Opinions on the implementation of installing elevators in existing houses in Shantou City

In order to simplify the application procedures for installing elevators in existing houses, further promote the installation of elevators in existing houses in our city, improve the living conditions of citizens and improve the quality of life of residents, according to the spirit of People's Republic of China (PRC) Property Law and other relevant laws, regulations and policies, we now put forward the following implementation opinions on further developing the installation of elevators in existing houses in our city.

I. Scope of application

This opinion is applicable to cities with legal ownership certificates or legal construction application procedures, and residential buildings without elevators have been completed and put into use, and elevators are added within the red line of the original property construction land.

This opinion does not apply to villas (including townhouses), single-staircase houses and houses that have been included in the demolition and reconstruction plan.

Second, the principle of jurisdiction

The existing residential elevator projects shall be managed territorially, and the relevant administrative departments at the county level where the project is located shall be responsible for specific examination and supervision, and the relevant administrative departments at the municipal level shall be responsible for guidance. There is no corresponding institution at the county level, which can be audited by the relevant municipal administrative departments. District and county government service centers should set up centralized service windows to facilitate public consultation and application procedures.

Third, the main body of implementation

The building (ladder) is the basic unit of adding elevators to existing residential buildings. All owners of the building (ladder) who agree to add elevators are the main body of implementation, and are responsible for organizing and coordinating fund raising, commissioned design, soliciting opinions, project application, equipment procurement, project implementation, maintenance management and other related work. The implementer may entrust the owners' committee, the original housing construction unit, the realty service enterprise, the elevator installation enterprise and other units or individuals to undertake the above work, and fulfill the obligations that the construction unit shall undertake according to laws and regulations.

Fourth, the implementation conditions

(a) the existing residential elevator should be based on the principle of practicality, and shall not occupy the existing urban road space, and shall not affect the implementation of urban planning, minimize the size of elevator shafts and protruding external walls, and reduce the adverse impact on adjacent buildings. On the premise of meeting the relevant codes and standards of architectural design, structural safety, fire safety and special equipment, the volume of elevator shaft protruding from the external wall is not included in the calculation of building spacing.

(two) the addition of elevators shall be approved by the owners whose exclusive parts account for more than two-thirds of the total area of buildings (ladders) and more than two-thirds of the total number of people. If an additional elevator intends to occupy the exclusive part of the owner, it shall obtain the consent of the owner of the exclusive part.

The calculation method of the area and the number of owners mentioned in the preceding paragraph shall be implemented in accordance with the relevant judicial interpretations and relevant regulations of the Supreme People's Court.

(3) The implementer shall reach a written agreement on the preliminary design scheme, capital budget and raising scheme, elevator maintenance mode and cost sharing scheme, compensation fund raising scheme for owners with damaged rights and interests, and elevator use manager.

The funds needed for adding elevators to existing houses can be raised in the following ways:

Local streets (towns) and community neighborhood committees should actively assist the executive body to do a good job in objection mediation. After the expiration of publicity 10 days, the community residents' committee will issue written explanation materials to the implementer on matters such as publicity, collecting written objections and organizing mediation.

(3) Construction drawing review

After the design scheme of installing elevators in existing houses is fully negotiated and publicized by the owners, the implementer will entrust a design unit with corresponding qualifications to carry out construction drawing design according to the renovation project. The construction drawing shall be reviewed by a drawing review organization with corresponding qualifications, and the review opinions of technical documents of construction drawing design shall be issued.

(4) Joint review

The implementation of the main body to the county administrative service center window to apply for the installation of elevators in existing houses, and provide the following materials:

1. Joint review opinion form for installing elevators in existing houses (see annex);

Application materials will be distributed to natural resources, housing and urban construction, market supervision and management, urban management and other departments. The window of the county administrative service center and the natural resources department shall convene the above departments for joint review. Meet the technical management requirements, within 5 working days to approve the "existing residential elevator joint review opinion form" (see annex).

(5) Engineering construction

Before installing the elevator, the implementer shall apply to the district and county housing and urban-rural construction departments for simple registration of project quality and safety supervision with the "Joint Review Opinion Form for Installing the Elevator in Existing Houses" (see annex) and the ID card and power of attorney of the manager. The district and county housing and urban-rural construction departments will inform the streets where the elevators are located, and the streets and community neighborhood committees should strengthen inspection and coordination. The construction unit can only start work when the community neighborhood committee confirms that there is no obstruction from interested parties at the elevator installation site. The elevator installation and construction unit shall declare the notice of special equipment construction to the special equipment safety supervision and management department before the elevator installation and construction, declare the elevator supervision and inspection to qualified special equipment inspection and testing institutions, and accept the quality and safety supervision of the special equipment safety supervision and management department and the construction engineering quality and safety supervision department during the construction process.

Elevator installation involves the relocation and transformation of power supply, communication, digital TV, water supply, gas and other pipelines and other supporting facilities. The implementer can apply to the above-mentioned units for relocation and transformation with the "Joint Review Form for Installing Elevators in Existing Houses" (see Annex). Within/0/5 days from the date of application, the pipeline unit must enter the site for construction and relocation, and bear relevant expenses. ?

(six) acceptance and use for the record

1. Project completion acceptance. The implementer of installing elevators in existing houses is fully responsible for the construction safety of installing elevators, and the design, construction and elevator enterprises bear corresponding responsibilities according to regulations. After the completion of the project, the implementer shall organize the design, construction, elevator enterprise and the neighborhood committee of the community where it is located to carry out the completion acceptance of the elevator installation project, and issue the opinions on the completion acceptance of the existing residential elevator installation project.

