Regulations of Guangxi Zhuang Autonomous Region on Property Management (revised in 2020)

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners, property service providers and property management parties, ensure the lawful, safe and rational use of property, and promote social harmony, these Regulations are formulated in accordance with the provisions of the Civil Code of People's Republic of China (PRC) and the Regulations on Property Management of the State Council, combined with the actual situation of this autonomous region. Article 2 These Regulations shall apply to property management activities and their supervision and management within the administrative area of this Autonomous Region.

The term "property management" as mentioned in these Regulations refers to the maintenance, conservation, cleaning, greening and inspection of houses, supporting facilities, equipment and related sites within the property management area. Some owners manage and take reasonable measures to protect their personal and property safety and maintain the relevant order in the property management area.

With the consent of the owner, it can be entrusted to a property service enterprise or other property managers for management, or it can be managed by the owner himself. Article 3 Property management shall follow the principles of openness, fairness, justice, honesty, market competition and management according to law, and promote the development of property management to specialization, intelligence, legalization and greening. Article 4 The property management shall be governed by the street and township party organizations as the leading factor, and the owners' autonomy, professional services and supervision and guidance of relevant government departments shall be combined. We should give full play to the guidance and supervision of sub-district offices, township people's governments and neighborhood committees to promote the innovation of property management. Article 5 The people's governments at or above the county level shall incorporate property management into the development planning of modern service industry, urban and rural construction and community governance system at the corresponding level, establish a mechanism for capital investment, assessment, incentive and comprehensive coordination of property management, and deploy, promote and coordinate all the work of property management within their respective jurisdictions. Article 6 The competent departments of housing and urban and rural construction of the people's governments at or above the county level shall be responsible for the supervision and management of property management activities within their respective administrative areas, and guide and supervise the subdistrict offices and township people's governments to implement administrative management related to property management.

The relevant competent departments of the people's governments at or above the county level, such as development and reform, finance, civil affairs, public security, natural resources (urban and rural planning), market supervision and management, emergency management and fire rescue, judicial administration, ecological environment, sanitation and health, civil air defense, and comprehensive administrative law enforcement of urban management, shall do a good job in the supervision and management of property management activities in accordance with their respective functions and duties and the provisions of these regulations.

Street offices and Township People's governments shall, in accordance with the prescribed duties, guide and supervise the property management activities within their respective jurisdictions.

Neighborhood (village) committees shall assist neighborhood offices and township people's governments in carrying out property management related work according to law. Article 7 Property service providers are encouraged to join property service industry organizations. Property service industry organizations should strengthen industry self-discipline management, organize business training, standardize industry behavior, improve industry service level, maintain market order and fair competition, promote property service providers and employees to operate according to law and provide honest services, and promote the healthy development of the property service industry.

Property service industry organizations shall accept the guidance and supervision of the competent department of housing and urban construction of the people's government and assist the competent department of housing and urban construction of the people's government to carry out the supervision and management of property services. Chapter II Owners, Owners' Congress and Owners' Committee Section 1 Owners Article 8 The term "owners" as mentioned in these Regulations refers to the owners of houses recorded in the real estate register within the property management area.

If the house ownership registration is not handled according to law, but one of the following conditions is met, it shall be deemed as the owner:

(a) units or individuals that have obtained the ownership of the exclusive part of the building due to the effective legal documents of the people's court or arbitration institution or the expropriation decision of the people's government;

(two) units or individuals that have obtained the ownership of the exclusive part of the building through inheritance;

(three) units or individuals that have obtained the ownership of the exclusive part of the building due to legal construction;

(four) based on the civil legal acts of buying and selling houses with the construction unit, units or individuals that have legally occupied the exclusive part of the building;

(five) other units or individuals as prescribed by laws and regulations. Ninth owners in property management activities, enjoy the following rights:

(1) Accepting the services provided by the realty service provider according to the stipulations of the realty service contract;

(two) to propose the convening of the owners' meeting and the owners' group meeting, and put forward suggestions on the relevant matters of property management;

(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;

(four) to participate in the owners' meeting and the owners' group meeting and exercise the right to vote;

(five) to elect the representatives of the owners, members of the owners' committee and the owners' supervision committee, and enjoy the right to be elected;

(six) to supervise the work of the preparatory group of the owners' congress and the owners' committee;

(seven) to supervise the performance of the realty service contract by the realty service provider;

(eight) the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and related sites;

(nine) to supervise the management and use of property special maintenance funds and public benefits;

(ten) other rights stipulated by laws and regulations.

The owner's exercise of rights shall not endanger the safety of the building or damage the legitimate rights and interests of other owners.
