Provisions of Shenzhen Special Economic Zone on the Implementation of Property Management Regulations
(a) to organize the implementation of the "Regulations" and other laws, regulations and rules related to property management, and to implement the relevant provisions of property management;
(two) to study and formulate policies and measures related to property management;
(three) to guide and coordinate the district government property management administrative department (hereinafter referred to as the district competent department) and other relevant administrative departments, street offices, industry associations, etc. Carry out property management related work according to law;
(four) in accordance with the "Regulations" and other laws, regulations and rules related to property management to make specific administrative acts such as administrative punishment;
(five) unified supervision and management of the city's property special maintenance funds;
(six) guidance, supervision and management of the city's property management bidding activities;
(seven) the establishment of property management electronic voting information system, network credit platform and integrity file system;
(eight) handling major petitions of property management according to law;
(nine) other property management and supervision duties stipulated by laws, regulations and rules and the municipal government. Article 3 The district competent department shall accept the business guidance of the municipal competent department and perform the following duties of property management supervision and management within its jurisdiction:
(a) to guide the street offices to perform their duties of property management supervision;
(2) If it is confirmed that the owners' committee has not been elected according to law or that the owners' committee has resigned collectively, it shall be ordered to rectify and dissolve the serious illegal owners' committee within a time limit;
(3) Revoking the decisions of the owners' congress and the owners' committee that violate laws and regulations, revoking the contents of the management statute that violate laws, regulations and obviously unfair, and deciding the contents of the management statute aimed at a specific owner, which is invalid for that specific owner;
(four) in conjunction with the street office to deal with disputes over the division of property management areas;
(five) guidance, supervision and management of property management bidding activities;
(six) for the property management area, the owners' committee and its members, the property service contract, the property management bidding, management regulations, the rules of procedure of the owners' congress, the seals of the owners' congress and the owners' committee, the disciplinary action of the trade association, the safety emergency plan and other filing matters;
(seven) to approve the application for the appointment of the realty service enterprise in the early stage;
(eight) in accordance with the "Regulations" and other relevant laws, regulations and rules of property management to make specific administrative acts such as administrative punishment;
(nine) handling property management petitions according to law;
(ten) laws, regulations, rules and other property management and supervision duties stipulated by the municipal and district governments.
The district competent department may, according to the actual management, entrust the subdistrict office to handle the filing matters specified in Item (6) of the preceding paragraph and the administrative punishment specified in Item (8) in the name of the district competent department, except for the punishment imposed by the establishment of the owners' committee and the implementation of the industry association. Article 4 Sub-district offices, under the guidance of the district competent department, are responsible for organizing and coordinating the establishment of the owners' congress and the election of the owners' committee, guiding and supervising the daily activities of the owners' congress and the owners' committee, and are specifically responsible for the following duties of property management supervision and management:
(a) responsible for verifying the conditions for the establishment of the owners' meeting, organizing and coordinating the establishment of the preparatory group for the first owners' meeting, guiding the preparatory group to carry out the preparatory work, and paying the preparatory expenses in accordance with these provisions;
(two) the owners' committee was not elected according to law, the owners' committee resigned collectively, the district competent department dissolved the owners' committee, the owners' committee failed to convene a meeting of the owners' general assembly as required, and refused to implement the decision to convene a meeting of the owners' general assembly within the time limit, and organized a meeting of the owners' general assembly;
(3) If the director or deputy director of the owners' committee fails to convene the meeting of the owners' committee without justifiable reasons, he shall be responsible for appointing/kloc-0 members to convene and preside over the meeting of the owners' committee;
(four) to investigate the decisions of the owners' congress and the owners' committee in violation of laws and regulations, and order them to make corrections within a time limit or report to the district competent department for cancellation;
(five) if the owners' committee fails to complete the general election according to law, supervise the owners' committee to organize the general election or organize the general election;
(six) to manage the property and materials of the owners' committee that has been dissolved or whose term of office has expired but has not yet completed the general election;
(seven) to organize a joint meeting of street property management;
(eight) handling property management petitions according to law;
(nine) laws, regulations, rules and other property management and supervision duties stipulated by the municipal and district governments.
Sub-district offices shall clarify the institutions, personnel and working funds, and implement the duties of property management and supervision according to law.
Community workstations assist street offices to carry out property management-related work. Sub-district offices may entrust community workstations to handle property management-related affairs according to law, but matters entrusted by district competent departments may not be delegated. Fifth land planning, urban management, public security, environmental protection, market supervision, civil affairs and other departments. According to their respective responsibilities, supervise and manage the property management activities within their respective jurisdictions according to law.
The municipal real estate registration agency shall provide necessary assistance for the competent department and the subdistrict office to verify the owner's identity information.
