Should Article 42 of the Property Management Regulations be mandatory?
Article 42 of the Property Management Regulations stipulates that it is to adjust the obligation relationship between owners and users, and between owners and developers, so as to avoid disputes over the payment of property fees arising from mutual wrangling among the three parties. According to this regulation, property companies have the direction to trace property fees.
Article 42 stipulates that the owner shall pay the property service fee in accordance with the provisions of the property service contract. If the owner and the property user agree that the property user shall pay the property service fee, the owner shall bear joint and several liability. Property that has been completed but has not been handed over to the property buyer shall be paid by the construction unit.
If the property company fails to collect the property fee from the owner or the user of the property, it may sue the owner, and the owner must bear joint and several liability, and the owner shall recover from the user (lessee).
