However, the nature is different. The seal of administrative organs is mainly the condition of fixing property or place (equivalent to fixed evidence), while the seal of judicial organs is a kind of power restriction. In any case, no one is allowed to tear up the seal.

The function of the administrative organ's seal is to fix the evidence for investigation and evidence collection. There is a time limit for investigation and evidence collection. When the evidence collection is completed or the time limit is up, it should be unsealed. The seal of the judiciary is a power constraint, and there is also a time limit, but the time can be very long. If the property sticks a seal on its own door, the owner must ask the reason why the property company sticks a seal and safeguard his rights and interests.

Legal basis: Article 50 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment shall be given a warning or a fine of less than 200 yuan if it commits one of the following acts; If the circumstances are serious, they shall be detained for more than five days and less than ten days, and may be fined up to five hundred yuan:

(a) refusing to implement the decisions and orders issued by the people's government in an emergency;
