Which department is in charge of site noise disturbing people?

The competent administrative department of environmental protection of the local people's government at or above the county level where the project is located is responsible for the noise disturbing the people on the construction site.

Construction noise refers to the noise that interferes with the surrounding living environment during construction. Those who discharge construction noise into the surrounding living environment within the urban area shall comply with the environmental noise emission standards of construction sites stipulated by the state.

In urban areas, if the use of machinery and equipment in the construction process may cause environmental noise pollution, the construction unit must declare the project name, construction site and construction period, possible environmental noise value and environmental noise pollution prevention measures to the competent administrative department of environmental protection of the local people's government at or above the county level fifteen days before the project starts.

Noise is basically divided into the following four categories:

1, industrial noise, refers to the noise that interferes with the surrounding living environment when using fixed equipment in industrial production activities, and belongs to the jurisdiction of the Environmental Protection Bureau;

2, construction noise, under the jurisdiction of the environmental protection bureau;

3. Traffic noise refers to the noise generated in the operation of motor vehicles, railway locomotives, motor vehicles, airplanes and other means of transportation that interferes with the surrounding living environment, and is under the jurisdiction of road vehicles, public security and other industries;

4. Social noise refers to the noise generated by human activities that interferes with the surrounding living environment except industrial noise, construction noise and traffic noise. In principle, it belongs to the public security organs, but there are two exceptions: If residents feel that noise pollution in the community is disturbing the people, they can first report it to the property management company and let the property management company come forward to coordinate and solve it. If the communication and coordination of the property management company fails, the owner can find environmental protection by himself.

People's Republic of China (PRC) Law on the Prevention and Control of Environmental Noise Pollution Article 26 The relevant competent department of the State Council shall, according to the requirements of acoustic environmental protection and the national economic and technical conditions, gradually stipulate noise limits in the national standards and industrial standards for products formulated according to law.

The noise value emitted by the industrial equipment specified in the preceding paragraph during operation shall be indicated in the relevant technical documents.

Thirtieth in the urban noise sensitive buildings concentrated area, it is forbidden to carry out construction operations that produce environmental noise pollution at night, except for emergency repair, emergency rescue operations and continuous operations due to production process requirements or special needs.

If continuous operation is necessary due to special needs, there must be a certificate from the people's government at or above the county level or its relevant competent department.

Night operations as mentioned in the preceding paragraph must be announced to nearby residents.
