Chapter I General Provisions Article 1 In order to strengthen the management of urban construction, promote the development of urban economic construction and social undertakings, and improve the working environment and living conditions of urban residents, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to urban construction in the urban planning area where the people's governments of provinces, cities and counties are located. Article 3 The term "urban construction management" as mentioned in these Regulations includes urban construction planning and survey, construction land and buildings, real estate, municipal public facilities, landscaping, city appearance and environmental sanitation, urban construction supervision and management of special funds for urban construction. Article 4 Urban construction should strictly control the scale of big cities, actively and rationally develop medium-sized cities and small cities, and coordinate with national economic and social development.

Urban construction follows the principles of unified planning, rational layout, adjusting measures to local conditions, comprehensive development and supporting construction, and realizes simultaneous improvement of economic, social and environmental benefits. Article 5 People's governments at all levels shall incorporate urban construction planning into national economic and social development plans. Urban construction investment should occupy a certain proportion in the fixed assets investment plan. Sixth provincial people's government construction administrative departments in charge of the province's urban construction management; The construction administrative departments of state, city and county people's governments and regional administrative offices are in charge of urban construction management within their respective administrative areas.

Land, industry and commerce, public security, transportation, health and other relevant departments, in accordance with their respective responsibilities, coordinate the management of urban construction. Article 7 The construction administrative departments of the people's governments at or above the county level shall supervise the construction and management of urban planning, municipal engineering, public utilities, scenic spots, city appearance and environmental sanitation and landscaping.

Urban construction supervision institutions established in cities shall exercise administrative law enforcement power in accordance with relevant laws and regulations. Article 8 All units and individuals have the obligation to protect urban construction and its facilities, and have the right to stop and report acts that damage urban construction and its facilities. Ninth units and individuals that have made remarkable achievements in urban construction and urban construction management shall be commended and rewarded by the people's governments at or above the county level or the competent departments. Chapter II Planning and Surveying Management Article 10 Urban planning shall determine the layout, nature and scale of the city according to the objectives and principles of national economic and social development, make overall arrangements for urban economic, cultural and public undertakings, and ensure the planned, orderly and coordinated development of urban construction.

Urban planning in ethnic autonomous areas should respect and maintain national traditions and local characteristics.

The planning of famous historical and cultural cities should protect, inherit and carry forward excellent historical and cultural characteristics and traditional features.

The preparation of urban planning should coordinate the relationship between urban and rural areas, production and life, part and whole, short-term and long-term, old city transformation and new district development, and make overall plans. Eleventh in the city survey and municipal engineering survey, must hold a valid qualification certificate, and after verification by the local administrative department of construction at or above the county level, can work in the professional and business scope approved by the certificate.

The work content and specific scope of urban survey and municipal engineering survey shall be stipulated by the construction administrative department of the provincial people's government.

The results of urban survey and municipal engineering survey shall be uniformly managed by the construction administrative departments at all levels.

Chapter III Construction Land and Building Management Article 13 All urban constructions shall adhere to the principle of rational land use and land conservation, and allocate corresponding municipal public facilities, environmental sanitation facilities and green land. Fifteenth the transfer and allocation of urban land use rights must conform to urban planning and be combined with construction projects.

Urban planning, construction, real estate management departments shall, jointly with land management and other relevant departments, formulate plans for the transfer of land use rights.

The urban planning department shall determine the allocated land; Put forward the planning and design conditions for transferring and allocating plots; Planning and management of development and utilization of transferred and allocated plots.

The content and technical requirements of the planning and design conditions for transferring and allocating land plots shall be stipulated separately by the construction administrative department of the provincial people's government. Sixteenth transfer, transfer of land planning and design conditions, any unit or individual shall not change. If it is really necessary to change, it shall be reported to the municipal planning department for approval, and the municipal planning department shall notify the relevant departments.

The transfer contract shall specify the planning and design conditions and construction requirements of the land to be transferred. Seventeenth land users to obtain land use rights by way of transfer, must obtain the "construction land planning permit", "land use right certificate" and "construction project planning permit" in turn, and the city planning department on-site inspection, before starting construction.
