Regulations of Nanjing Municipality on the Administration of Domestic Waste

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Law of the People's Republic of China on the Promotion of Circular Economy and the Regulations on the Administration of Urban Appearance and Environmental Sanitation in order to strengthen the management of domestic waste, improve the living environment in urban and rural areas and promote the sustainable development of economy and society. Article 2 These Regulations shall apply to activities such as source reduction, classified delivery, collection, transportation, disposal, resource utilization, supervision and management of domestic garbage within the administrative area of this Municipality.

The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life, and the solid waste regarded as domestic waste according to laws and administrative regulations. Article 3 Domestic garbage in this Municipality shall be classified according to the following standards:

(1) Recyclable refers to domestic garbage suitable for recycling, mainly including waste paper, plastics, glass, metals, fabrics, etc.

(2) Hazardous waste refers to domestic waste that directly or potentially harms human health and natural environment, mainly including rechargeable batteries, button cell, lamps, discarded drugs, pesticides (containers) and mercury products.

(3) Kitchen garbage, also known as wet garbage, refers to perishable domestic garbage, mainly including vegetables, leaves, peels, stones, leftovers, discarded food, etc. Food residue, food processing waste and waste cooking oil produced by catering operators and collective canteens of organs, military units, schools, enterprises and institutions in food processing, food service, unit feeding and other activities; Vegetables, fruits, garbage, carrion, discarded meat bones, aquatic products, internal organs of livestock and poultry, etc. Produced by farmers' markets and agricultural products wholesale markets.

(4) Other garbage, also called dry garbage, refers to other domestic garbage except recyclables, harmful waste and kitchen garbage. Article 4 The management of domestic waste in this Municipality follows the principles of leadership by the Party committee, government-led, participation by the whole people, social coordination, overall planning of urban and rural areas and systematic promotion; Establish and improve the overall classification system of domestic waste classification, collection, transportation and disposal, and improve the level of reduction, resource utilization and harmlessness of domestic waste. Article 5 The Municipal People's Government shall be fully responsible for the management of domestic waste in this Municipality, incorporate it into the national economic and social development plan of this Municipality, determine the management objectives of domestic waste, formulate the total control plan of domestic waste source in this Municipality, districts and Jiangbei New District, coordinate the planning and layout of facilities, ensure capital investment, and promote the implementation of various policies and measures for the reduction, recycling and harmlessness of domestic waste.

The District People's Government and the management organization of Jiangbei New District are responsible for the management of domestic waste in this region, incorporate it into the local national economic and social development plan, ensure capital investment, and organize the implementation of the domestic waste management objectives determined by the Municipal People's Government and the total control plan of domestic waste source in this region.

Town People's Government and sub-district offices are responsible for the daily work of domestic waste management within their respective jurisdictions, and guide residents' committees and villagers' committees to organize and mobilize individuals and units within their respective jurisdictions to participate in the reduction and classification of domestic waste.

The residents' committees and villagers' committees shall assist in the publicity and guidance of the classified management of domestic waste, and cooperate with the town people's government and street offices to organize, mobilize and urge individuals and units within their respective jurisdictions to carry out classified delivery of domestic waste. Article 6 The administrative department in charge of urban management is the competent department in charge of domestic waste management, responsible for the comprehensive coordination, overall planning, guidance, supervision, inspection and assessment of domestic waste management, and supervising and managing the classified delivery, collection, transportation and disposal of domestic waste.

The administrative department of development and reform is responsible for the work related to the reduction of domestic waste at the source, and studies and formulates the charging system for domestic waste treatment.

The education administrative department shall incorporate the knowledge of domestic waste classification into the educational content of kindergartens and primary and secondary schools in this Municipality, and organize activities such as the practice of domestic waste classification education.

The competent department of ecological environment administration is responsible for examining and approving the environmental impact assessment documents of domestic waste transfer and centralized disposal facilities construction projects, guiding and supervising the prevention and control of environmental pollution of domestic waste disposal units, and supervising and managing the storage and disposal of hazardous wastes sorted from domestic waste.

Urban and rural construction administrative departments are responsible for the overall coordination, completion and acceptance, filing and handover of government-invested domestic waste transfer and centralized disposal facilities construction projects.

Housing security and real estate administrative departments are responsible for urging property service enterprises to carry out domestic waste classification.

The administrative department of commerce is responsible for supervising and guiding the recycling management of recyclable materials in domestic garbage.

The administrative departments in charge of finance, planning, natural resources, transportation, cultural tourism, sanitation, market supervision, and agency affairs management shall, in accordance with the division of responsibilities, cooperate in the related work of domestic waste management. Seventh according to the principle of garbage producers pay, the establishment of metering fees, classified pricing of domestic garbage disposal fee system. The specific measures shall be formulated separately by the municipal administrative department of development and reform in conjunction with the municipal administrative department of urban management and the financial department, and shall be promulgated and implemented after being approved by the Municipal People's government.

Individuals and units that produce domestic garbage shall pay the domestic garbage disposal fee in accordance with the regulations.
