Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, improve the living environment and promote social harmony, these Regulations are formulated in accordance with the State Council's "Regulations on Property Management" and other laws and regulations, combined with the actual situation of the Autonomous Prefecture. Article 2 These Regulations shall apply to the use, maintenance, service, supervision and management activities of the property within the administrative area of this Autonomous Prefecture. Article 3 The term "property management" as mentioned in these Regulations refers to the activities that the owners employ property service enterprises, and the owners and the property service enterprises carry out maintenance, conservation and management of the houses, supporting facilities, equipment and related sites in accordance with the provisions of the property service contract, so as to maintain the environmental sanitation and order in the relevant areas. County (city) people's government is responsible for leading and organizing the property management within their respective administrative areas, and determining the property management institutions of county (city) property departments, neighborhood offices and township (town) people's governments; Encourage the adoption of new technologies and methods to improve the level of property management and promote the healthy development of the property management industry.

County (city) property department is responsible for the supervision and management of property management activities within their respective administrative areas.

Street offices and township (town) people's governments are responsible for the daily supervision and management of property management divisions and property inspection within their respective administrative areas.

Community, neighborhood (village) committees assist and cooperate with neighborhood offices and township (town) people's governments to carry out property management related work.

Other relevant administrative departments shall, in accordance with their respective responsibilities, be responsible for the supervision, management and service related to the property field. Fifth autonomous prefecture real estate departments, county (city) real estate departments should carry out publicity and training of property management laws, regulations, rules and related policies, and guide owners and property service enterprises to exercise their rights and fulfill their obligations according to law; We should establish a joint incentive mechanism for trustworthiness and a joint punishment mechanism for dishonesty with relevant departments, strengthen the education and management of industry integrity, promote the legal operation and honest service of property service enterprises, maintain market order and fair competition, and promote the healthy development of the property management industry. Chapter II Owners, Owners' Congress and Owners' Committee Article 6 The owner of a house is the owner. According to laws, regulations, management regulations and their agreements with the owners, the users of the property shall enjoy the rights and undertake the obligations of the owners.

Owners enjoy the following rights in property management activities:

(a) in accordance with the provisions of the realty service contract, accept the services provided by the realty service enterprise;

(two) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property management;

(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;

(four) to participate in the owners' meeting and exercise the right to vote;

(five) to elect members of the owners' committee and enjoy the right to be elected;

(six) to supervise the work of the owners' committee;

(seven) to supervise the realty service enterprise to perform the realty service contract;

(eight) the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and related sites;

(nine) to supervise the management and use of special maintenance funds for property;

(ten) other rights stipulated by laws and regulations.

Owners shall perform the following obligations in property management activities:

(a) abide by the management regulations and the rules of procedure of the owners' congress;

(two) abide by the rules and regulations of the use of * * * parts and facilities, the maintenance of public order and environmental sanitation in the property management area;

(three) to implement the decisions of the owners' congress and the decisions of the owners' committee authorized by the owners' congress;

(four) in accordance with the relevant provisions of the state to pay special maintenance funds;

(five) to pay the property service fee on time;

(six) other obligations stipulated by laws and regulations. Seventh a property management area to set up an owners' meeting. The owners' meeting is composed of all owners. If the owner is unable to attend the meeting of the owners' congress, he may entrust an agent to attend. The agent can't be a staff member of the property service enterprise in this residential area, and can't be entrusted for more than three times.

If the number of owners is small and the owners agree not to set up the owners' meeting, the owners shall perform the duties of the owners' meeting and the owners' committee. Article 8 In a property management area, if the construction area that has been delivered to the owner for use reaches more than 50%, or more than 30% but less than 50%, but the first house has been sold and actually delivered for use for two years, the construction unit shall submit the following documents and materials to the property administrative department of the county (city) where the property is located, or the subdistrict office and township (town) people's government:

(a) the property management area certificate;

(2) A list of the area of houses and buildings;

(3) List of owners;

(four) the general plan of building planning;

(five) the delivery certificate of the facilities and equipment used in * * * *;

(six) the property service room configuration certificate;

(7) Other relevant documents.

In line with the conditions for the establishment of the owners' meeting, the county (city) property department and the subdistrict office and the township (town) people's government shall be responsible for organizing and guiding the establishment of the preparatory group for the first owners' meeting within 60 days after receiving the written application for the preparation of the owners' meeting.
