Rules for the implementation of urban greening management regulations in Hangzhou

Article 1 These Detailed Rules are formulated in accordance with the Regulations of Hangzhou Municipality on Urban Greening Management (hereinafter referred to as the "Greening Regulations"). Article 2 These Rules are applicable to all kinds of greening activities in the built-up area of Hangzhou and the planned area determined by the overall urban planning of Hangzhou approved by the State Council, as well as the planning, construction, management and protection of all kinds of green spaces (including planned green spaces), trees and greening facilities (including green decorative guardrails, garden sketches, greening plants, place name signs, park guiding signs and other greening publicity signs, etc.). Article 3 Hangzhou Municipal Bureau of Landscape Architecture and Cultural Relics is the administrative department in charge of urban landscaping in Hangzhou, responsible for the unified management of urban landscaping in the city, organizing the implementation of urban landscaping planning, guiding, coordinating and inspecting the greening work in various urban areas, and directly responsible for the greening management and protection of West Lake scenic spots and urban street trees.

The administrative department of urban construction of the District People's Government shall be responsible for the greening management within its jurisdiction according to the provisions of these rules, and shall be responsible for the supervision, inspection and guidance of the greening work of organs, troops, enterprises, institutions and people's organizations within its jurisdiction.

Sub-district offices specifically organize supervision and inspection on the greening and management of units, residential quarters and residential buildings within their respective jurisdictions.

Hangzhou Greening Committee unified organization and leadership of the city's urban and rural greening work, and its office is located in Hangzhou Garden Cultural Relics Administration.

Under the guidance of the Municipal Greening Committee, the district greening committees organize and lead the greening work in this district, and their offices are located in the administrative departments of urban construction in various districts. Article 4 The Hangzhou Planning Administration and the Hangzhou Garden Cultural Relics Administration shall, according to the requirements of the overall urban planning of Hangzhou, prepare the urban green space system planning and phased implementation plan. The construction of urban green space should be rationally distributed, so as to combine urban greening with suburban greening, universal greening with key improvement, and gradually form a complete urban green space system. Article 5 All urban residents who have reached the age of 1 1 shall perform voluntary tree planting and other greening obligations in accordance with the relevant provisions of the Measures for the Implementation of Nationwide Voluntary Tree Planting Activities in Municipalities directly under the Central Government of the State Council. All units should report the actual statistical data of people in that year to the office of the District Greening Committee as the basis for assigning specific tasks in that year.

When determining the specific task indicators of voluntary tree planting in each unit, the office of the Municipal and District Greening Committee can delimit the responsibility area according to the unit, undertake tasks such as land preparation, seedling raising, transportation, planting and maintenance, or assign a single task and several single tasks to undertake greening and afforestation according to the corresponding labor volume, or implement the measures for the capital as required. Article 6 If an adult citizen who has reached the age of 18 fails to perform the obligation of planting trees without any reason, he shall be educated by his unit, ordered to replant within a time limit or given economic punishment.

Units that have not completed the task of voluntary tree planting in that year shall pay the voluntary tree planting fee to the office of the Municipal Greening Committee according to the standards formulated by the Municipal Greening Committee and the financial department. Expenses, administrative institutions in the balance of funds or extrabudgetary income charged; The expenditure of an enterprise unit shall be subject to tax adjustment and charged after tax. Article 7 The expenses for voluntary tree planting and greening shall be specially used for the expenses such as salaries, seedlings, fertilizers, medical devices, tools, greening publicity and rewards of tree planting personnel employed by compensation units or individuals who have not completed the task of voluntary tree planting. Article 8 The planning and design of the attached green space of urban construction projects shall be examined and approved in accordance with the basic construction procedures, and the Hangzhou Municipal Bureau of Gardens and Cultural Relics must participate in the examination and approval. Hangzhou Municipal Bureau of Landscape Cultural Relics shall promptly notify the relevant district urban construction administrative departments of the audit opinions. Ninth new district development and old city reconstruction projects, the green land area shall meet the following requirements:

(a) the green area of new residential areas should not be less than 30% of the total land area. Among them, the general index of public green space is not less than 0.5 square meters per capita for groups, not less than 1 square meter per capita for communities (including groups) and not less than 1.5 square meters per capita for residential areas (including communities and groups).

(2) The green area of the old city reconstruction (including groups, communities and residential areas) shall not be less than 25% of the total land area, and the public green area shall not be less than 50% of the corresponding indicators in the preceding paragraph.

(5) The green area of permanent ports, docks, container distribution centers, stations, parking lots, large coal yards and specialized markets determined in the overall urban planning shall not be less than 20% of the total land area, and it shall not be less than 15% of the old city reconstruction project.

(6) Large-scale single buildings such as theaters, restaurants, commercial buildings, and great halls will be built on both sides of the main roads in the old city, and the green area shall not be less than 15% of the total land area.

(seven) schools, nursing homes, hospitals, military units, government organizations, public cultural facilities and other buildings, the green area should be not less than 35% of the total land area, belonging to the old city reconstruction project, not less than 30%.

(eight) chemical, printing and dyeing, papermaking, tanning and other units that discharge toxic and harmful substances, the green area of the factory area should not be less than 30% of the total land area, and it should not be less than 25% of the old city reconstruction project. A protective forest belt with a certain width should be set between the factory and the living area.

(9) Urban road greening: the green belt area of the main road is not less than 20% of the total land area of the road, and the green belt area of the secondary road is not less than 15% of the total land area of the road, which can be reduced by 5 percentage points in the old city.

(ten) the green area of construction projects in the West Lake Scenic Area should be higher than that of similar projects in urban areas15%; The green rate of engineering construction projects in the peripheral protection zone of West Lake Scenic Area should be higher than that of similar projects in urban areas by 5%.
