Right to use the roof

The right to use the roof belongs to all the owners, not the top-level residents.

According to the relevant provisions of the Property Law, if the property right of the roof owner's house purchase contract does not include the roof, the roof belongs to the owner. Since it belongs to the public space of the community, the right to use the public space belongs to all owners, and the supervision right belongs to the community owners' Committee. In the case that individual owners use the roof privately but there is no illegal construction, the owners' committee can complain to the property management company, which will urge the owners to stop occupying public space. Therefore, the right to use the top floor does not only belong to the top floor users.
