Measures of Urumqi Municipality on the Administration of Fire Safety

Article 1 In order to strengthen fire safety management, prevent and reduce fires, and ensure the safety of public property and citizens' personal and property, these Measures are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC), the Fire Protection Regulations of Xinjiang Uygur Autonomous Region and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the management of fire safety within the administrative area of this Municipality. Article 3 The fire safety work in this Municipality shall be supervised and managed by the public security organs, and the public security fire control institutions shall be specifically responsible for the implementation.

Development and reform, construction, education, planning, water affairs, municipal appearance, comprehensive administrative law enforcement and other departments shall, in accordance with their respective responsibilities, do a good job in fire safety. Article 4 This Municipality actively promotes the development of fire public liability insurance, popularizes the application of advanced fire-fighting technology, advocates the establishment of remote monitoring system for building fire-fighting facilities and fire safety management, and improves the fire-fighting ability of the whole society. The Municipal People's Government shall sign an annual fire safety responsibility letter with the district (county) people's government and relevant departments and units.

District (county) people's government, relevant departments and units shall sign the annual fire safety responsibility letter step by step.

The fire safety responsibility book shall specify the responsible person, objectives and tasks, work measures, assessment methods, reward and punishment contents and standards. Article 6 The municipal and district (county) people's governments shall organize and coordinate relevant departments to solve major problems existing in fire control work within their respective administrative areas, and urge relevant units to implement rectification of major fire hazards.

Public security organs at all levels shall regularly study and deploy fire control work, coordinate and solve important problems existing in fire control work, and urge public security fire control institutions at the same level to implement fire control laws and regulations. Article 7 The municipal, district (county) people's governments shall incorporate the construction of public fire-fighting facilities and fire-fighting equipment into the national economic and social development plan, include the required funds in the fiscal budget, and increase the financial input of fire-fighting funds year by year according to the growth of fiscal revenue. Eighth public security fire control institutions shall, in accordance with the relevant provisions of the state, prepare special fire control plans. Special fire protection planning should be incorporated into the overall urban planning. Article 9 The location and land of the identified fire station shall be controlled by the planning department, and no unit or individual may occupy it. Tenth fire communication, fire water supply, fire exits, fire stations and other public fire safety facilities should be designed, constructed and put into use at the same time with other municipal infrastructure according to the requirements of special urban fire planning. Eleventh production, use, storage, transportation and loading and unloading of inflammable and explosive dangerous goods factories, warehouses and special stations, should be in line with the city fire safety layout. Twelfth outdoor advertising facilities shall comply with fire safety regulations, and shall not affect personnel evacuation and fire fighting and rescue. Thirteenth fire water supply pipeline is old or the water quantity and water pressure are insufficient. City water supply enterprises should carry out technical transformation in combination with pipeline expansion and reconstruction to meet the needs of fire water supply. Fourteenth of the examination and approval projects involving fire safety, the relevant departments shall strictly examine and approve according to law, and abide by the following provisions:

(a) for construction projects that do not meet the requirements of fire safety layout, the urban planning department shall not issue construction land planning permits and construction project planning permits;

(two) the fire protection design of a building project has not passed the examination by the public security fire control institution, and the construction department shall not issue a construction permit;

(three) in accordance with the national standards, the construction project needs to be designed for fire protection. If there is no fire acceptance document in the completion acceptance data, the real estate department will not issue the house ownership certificate;

(four) without the approval of the public security fire control institutions, education, civil affairs, health, culture, sports and other departments shall not approve the establishment of schools, kindergartens, nurseries, nursing homes, welfare homes, medical institutions and cultural, sports and other public places. Fifteenth of the units that have major fire hazards or refuse to rectify the fire hazards, public security fire control institutions may request the local people's government to supervise the rectification. Sixteenth any unit or individual has the right to report fire hazards; If the fire hazard report is true, it shall be rewarded by the public security fire control institution. Seventeenth multi-property buildings, which have been delivered for use, the owners or users are responsible for the fire safety of exclusive parts and special parts; * * * Fire safety management in some property management shall be performed by the owners, users and property service enterprises in accordance with laws, regulations and these Measures; If property management is not implemented, the owner or user shall negotiate with some fire safety responsible persons of the building, establish a fire safety coordination organization, and perform fire safety responsibilities. Eighteenth building owners or users shall perform the following duties of fire safety:

(a) comply with the provisions of the relevant fire laws, regulations and rules;

(2) Maintaining proprietary and special fire-fighting facilities and equipment, and ensuring that the fire-fighting facilities and equipment are in good condition and effective;

(three) entrusted by the property management, cooperate with the property service enterprises to do a good job in fire safety management and eliminate fire hazards;

(four) the building that does not meet the fire safety conditions shall not be leased to others for business use. Nineteenth property services companies in the property services, shall perform the following duties of fire safety:

(1) Designate a special person or set up a specialized agency to be responsible for fire safety management;

(two) under the guidance of public security fire control institutions, establish and improve the fire safety system, formulate fire fighting and emergency evacuation plans, carry out fire propaganda and organize fire drills;

(3) Organizing fire prevention inspection, eliminating fire hazards in time, stopping illegal acts such as occupying and blocking safe evacuation routes, fire exits and fire exits, and reporting to public security fire control institutions in time;

(four) regular inspection and maintenance of public fire control facilities, equipment, to ensure that fire control facilities, equipment and fire safety signs in good condition and effective.

The owners' committee shall assist the realty service enterprise to do a good job in fire safety management, and timely configure and update fire control facilities and equipment.
