Regulations of Suzhou Municipality on the Administration of Yangtze River Flood Control Project
Units and individuals that have made remarkable achievements in the management and protection of flood control projects shall be commended and rewarded by people's governments at all levels or water administrative departments. Article 6 The water administrative department of the Municipal People's Government is the competent authority in charge of flood control projects within the administrative area of this Municipality, and implements unified management of flood control projects.
The water administrative department of the people's governments at the county level along the Yangtze River is the competent authority of flood control projects within their respective administrative areas, and is responsible for the management and supervision of flood control projects in accordance with the authority of hierarchical management and the unified planning and technical requirements of superiors.
During the flood season, the operation and management of flood control projects must obey the dispatch, command and supervision of the relevant flood control headquarters. Seventh people's governments at the county level along the Yangtze River shall, in accordance with the principles of simplification, efficiency, standardization and unification, establish and improve the management institutions of flood control projects and ensure the daily management funds of the management institutions. Eighth flood control project management agencies entrusted by the water administrative department at the same level, exercise the following duties:
(a) responsible for the daily management of flood control project operation, maintenance and conservation;
(two) in accordance with the requirements of flood control engineering management norms, responsible for the inspection and observation of flood control projects, establish and improve the technical archives of flood control projects;
(three) to stop the occupation, destruction, damage and other illegal acts of flood control projects;
(four) to supervise and inspect activities related to the safety of flood control projects;
(five) to provide technical guidance and supervision to the units or individuals involved in the construction of flood control projects within the management scope of flood control projects;
(six) other matters assigned by the water administrative department at the same level. Article 9 The management scope of flood control projects is stipulated as follows:
(1) River banks: waters, sandbars and beaches (including cultivated land) outside the waterfront bank slopes. If there is a river bank on the back water slope, it is bounded by the river bank (including the water surface); There is no embankment along the river, ten to fifteen meters outside the embankment foot.
(2) Embankments outside the sluice: waters and beaches outside the water slope. If there is a river bank on the back water slope, it is bounded by the river bank (including the water surface); If there is no river along the dike, it is eight to ten meters outside the dike foot.
(3) Laojiangdi: the berm outside the inner and outer embankment feet.
(4) Tongjiang Culvert:
1. Medium-sized culvert: 200m to 500m for upstream channel and dike respectively; 50 meters to 200 meters left and right.
2. Small culverts: the upstream river course and dike are150m to 300m respectively; The left and right sides are 50m to150m respectively.
3. The waters within 50m to100m upstream and downstream of the sluice are designated as warning zones, and signs are set up. Tenth state-owned land within the scope of flood control project management shall be registered by the land administrative department of the county-level city, and the people's government at the same level shall issue the certificate of state-owned land use right, which shall be managed and used by the flood control project management institution; If it is occupied by other units or individuals with the approval of the provincial water administrative department or the river basin management institution, it can be occupied by the original unit or individual after being registered by the water administrative department of the county-level city and obtaining the occupation certificate of the river project.
The ownership and use right of collectively owned land within the scope of flood control project management shall remain unchanged, but all activities must comply with the provisions of relevant laws, regulations and these regulations. Eleventh flood control projects within the scope of management to prohibit the following acts:
(a) damage, damage all kinds of flood control projects and mechanical and electrical equipment, hydrology, communications, power supply, observation, measurement, signs and other facilities;
(two) unauthorized digging, earth, drilling, digging, burying, cultivating seeds, grazing, mining sand and gravel, blasting, destroying slope protection, retaining ridges, forest vegetation, handling, turning flood control stones and other acts that endanger the safety of flood control projects;
(3) building houses, fences, canals, storing inflammable and explosive materials, stacking materials, setting up bazaars, laying pipelines and cables, or building various buildings and structures unrelated to flood control projects without authorization;
(4) setting up buildings, obstacles, fishing nets, fishing pins or abandoning sunken ships that affect navigation on water within the scope of management of port dikes outside sluices and Tongjiang culverts;
(five) swimming, fishing and unauthorized berthing of ships in the river channel of the sluice warning zone;
(six) in the Yangtze River, Tongjiang waters, beaches, dumping garbage, waste residue, pesticides, discharge other toxic and harmful sewage and waste;
(seven) in the Yangtze River mining area, during the mining period;
(eight) unauthorized reclamation of the Yangtze River beach;
(nine) arbitrary demolition and unauthorized removal, sale, transfer and lease of flood control facilities and land;
(ten) engaged in aquaculture activities along the embankment in Hanoi.
