee to perform their duties according to law;

(three) to guide the property to undertake the inspection and handover of property management projects;

(four) to supervise and guide the property service providers to perform their obligations according to law;

(five) overall coordination, supervision and guidance of other property management activities within the jurisdiction;

(six) the implementation of old residential areas, resettlement housing area management.

Community neighborhood (village) committees shall assist and cooperate with neighborhood offices (town people's governments) to carry out property management-related work, and give play to the role of the cooperative operation mechanism of community neighborhood (village) committees and property service enterprises under the guidance of party building in community governance. Article 4 The municipal administrative department of property management shall perform the following duties:

(a) to formulate policies related to property management and organize their implementation;

(two) to guide and supervise the county-level city and district property management administrative departments to carry out property management supervision and management;

(three) to guide and supervise the collection, management and use of residential special maintenance funds;

(four) to establish and improve the training system for members of the owners' committee and the property management committee;

(five) to formulate temporary management regulations, management regulations, rules of procedure of the owners' congress, property service contracts and other model texts and related standards;

(six) the establishment of a unified property management credit information, owners of electronic decision-making and other information systems;

(seven) to guide industry associations to formulate and implement self-discipline norms;

(eight) to perform other duties of supervision and management of property management.

The district property management administrative department shall perform the following duties:

(a) the implementation of property management policies and systems;

(two) supervision and management of the property service enterprises and employees within their respective jurisdictions;

(three) responsible for the collection, management (except Liangxi District, Binhu District and Wuxin District), approval and use of special maintenance funds for residential buildings within the jurisdiction;

(four) to organize the training of members of the owners' committee and the property management committee within their respective jurisdictions;

(five) to guide the street offices (town people's government) to implement the relevant work of property management;

(six) to perform other duties of supervision and management of property management.

County-level city property management administrative departments shall perform the duties stipulated in items 1, 4 to 7 and 2 of the first paragraph of this article.

Development and reform, civil affairs, finance, natural resources planning, urban management, public security, municipal gardens, civil air defense and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of property management activities. Article 5 The municipal, county-level city and district people's governments shall establish a coordination mechanism for property management to coordinate and solve major problems in property management.

Neighborhood offices (town people's governments) shall, jointly with the county-level city and district property management administrative departments, establish a joint meeting system attended by community neighborhood committees, public security police stations, owners' committees, property service providers and construction units. The joint meeting shall be convened by the sub-district office (town people's government) to coordinate and deal with the problems arising from the election of the owners' committee and the handover of property service providers, as well as other major property management disputes.

Establish and improve a diversified dispute resolution mechanism that integrates people's mediation, industry mediation, administrative mediation and judicial mediation, and mediate and resolve contradictions and disputes in property management. Article 6 During the emergency response period, the property service provider shall implement the emergency response measures and other management measures implemented by the government according to law, and actively cooperate with relevant work; Sub-district offices (Town People's Government) shall guide property service providers to carry out coping work and give material and financial support.

For property service providers to implement emergency measures and other management measures implemented by the government according to law, the owners shall cooperate with them according to law. Article 7 The realty service industry association shall strengthen the self-discipline management of the industry, formulate industry norms, train employees, standardize the practice behavior, promote the integrity management, and improve the level of realty service. Chapter II Owners' Congress, Owners' Committee and Property Management Committee Article 8 If the conditions for the establishment of the owners' congress are met, the subdistrict office (town people's government) shall organize the establishment of the preparatory group for the first owners' congress within 60 days from the date of receiving the written application from the construction unit or more than ten owners.

The preparatory group consists of owners, neighborhood offices (town people's governments), construction units, public security police stations and members of community residents' (village) committees. The number of the preparatory group shall be an odd number of five to eleven, of which the owner's members shall be no less than 60% of the number of the preparatory group. The head of the preparatory group is appointed by the sub-district office (town people's government). Members of the owners are recommended by the neighborhood offices (town people's governments) to organize the owners. Owners have objections to the members of the preparatory group, by the street office (town people's government) to coordinate and solve.

The recommendation method of the owner members in the preparatory group shall be determined by the sub-district office (town people's government) after soliciting the opinions of all the owners.
