"Chongqing elevator safety management measures" has been adopted at the107th executive meeting of the municipal people's government on 20 15 years123 October, and is hereby promulgated and shall come into force as of 20 16 years/23 October.

Chapter I General Provisions

Article 1 In order to strengthen elevator safety, reduce elevator failures, prevent elevator accidents, and ensure personal and property safety, these Measures are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment and other relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 These Measures shall apply to the supervision and management of elevator production (including manufacturing, installation, renovation and maintenance), operation, use, inspection and testing and elevator safety within the administrative area of this Municipality.

The elevators mentioned in these Measures include manned (cargo) elevators, escalators and moving sidewalks. The specific types, categories and varieties are determined according to the Catalogue of Special Equipment of the State Council.

Article 3 The people's governments of cities, districts and counties (autonomous counties) shall be responsible for leading the elevator safety work within their respective administrative areas, urging relevant departments to perform their duties of supervision and management according to law, and coordinate and solve major problems existing in elevator safety supervision and management in a timely manner.

Township people's governments and sub-district offices shall assist the relevant departments of the people's governments at higher levels to strengthen the daily inspection of elevator safety within their respective jurisdictions and establish an elevator safety management system.

Fourth city, county (Autonomous County) people's government special equipment safety supervision and management department is responsible for the elevator safety supervision and management within their respective administrative areas.

The construction administrative department shall, jointly with relevant departments, supervise and manage the elevator selection and configuration; The real estate administrative department shall, jointly with the relevant departments, establish a management mechanism for the use of elevator renovation and maintenance funds, and urge the property service enterprises to assume the responsibility for the safety management of elevator use; The fire control institution of the public security organ shall, jointly with the safety supervision and management department of special equipment, carry out the rescue and disposal of elevator accidents.

Education, commerce, health and family planning, transportation, tourism, sports and other relevant departments shall, in accordance with their respective responsibilities, do a good job in elevator safety supervision and management.

Article 5 Elevator manufacturing units, elevator installation, renovation and maintenance units and elevator operation and use units shall abide by laws and regulations, safety technical specifications and relevant standards, establish and improve the elevator safety responsibility system, strengthen elevator safety management, and ensure elevator manufacturing, installation, renovation and maintenance, operation and use safety.

Article 6 The elevator safety liability insurance shall be implemented.

Elevator used in schools, kindergartens, hospitals, airports, stations, passenger terminals, shopping malls, stadiums, tourist attractions, exhibition venues, parks and other public gathering places shall be insured with elevator safety liability insurance in accordance with the Insurance Law of People's Republic of China (PRC) and relevant regulations.

Seventh special equipment safety supervision and management departments and relevant departments should strengthen the publicity and education of elevator safety laws and regulations and safety knowledge, and enhance public safety awareness and self-protection ability.

Elevator users, news media and industry associations should popularize and publicize elevator safety knowledge and common sense, and advocate civilized use of elevators.

Elevator manufacturing units, elevator installation, renovation and maintenance units, units engaged in elevator maintenance and special equipment inspection and testing institutions shall strengthen the publicity of elevator safety professional knowledge.

Eighth to encourage the elevator safety science and technology research, encourage the use of advanced technology and scientific management means to improve the elevator safety performance and management level, enhance the ability of accident prevention and emergency rescue.

Article 9 Elevator-related industry associations shall strengthen industry self-discipline, promote the construction of industry credit system, carry out industry information analysis and research, organize education, training and consultation, participate in the formulation of relevant standards, and improve industry service level and elevator safety management level.

Chapter II Production and Management

Tenth elevator production in accordance with state regulations in accordance with the law to implement the licensing system.

No unit or individual may forge, falsely use, alter, resell, lease or lend the license certificate.

Eleventh elevator manufacturing units should ensure that elevator production meets the requirements of laws and regulations, safety technical specifications and related standards, and be responsible for the safety performance of the elevators they produce.

Twelfth elevator installation, renovation and maintenance, must be carried out by the elevator manufacturing unit or its entrusted unit to obtain the corresponding license according to law. Elevator manufacturing units entrust other units to install elevators,

Where renovation and maintenance are involved, safety guidance and monitoring shall be carried out for its installation, renovation and maintenance, and verification and debugging shall be carried out in accordance with the requirements of safety technical specifications. Elevator manufacturing units are responsible for the safety performance of elevators.

The entrusted unit shall not subcontract the elevator installation, renovation and maintenance business.

No unit or individual may engage in elevator installation, renovation and maintenance activities in the form of affiliation.

Article 13 After the installation of the elevator is completed, the elevator installation unit shall hand over the elevator factory data, elevator installation technical data, elevator installation self-inspection report, elevator supervision and inspection qualified report and other technical data to the elevator user unit, and handle the written delivery procedures.

If the elevator installation unit fails to go through the delivery procedures or pass the supervision and inspection, no unit or individual may use the elevator except for debugging and testing in accordance with the safety technical specifications.

