Article 1 In order to encourage and guide social funds to invest in municipal solid waste treatment, accelerate the process of municipal solid waste treatment, further improve the urban ecological environment and promote sustainable development, according to the Price Law of People's Republic of China (PRC) and the Notice of the State Planning Commission, the Ministry of Finance, the Ministry of Construction and the State Environmental Protection Administration on Implementing the Charge System for Municipal Solid Waste Treatment to Promote the Industrialization of Garbage Treatment (JJ [2002] No.872).

Second cities and counties with municipal solid waste treatment facilities within the province shall implement the municipal solid waste treatment fee system. All state organs, enterprises and institutions (including means of transportation), social organizations, individual operators, urban residents and urban temporary residents who produce domestic garbage in cities where the domestic garbage disposal fee system is implemented shall pay the domestic garbage disposal fee according to regulations.

Article 5 The competent price departments of governments at all levels are the competent departments of municipal solid waste treatment fees, and the administrative departments of finance, construction and environmental protection at all levels shall do a good job in the supervision and management of municipal solid waste treatment fees according to their duties.

Article 7 The municipal solid waste disposal fee shall be set by the government, which shall be formulated by the price department of the Municipal People's Government jointly with the administrative department of construction (environmental sanitation), implemented after the approval of the people's government at the same level, and reported to the provincial price and construction administrative department for the record.

The price hearing system should be implemented to formulate and adjust the standard of municipal solid waste treatment fee.

Specific relief measures and supervision measures shall be formulated by the Municipal People's Government according to the actual situation.

Eleventh after the collection of municipal solid waste disposal fees, all other charges related to domestic waste disposal will be cancelled. Establish a market access system, actively explore various modes of operation such as contracting operation and leasing operation that conform to the laws of the market economy, encourage domestic and foreign funds, including private enterprises, to invest in the construction and operation of garbage disposal facilities, and finally establish a garbage disposal operation mechanism that conforms to the requirements of the market economy.

Fifteenth municipal solid waste management enterprise management, the introduction of market competition mechanism. Through public bidding, select capable enterprises to undertake the treatment of municipal solid waste. By signing the contract, the responsibilities, obligations and rights of each party are clearly defined, avoiding multi-head management and multi-head charging, prompting enterprises to reduce the processing cost and effectively ensuring that garbage disposal meets environmental protection requirements.

Article 16 The administrative department of urban construction (environmental sanitation) shall strengthen the supervision and management of urban domestic garbage disposal. If the treatment standards and service quality are not up to standard, it shall be ordered to make corrections within a time limit. Repeated inspection for more than two times is still not correct, terminate its right to operate. The garbage disposal plant with potential pollution hazards shall be ordered to put forward a transformation plan and make rectification within a time limit. Environmental protection departments should strengthen the supervision and inspection of the quality of garbage disposal facilities and their surrounding environment, and punish those who cause secondary pollution in accordance with relevant regulations. The competent price department should strengthen the supervision and inspection of the charges for the treatment of municipal solid waste, and severely investigate and punish the acts of charging fees for self-supporting projects in violation of the provisions and raising the charging standards without authorization. The act of misappropriating the garbage disposal fee shall be severely punished by the relevant functional departments in accordance with the relevant provisions.