2. Acceptance and filing. The following materials shall be submitted to the completion acceptance filing unit where the project is located for handling the completion acceptance filing procedures for installing elevators in existing houses:

(1) Record Form for Completion Acceptance of Installation of Elevator in Existing Residential Buildings;

(2) Planning verification procedures;

(3) opinions on the completion and acceptance of adding elevators to existing houses;

(4) ID card and power of attorney of the agent who goes through the formalities.

Supervision report of quality supervision, safety supervision and management departments or institutions (submitted by the above-mentioned units directly to the project completion acceptance filing unit).

3. Filing and handover. After the acceptance of the project is put on record, the implementer shall handle the warehousing book of adding elevator construction files to the existing houses and hand over the completion data of the construction project to the urban construction archives where the project is located. The following materials shall be submitted:

(1) Joint review opinion form for installing elevators in existing houses (see annex);

(2) Add the elevator completion acceptance record in the existing residence;

(3) Review opinions on technical documents of construction drawing design;

(4) as-built drawings.

3. Use archiving. The implementer shall, before the elevator is put into use, go through the registration formalities for new elevators with the safety supervision and management department of special equipment according to law and obtain the registration certificate for the use of special equipment. The following materials shall be submitted when handling:

(1) ID card and power of attorney of the agent who goes through the formalities;

(2) special equipment use registration form;

(3) A certificate containing the unified social credit code of the management unit or a personal identification certificate;

(4) special equipment product certificate;

(5) Special equipment supervision and inspection certificate;

(6) Add elevator construction files to existing houses.

Seven, the new district processing

The construction area increased due to the installation of elevators belongs to all owners of the building (staircase), and the property area of each owner remains unchanged. If it needs to be levied for public interests, the increased construction area shall be compensated at the depreciation price.

Eight, objection handling

If the disputes arising from the installation of elevators are not resolved through consultation or mediation by grass-roots organizations, the parties may bring a lawsuit to the people's court according to law.

IX. Management and Maintenance

The implementer shall entrust the realty service enterprise and other units or individuals as the use managers of elevators, fulfill the legal obligations of users of special equipment, and bear corresponding responsibilities.

The use manager shall entrust an elevator maintenance unit with corresponding qualifications to carry out daily maintenance, and submit a regular inspection application to the special equipment inspection agency one month before the expiration of the elevator safety inspection.

X. Financial subsidies

(A) the scope and standards of subsidies

Starting from 20 19, according to the principle of giving priority to compensation, subsidies will be given to four-storey and four-storey multi-owner existing houses without elevators, and a staircase will be subsidized by the municipal finance for 40,000 yuan. At the same time, according to the standard of a staircase 1 1,000 yuan, the municipal finance will reward the community neighborhood Committee where the elevator is added as its daily work funds. At the same time, the people's governments of all districts and counties shall give the same amount of subsidies and awards in accordance with the municipal subsidy and award standards.

(2) Procedures for applying for subsidies

After the elevator is completed and accepted, the implementer shall apply to the county housing and urban-rural construction department with the "Registration Certificate for the Use of Special Equipment" and the confirmation of the community neighborhood committee where the project is located. Every year 1 month, the housing and urban-rural construction departments of counties summarize the situation of installing elevators in existing houses in the previous year and report them to the office of the leading group for installing elevators in existing houses in the city. After the approval of the leading group for installing elevators in existing houses in the city, it will be allocated by the municipal finance department at two levels according to the procedures.

3. The municipal market supervision and management department is responsible for the supervision and management of the use of elevator additional equipment and the manufacturing, installation, renovation, maintenance, inspection and testing related to the use of safety within its administrative area. The market supervision and management department shall regularly publish the candidate list of elevator equipment enterprises for the reference of the implementation subject.

4. The municipal finance department is responsible for allocating additional financial subsidies and incentive funds for elevators, coordinating annual funds, and subsidizing and rewarding qualified implementers and community neighborhood committees.

6. If the addition of elevator projects involves supporting fees for urban infrastructure and occupation, excavation and moving fees for municipal facilities, the relevant departments shall waive them.

8. The people's governments of all districts and counties should set up corresponding work leading groups, set up special service windows, strengthen organization and implementation, improve publicity, actively mobilize, coordinate and guide qualified existing houses to carry out the work of adding elevators. It is necessary to set up a one-stop center for elevator technical consultation in the existing houses of streets or community neighborhood committees within the jurisdiction to provide consulting services for the public. It is necessary to strengthen the resolution of neighborhood contradictions in the addition of elevators, actively build a communication and coordination platform, handle neighborhood contradictions and disputes in a timely manner, and ensure the orderly development of elevator addition in existing houses.

9. Increase the number of grass-roots units such as streets and neighborhood committees where elevators are located, and take the initiative to coordinate and handle residents' policy propaganda and opinions. Original housing reform unit, owners' committee, elevator production and installation enterprise, etc. Give guidance and assistance to the installation of elevators in existing houses. After reaching the declaration conditions, the residential property service enterprise shall provide services on its own initiative, create convenient conditions for adding elevators, and actively cooperate with the implementation subject to do a good job in matters such as agreement publicity, engineering construction, elevator operation and maintenance, etc.

Twelve. Strengthen performance appraisal.

Adding elevators to existing houses is included in the annual performance appraisal. The people's governments of all districts and counties and relevant departments should strengthen the supervision and inspection of the installation of elevators in existing houses, and the relevant responsible personnel of regions and departments who are not obvious in work performance, perfunctory, dare not act or act indiscriminately will be investigated for corresponding responsibilities according to law.

Thirteen, the people's governments of all districts and counties may, in combination with this opinion, introduce supporting policies to fully promote the installation of elevators in existing houses within their respective jurisdictions.

Fourteen This opinion will be implemented from June 20 19 15 and will be valid until June 4, 2024. After the expiration of the validity period, if it is considered necessary to continue the implementation after assessment, it shall be revised according to the assessment.
