These disputes mainly focus on: the quality of property services provided by the property management company does not match the price, the unauthorized pricing exceeds the government-guided price, the property service charges are not clearly marked according to the regulations, and the property management company's charging behavior to the owners is not standardized.
The property management fee currently implemented in Guangdong Province is the government-guided price of ordinary houses, which can fluctuate up and down within the government-guided price range. Take the elevator building in Guangzhou as an example, the highest charge for a first-class property can reach 1.96 yuan/square meter, and the lowest can reach 1.45 yuan/square meter.
Guangdong Provincial Price Bureau issued the Notice on Strengthening the Management of Property Service Charge, which will be implemented on February 1 2007. First of all, adjust the scope of property service charges that implement government-guided prices. Before the establishment of the owners' committee, the residential (excluding villas) property service charges are subject to government guidance prices, while after the establishment of the owners' committee, the residential and other non-residential property service charges of villas and owners' committees are subject to market adjustment prices. The Guangdong Provincial Price Bureau said that this provision is conducive to promoting the marketization of property services.
The new regulations stipulate that property management companies are not allowed to set prices beyond the government-guided prices without authorization. At the same time, the conditions and procedures for setting the standards for property service charges higher than the government-guided prices are clarified: for properties with government-guided prices, property management companies provide owners with property services that are not covered by the highest service level, and the property service charges need to exceed the local government-guided prices, local price authorities can verify the government-guided prices in property management areas according to the principle of high quality and good price after cost supervision and examination. This means that high-quality real estate can exceed the guide price.
The Guangdong Provincial Price Bureau also specifically regulated the related charging behaviors of property management enterprises. If it is stipulated that the property management enterprise accepts the entrustment to collect the water and electricity charges, the property management enterprise may collect the water and electricity charges in advance and deduct them on a monthly basis, and shall not collect the working capital of water and electricity and other fees related to the payment of water and electricity charges, except for those voluntarily paid by the owners; It is stipulated that the property management enterprise can agree with the owner (or decoration enterprise) on the specific standards of expenses such as decoration deposit (deposit), garbage and mud removal, decoration worker pass deposit (or fee) during the owner's decoration period in accordance with the provisions of the local price department. In addition to the above fees, property management companies shall not charge any other fees related to decoration.
At the same time, the new regulations emphasize that property service charges must be clearly marked, and put forward the new requirement that the contents, service standards and charging standards of property services must be clearly marked in the sales place in the past to protect the owners' right to know.
