What reminders can the owner refuse to pay? Say no to developers

When the owner repossesses the building, the developer and the property always charge fees in various names. Some of these fees should be paid, but some are not mandatory for property and developers. Let's look at what owners can refuse to pay and learn to say "no" to developers and properties.

1, hydropower liquidity

Some developers will collect water and electricity liquidity from the owners when handing over the house, but this is actually illegal. If the owner agrees to pay this fee, the property can deduct this fee every month, but the owner does not agree to pay this fee, and neither the property nor the developer has the right to impose it.

2, gas installation fee, pipe network construction fee

At present, different regions have different regulations on the collection of this fee. For example, the Notice of Guangdong Provincial Price Bureau on Regulating the Price Management of Pipeline Gas in our province stipulates that "all localities must stop charging fees in the name of pipeline gas installation fee, capacity increase fee and account opening fee." The gas installation fees in Beijing, Zhengzhou, Henan, Dalian and other places are included in the collection scope of urban infrastructure supporting fees, and developers may not collect them under another name.

3. Video intercom system cost

Normally, property or developers should not charge for this project. If the project is charged separately, it needs to be clearly stated in the house sales contract. This is the rule in most areas, and the price is clearly marked according to the method of "one suite, one price". Since 2007, Guangdong Province has implemented the Code of Conduct for the Transaction Price of Newly-built Commercial Houses of Guangdong Provincial Price Bureau, in which Article 5 stipulates that "all supporting infrastructure for the construction of commercial houses includes water supply, power supply, gas supply, communication, cable TV, security monitoring system, letter box, etc.". , should be included in the development and construction costs, and shall not be charged separately outside the house price. "

4. Sales agency fee and comprehensive fee for warrants.

Formal real estate sales do not need to pay intermediary fees and warrants comprehensive fees. Usually, the generation of this fee means that the property buyer bought the house through an intermediary. The intermediary fee should be paid by the property buyer in advance and voluntarily, and the operator may not force it.

5, deed tax, stamp duty and other accreditation fees

It is a prerequisite for the developer to collect the deed tax, stamp duty and other accreditation fees from the owner, that is, the developer has obtained a large property certificate, indicating that these fees are paid by the developer, and it is reasonable to collect these fees from the property buyers. If the developer has not yet obtained the large production certificate, he will charge the buyer this part of the fee, then the buyer can refuse.

6. Pay the property management fee for three months in advance.

Property fees are generally paid monthly, but when they are delivered for the first time, it is almost a "rule" to collect property fees a few months or even a year in advance. In fact, there is no legal basis for this. Even if the owner refuses to pay the fee, the property has no right to force the owner to pay the fee, let alone give the owner the key on this ground.

7. How to recover the paid fees?

Specific operation method: complain to the district price bureau or the municipal price bureau and ask the bureau for a written reply. The owner of a real estate in Haizhu District, Guangdong Province complained to the District Price Bureau that the fees charged by the bureau were all illegal fees, and eventually the developer stopped collecting or refunding most of the fees.
