Measures for the Implementation of Bidding for Early Property Management in Jiangsu Province

Article 8 The term "tenderee" as mentioned in these Measures refers to the project construction unit that conducts the preliminary property management bidding according to law.

The preliminary property management bidding shall be organized and implemented by the tenderer according to law. The tenderer shall unify the multi-company construction projects in a property management area by stages, and the property management area agreed in the tender shall be consistent with the property management area actually delivered for use.

Article 9 A tenderer who has the ability to prepare bidding documents and organize the implementation of bidding activities may organize bidding by himself; A tenderer may also entrust a bidding agency to organize bidding.

Where the tenderee entrusts an agency to organize the bidding, the agency shall be a legally established social intermediary organization with corresponding professional strength to prepare the bidding documents, verify the qualifications of the bidding applicants and organize the bid evaluation. The tendering agency shall handle the tendering matters within the scope entrusted by the tenderer and abide by the provisions of these Measures on the tenderer.

Tenth preliminary property management bidding is divided into public bidding and invitation bidding.

Take the form of public bidding, it shall publish a tender announcement in the public media, and publish a tender announcement on the website designated by the China Housing and Real Estate Information Network, China Property Management Society Network or Jiangsu Construction Information Network or the property management administrative department of the city where the project is located; The specific release website shall be determined by the tenderer according to the scope of public bidding. The tender announcement shall specify the name, address and contact information of the tenderer, the basic information of the project subject to tender, the time schedule of the tender activities, the conditions of the bidding applicant and the pre-qualification measures for bidding.

Where a tenderer adopts the method of inviting tenders, it shall issue an invitation to bid to three or more property management enterprises with corresponding qualifications, which shall include the matters specified in the preceding paragraph and the way to obtain the tender documents.

Eleventh the tenderer shall, according to the characteristics and needs of the property management in the early stage of the project subject to tender, complete the preparation of the tender documents and the tender filing before the start of the tender activities.

The bidding documents for early property management shall include the following contents:

(1) Brief introduction of the tenderer and the project subject to tender, including the name, address and contact information of the tenderer, the basic situation of the project planning and construction (name, type, location, construction area, four districts, main economic and technical indicators, construction delivery date and completion date), relevant facilities and equipment, and the configuration of property management houses, etc.;

(two) the time and service requirements for the early intervention of property management, and the requirements for the takeover and acceptance of roads, green spaces, public places, public facilities, parking spaces (garages), property management houses, houses, facilities and equipment owned by relevant owners;

(3) Requirements for bidders and bidding documents, including bidder qualification, bidding document format, number of bidding documents, enterprise situation, overall objectives and requirements of management services, resumes and achievements of the person in charge of the management project to be sent, design mode of property management, organization setting, post arrangement, personnel training plan, management system, equipped mechanical equipment and measures taken, calculation of property service fee standards, energy consumption management, etc.

(4) Lease management after the delivery of the operating property, including the ownership of parking lots (garages), clubs and other related facilities and the service charging methods;

(5) Property services (including owner's occupancy, establishment of service system and network, maintenance of house use parts and facilities, public greening maintenance management, public order maintenance, vehicle parking management, fire management, decoration management service, public environmental sanitation and cleaning, property information management, customer service, etc.).

(six) financial management, including the management of the use of property service fees (contract system, gratuity system or other methods) and special maintenance funds;

(seven) to sign the preliminary property service contract and formulate the temporary convention of the owners;

(eight) housing quality assurance documents and housing instructions;

(nine) the property management conditions or preferential conditions provided by the tenderer to the winning bidder;

(ten) evaluation criteria and methods, and the principle of determining invalid bidding;

(eleven) the payment of the bid bond, the economic compensation measures for the unsuccessful bidder to prepare the bid documents, etc. ;

(twelve) the tenderer and the winning bidder's liability for breach of contract;

(13) Explain the bidding documents and bidding activity plan, including site survey, bid delivery place and deadline, bid opening time and place, etc. ;

(14) Description of other tender matters and other contents as stipulated by laws and regulations.

Article 12 If the tender documents require the bidder to pay the bid bond, the bidder shall pay it; The bid bond shall be returned to the bidder within 10 days after the winning bidder is determined.

If the tender documents promise to pay the compensation fee for the preparation of the pre-tender estimate to the unsuccessful bidders, the tenderer shall pay it; The compensation standard can be compensated by stages according to the bidder's bid evaluation score.

Article 13 A bidder for a residential property project shall submit the following materials to the property management administrative department of the county (city, district) where the property project is located for the record before issuing the tender announcement or invitation letter 10:

(a) government approval documents such as land, planning and construction, and construction permit for the project construction;

(2) A tender announcement or an invitation to bid;

(3) tender documents;

(4) Entrustment contract of tendering agent (applicable to agents);

(5) Other materials as prescribed by laws and regulations.

If the property management administrative department finds that the tenderee violates laws, regulations and these Provisions, it shall order the tenderee to make corrections.

Article 14 Where the prequalification of bidders is implemented in public bidding, the tenderee shall specify the conditions and methods of prequalification in the tender announcement as the basis for prequalification of bidders.

Pre-qualification documents shall generally include the enterprise qualification documents, performance, technical equipment, financial status, resumes, performance and other supporting materials of the project leader and main management personnel to be dispatched.

When there are too many pre-qualified bidders in public bidding, the tenderee shall choose not less than five pre-qualified bidders as bidders by means of open random drawing or by means of pre-qualification of the qualifications and performance of the bidding applicants specified in the tender announcement.

Fifteenth after the prequalification, the tenderer shall issue a prequalification notice to the bidders who have passed the prequalification, informing them of the time, place and method of obtaining the tender documents; At the same time, the prequalification results will be notified to the unqualified bidders.

Article 16 A tenderer shall determine a reasonable time for bidders to prepare their bid documents; From the date of issuing the tender documents to the deadline for submitting the tender documents, the preparation time of the tender documents shall not be less than 20 days.

Article 17 If a tenderer makes necessary clarifications or amendments to the issued tender documents, it shall notify all recipients of the tender documents in writing at least 65 days before the deadline for submission of tender documents required by the tender documents; This clarification or modification is an integral part of the tender documents.

The tenderer clarifies or modifies the substantive contents of the tender documents, including the main economic and technical indicators of the project subject to tender, the project construction progress and completion delivery time, property management conditions, the content or standard of property management services, the time or place of bid opening and evaluation, evaluation methods, and the signing of the preliminary property service contract, etc. , shall be reported in writing to the property management administrative department for the record.

Article 18 A tenderer may, according to the specific conditions of a property management project, organize the recipients of the tender documents to inspect the site of the property project within 5 days after the tender documents are issued, and provide information such as concealed engineering drawings. The tenderer shall clarify the questions raised by the recipients of the tender documents or send them to all recipients of the tender documents in written form.

Article 19 A tenderee shall not disclose to others the bidding information that may affect fair competition.

If the tenderer has a pre-tender estimate, the pre-tender estimate must be kept confidential.

Article 20 Before determining the winning bidder, the tenderee shall not negotiate and communicate with the bidders on the bid price, bid plan and other substantive contents.

Article 21 Where a property management enterprise is selected through bidding, the tenderer shall complete the bidding work within the following prescribed time limit:

(a) new commercial housing projects should be completed 30 days before the sale;

(two) the pre-sale of commercial housing projects should be completed before obtaining the "pre-sale permit for commercial housing";

(three) new projects that are not for sale should be completed 90 days before delivery.
