Measures of Shanxi Province for Quality Appraisal and Daily Supervision and Management of Agricultural Machinery Products

Article 1 In order to strengthen the quality appraisal and daily supervision and management of agricultural machinery products, and protect the legitimate rights and interests of users, producers and operators of agricultural machinery, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this province. Article 2 The term "agricultural machinery products" as mentioned in these Measures refers to power machinery, working machinery and parts thereof used in planting, forestry, animal husbandry, fishery, processing of agricultural and sideline products, irrigation and drainage of farmland and rural transportation. Article 3 All units and individuals engaged in the production, sale, use, quality appraisal and daily supervision and management activities of agricultural machinery products within the administrative region of this province shall abide by these measures. Fourth administrative departments of quality and technical supervision at all levels shall be responsible for the supervision and management of the quality of agricultural machinery products.

The competent department of agricultural machinery of the people's governments at or above the county level shall be responsible for the quality appraisal of agricultural machinery products within their respective administrative areas, and may conduct daily supervision and management on the quality of agricultural machinery products. Its specific responsibilities are:

(a) the test, evaluation and appraisal of the advanced nature and adaptability of new agricultural machinery products;

(2) Organizing and popularizing advanced and high-quality agricultural machinery products;

(three) according to the relevant laws and regulations, daily supervision and inspection of the quality of agricultural machinery products;

(four) to accept complaints about the quality of agricultural machinery products and deal with them according to law.

The competent department of agricultural machinery of the people's government at the county level shall perform the duties specified in the preceding paragraph except item (1). Fifth provincial and municipal (prefectural) people's government departments in charge of agricultural machinery may entrust their subordinate agricultural machinery appraisal institutions to be specifically responsible for the implementation of the duties stipulated in Article 4 of these Measures. Sixth agricultural machinery appraisal institutions must have the corresponding testing conditions and capabilities, and can carry out the quality inspection of agricultural machinery products only after passing the examination and authorization according to law. Article 7 The staff of the competent agricultural machinery department and its subordinate agricultural machinery appraisal institution shall accept the quality appraisal of agricultural machinery products and the daily supervision and management training, and shall perform the duties of supervision and inspection only after passing the examination of the competent agricultural machinery department of the provincial people's government. Article 8 Before the new agricultural machinery products are put into production, the provincial and municipal agricultural machinery appraisal institutions shall conduct product quality appraisal and testing respectively according to the declared product grades, and after the appraisal report is put forward, they shall conduct acceptance in accordance with the relevant provisions of the national and provincial new product appraisal and acceptance. Article 9 According to the relevant provisions of the state, agricultural machinery products mass-produced and sold in this province must be popularized and appraised by the provincial agricultural machinery appraisal institutions, and the reliability, safety, adaptability and "three guarantees" commitment of the products are comprehensively evaluated. Those who pass the examination shall be issued with the license certificate and badge of agricultural machinery promotion by the competent department of agricultural machinery at the provincial level, giving priority to promotion.

Agricultural machinery products sold in this province from outside the province must hold the certificate of agricultural machinery promotion at or above the provincial level, go through the appraisal procedures in the provincial agricultural machinery appraisal institution, and enjoy priority promotion treatment in our province.

In the period of validity of the agricultural machinery promotion license or approval procedures, the competent department of agricultural machinery of the provincial people's government shall promptly organize agricultural machinery appraisal institutions to conduct spot checks and appraisals on agricultural machinery products with declining quality and great user opinions.

Where agricultural machinery promotion products fail to pass the appraisal, the distribution department shall not distribute them. Tenth people's governments at or above the county level shall strengthen the daily supervision and inspection of the quality of agricultural machinery products sold and used. Important agricultural machinery products with large user opinions and many quality problems can be organized for key inspection. Article 11 The inspected shall provide convenience for the inspection work. If agricultural machinery products need to be inspected, the inspected shall provide samples free of charge and return them to the inspected after the inspection expires. For agricultural machinery products with unqualified inspection results, the inspection expenses shall be borne by the inspected, and the inspected shall have the right to claim compensation from the responsible party according to law. Twelfth inspection of agricultural machinery shall be completed within two months, and the results shall be notified to the inspected in writing in a timely manner, and submitted to the relevant administrative departments, and published in an appropriate manner. Thirteenth inspectors have objections to the inspection results, can apply for re-inspection according to the relevant provisions of the state and province. Fourteenth in violation of the provisions of article eighth of these measures, the product quality has not been put into production by the provincial agricultural machinery appraisal institution, and the competent agricultural machinery department of the people's government at or above the county level shall order it to apply for appraisal within a time limit. Article 15 Whoever, in violation of the provisions of Article 9 of these Measures, sells agricultural machinery products in batches without going through the formalities of agricultural machinery promotion license, badge or approval, shall be fined by the competent agricultural machinery department of the people's government at or above the county level according to the circumstances, with a maximum of 30,000 yuan. Article 16 Whoever forges or fraudulently uses the promotion license certificate, badge and approval procedures for sales shall be ordered by the competent agricultural machinery department of the people's government at or above the county level to make public corrections, and shall be fined between one and five times the illegal income, with a maximum of 30,000 yuan. Seventeenth of the agricultural machinery products that have obtained the promotion license or gone through the examination and approval procedures, after testing, the product quality is declining and can not maintain the qualified level, the issuing department can withdraw and cancel the promotion license or approval procedures. Eighteenth daily supervision and inspection found that the sale and use of agricultural machinery products are unqualified, by the competent department of agricultural machinery of the people's government at or above the county level to assist the administrative department of technical supervision shall be punished in accordance with relevant laws and regulations.