Fourteenth after the completion of elevator renovation and maintenance, the elevator renovation and maintenance unit shall hand over the relevant technical data and documents to the elevator users.

After the elevator transformation is completed, the elevator transformation unit shall paste the elevator nameplate in a prominent position of the elevator car, indicating the unit name, license number and other information.

Fifteenth elevator business units should check the elevator design documents, product quality certificates, installation and maintenance instructions, type test reports of main components, supervision and inspection certificates and other documents when selling elevators, and establish acceptance and sales records.

It is forbidden to sell the following elevators:

(a) Unauthorized production;

(two) the state has explicitly eliminated and scrapped;

(3) The safety performance is defective;

(four) the use of scrapped and refurbished parts assembled;

(five) does not meet the requirements of safety technical specifications and related standards;

(6) Other elevators prohibited by laws and regulations.

Sixteenth construction units should be in accordance with the relevant provisions and standards for elevator selection and configuration; If the selection and configuration do not meet the relevant regulations and standards, the construction drawing design documents shall not be submitted for approval.

The construction unit shall, in accordance with the quality requirements of construction projects, technical standards for fire control of construction projects and technical specifications for elevator safety, build elevator shafts, machine rooms and other buildings and ancillary facilities related to elevator safety.

Construction units and construction units are prohibited from using elevators to carry construction materials, construction waste and other engineering construction operations.

Chapter III Use

Seventeenth elevator users to fulfill the obligations of elevator safety management, bear the responsibility for safety.

Eighteenth elevator users shall, before or within 30 days after the elevator is put into use, go through the use registration with the local district/county (autonomous county) special equipment safety supervision and management department and obtain the use registration certificate; When handling the use registration procedures, the elevator user shall state in writing the date when the elevator is put into use.

If the elevator use registration information is changed, the elevator user shall go through the formalities of change at the original use registration authority within 30 days after the change.

Nineteenth elevator users should establish post responsibility, hidden danger management, emergency rescue and other safety management systems and elevator safety technology file storage system, and formulate elevator operation procedures to ensure the safe operation of elevators.

Twentieth elevator users shall abide by the following provisions in the management of elevator use:

(a) the establishment of elevator safety management institutions in accordance with the law, equipped with elevator safety management personnel and operators;

(two) to carry out regular maintenance and self-inspection of the elevators used by them, and make records;

(three) regularly check and maintain the safety accessories and safety protection devices of the elevators used by them, and make records;

(4) Posting effective elevator use registration signs, safe use instructions, safety precautions and warning signs, and emergency rescue telephone numbers in a prominent position in the elevator car;

(five) to strengthen the daily inspection of elevator safety, eliminate hidden dangers in time;

(six) in abnormal circumstances such as elevator failure, passengers are explicitly prohibited from taking the elevator in a prominent position;

(seven) when passengers are trapped by elevator failure, immediately arrange elevator operators to take measures to organize rescue, and do a good job of comforting the trapped passengers;

(eight) set up an emergency alarm device or emergency rescue telephone in the elevator car to ensure its normal use and be on duty 24 hours a day;

(9) Give the elevator landing door special key, car control switch key, machine room key and escalator (sidewalk) special key to elevator safety management personnel or operators for safekeeping and use;

(ten) to ensure the normal use of air conditioning, elevator car lighting and other facilities and equipment in the elevator room;

(eleven) according to the emergency rescue plan, organize no less than one emergency rescue drill every year;

(twelve) timely handling of elevator safety complaints, and make a record of complaint handling;

(thirteen) other provisions of laws and regulations.

Twenty-first elevator users should entrust the elevator manufacturing unit or the installation, renovation and maintenance unit that has obtained the license according to law to maintain the elevator.

Article 22 If the elevator machine room is set on the top floor or the top floor, the elevator user shall install air conditioners in the elevator machine room to meet the needs of the safe operation of the elevator.

Twenty-third elevator users to carry out internal decoration of the elevator car, shall not change the elevator performance parameters; The change of elevator performance parameters shall be handled by the elevator manufacturing unit or the unit entrusted by it to obtain the corresponding license according to law in accordance with the relevant provisions of elevator transformation.

Elevator users should use flame retardant materials when decorating the interior of elevator car.

Article 24 If there are serious accidents in the elevator, it has no value for renovation or repair, or meets other scrapping conditions stipulated in safety technical specifications and relevant standards, the elevator user shall fulfill the obligation of scrapping according to law, take necessary measures to eliminate the use function of the elevator, and go through the cancellation procedures of the use registration certificate with the original use registration authority within 30 days after scrapping.

Article 25 After an elevator accident, the elevator user shall take measures according to the emergency rescue plan, organize rescue, prevent the accident from expanding, reduce casualties and property losses, protect the scene of the accident and relevant evidence, and report to the special equipment safety supervision and management departments and relevant departments in the counties (autonomous counties) where the accident occurred within 1 hour.

