It is well documented that the property fee for vacant houses in Hunan should not exceed 90%. The Hunan Provincial Development and Reform Commission, together with the Provincial Department of Housing and Urban-Rural Development and the Provincial Market Supervision Administration, issued the "Measures for the Administration of Property Service Charges in Hunan Province", which pointed out that when paying the property service fee for vacant houses that have gone through the house delivery procedures but have not yet moved in, the property service fee shall not exceed 90%. The document shall take effect from May 15, 2005, with a validity period of 5 years.

Do you have to pay property fees for vacant houses?

Vacant houses have to pay property fees. If the house you bought is really unoccupied and not decorated, you can apply for relief from the property. There are basic rules when applying for relief. The requirement is that you can only apply if you have not lived in the house for more than six months, and you must also produce written proof. In addition, the old house is not within the scope of property fee reduction and exemption, and only the new house is eligible to apply.

According to the relevant regulations, if the owner has stayed in the vacant property for more than six months continuously, and has not stayed or used it for a long time, the owner should file a written record with the property management company and pay the vacant property management fee at 90% of the stipulated or agreed service fee. The so-called vacant house refers to a house where no one lives, and vacant houses also have to pay property fees.

Consequences of not paying property fees for vacant houses

According to the "Regulations on Property Management", the owner shall pay the property service fee according to the agreement in the property service contract. Violation of the property service contract, overdue payment or refusal to pay the property service fee without justifiable reasons, the owners' committee has the right to urge them to pay within a time limit; If it fails to pay within the time limit, the property management enterprise may bring a lawsuit to the people's court.

In this regard, Article 6 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Specific Application of Law in the Trial of Property Service Disputes further stipulates that if the owner refuses to pay the property fee without justifiable reasons or fails to pay the property fee within a reasonable period after being urged in writing, the people's court shall support the property service enterprise to request the owner to pay the property fee. Property service enterprises have provided services in accordance with the contract and relevant regulations, and the people's court will not support the owners' defense on the grounds that they do not enjoy or need to accept relevant property services. Therefore, if the owner refuses to pay the property fee without justifiable reasons, he will bear the liability for breach of contract to the property management enterprise and bear all the adverse consequences caused by losing the case.