Twenty-sixth in any of the following circumstances, the elevator management unit may entrust special equipment inspection and testing institutions to carry out elevator safety assessment:

Twenty-seventh elevator daily operation, maintenance, renovation, maintenance, inspection, testing, safety assessment and other expenses shall be borne by the elevator owner, and the elevator user shall assist the elevator owner in organizing the implementation of the required funds.

Twenty-eighth elevator in use, the elevator manufacturing unit shall comply with the following provisions:

(a) tracking, investigating and understanding the safe operation of the elevators manufactured by them, and making records;

(2) Put forward improvement suggestions and provide necessary technical assistance (including technical upgrading, technical training, technical data and necessary elevator parts, etc.). For the problems existing in the elevator maintenance and safe operation of the maintenance unit or the user unit;

(three) found that there are serious accidents in the elevator, promptly inform the elevator users, and report to the local district (county) special equipment safety supervision and management department;

(four) shall not set the elevator password and other technical barriers to limit the safe operation of the elevator.

If the elevator manufacturing unit is cancelled, missing or does not have the corresponding qualifications, the elevator using unit shall choose other elevator manufacturing units with corresponding qualifications to undertake the obligations specified in the preceding paragraph.

Twenty-ninth passenger elevators shall abide by the elevator safety instructions, safety precautions and warning signs, and shall not have the following acts:

(1) Taking an elevator that is obviously in an abnormal state;

(2) Opening the elevator landing door by unsafe means;

Chapter IV Inspection and Testing

Thirtieth elevators shall be inspected and supervised regularly in accordance with the provisions of the state, and shall not be used without inspection or unqualified inspection.

Thirty-first special equipment inspection and testing institutions shall, after receiving the written materials submitted by the elevator users, handle them in accordance with the following provisions:

(1) If the materials are complete and conform to the statutory form, it shall be accepted on the spot;

(two) the materials are incomplete or do not meet the statutory form, and can be corrected on the spot. After correction, it shall be accepted on the spot;

(3) If the materials are incomplete or do not conform to the statutory form but cannot be corrected on the spot, it shall inform all the contents that need to be corrected at one time within three working days. Fails to inform, the date of receipt of the materials as the date of acceptance.

Thirty-second special equipment inspection and testing institutions shall complete the inspection and testing within 20 working days from the date of acceptance; If the inspection cannot be completed within 20 working days, it may be extended by 10 working days with the approval of the person in charge of this institution.

Special equipment inspection and testing institutions shall deliver the inspection results to elevator users within 10 working days after the inspection is completed.

Thirty-third special equipment inspection and testing institutions in the inspection found that the elevator needs rectification, in accordance with the following provisions:

(1) In case of rectification of general accident hazards, the elevator user shall be informed in writing within 1 working day and required to complete the rectification within 5 working days;

(two) there are major accidents rectification matters, need to carry out renovation and major maintenance, it shall inform the elevator user in writing within 1 working days, and require it to complete the rectification within 30 working days.

Special equipment inspection and testing institutions shall conduct on-site verification on whether the elevator users are qualified for rectification. If the elevator user fails to make rectification within the time limit or fails to pass the inspection after rectification, the special equipment inspection and testing institution shall make a conclusion that the inspection is unqualified.

The rectification period of elevator users is not included in the inspection cycle of special equipment inspection and testing institutions.

Thirty-fourth special equipment inspection and testing institutions in the inspection found that there are serious accidents in the elevator, it should promptly inform the elevator users in writing, and immediately report in writing to the local district (county) special equipment safety supervision and management department.

After receiving the written notice from the special equipment inspection and testing institution, the elevator user shall immediately stop using the elevator and take timely measures to eliminate hidden dangers.

Thirty-fifth elevator users should provide necessary elevator inspection site conditions for special equipment inspection and testing institutions.

Special equipment inspection and testing institutions shall judge the conditions of elevator inspection site, and conduct inspection if they meet the conditions; If it does not meet the requirements, it shall notify the elevator user in writing at one time. If it is not informed or the information is incomplete, it shall be deemed to meet the inspection conditions.

Thirty-sixth elevator manufacturing units, elevator installation, renovation and maintenance units, elevator users can put forward testing requirements to special equipment inspection and testing institutions according to needs, and special equipment inspection and testing institutions shall provide testing services according to law and be responsible for the testing conclusions.

Article 55 The meanings of the following terms in these Measures:

(1) Overhaul refers to the activity of repairing the main components and safety components of the elevator without changing the original performance parameters and technical indicators of the elevator. The specific scope is determined in accordance with the relevant provisions of the state.

(2) Extraordinary accidents refer to the illegal production or use of waste parts to assemble elevators; The main components and safety protection devices of the elevator are invalid or missing; The elevator continues to be used without comprehensive inspection after the accident; Use elevators explicitly eliminated by the state; The elevator failed to pass the inspection due to the equipment itself.

Article 56 These Measures shall come into force as of 20061October 2065438+ 1 day.
