Measures for the Prevention and Control of Air Pollution in Changchun (revised in 2004)
The term "air pollution" as mentioned in these Measures refers to the phenomenon that human activities directly or indirectly discharge pollution into the atmosphere, resulting in changes in the quality of the atmospheric environment, thus causing harm to life and the ecological environment. Article 3 The prevention and control of air pollution shall follow the principles of giving priority to prevention, combining prevention with control and comprehensive management. Article 4 The municipal, county (city) and district people's governments shall be responsible for the quality of the atmospheric environment within their respective jurisdictions, and must incorporate atmospheric environmental protection into the national economic and social development plan, rationally plan the industrial layout, strengthen scientific research on the prevention and control of atmospheric pollution, and take measures to protect and improve the atmospheric environment. Fifth Changchun Municipal Environmental Protection Bureau is the administrative department in charge of the prevention and control of air pollution in our city, and implements unified supervision and management of air pollution in our city. County (city) and district environmental protection administrative departments shall be responsible for the prevention and control of air pollution within their respective administrative areas.
Public security, transportation and railway management departments at all levels shall, according to their respective responsibilities, supervise and manage the air pollution caused by motor vehicles, ships and locomotives, and accept the supervision, inspection and guidance of environmental protection departments. Article 6 All units and individuals have the obligation to protect the atmospheric environment and have the right to report and accuse the units and individuals that pollute the atmospheric environment. Chapter II Supervision and Management of Prevention and Control of Air Pollution Article 7 During the feasibility study stage of a construction project, the construction unit shall entrust a unit with the qualification of environmental impact assessment to prepare an environmental impact report (table) of the construction project, and submit it to the environmental protection department for examination and approval according to the prescribed procedures. The project review department must receive the approval documents from the environmental protection department before approving the project. Eighth air pollution prevention and control facilities of construction projects must be designed in accordance with the requirements of the environmental impact report (table) and the approval opinions. Article 9 The air pollution prevention and control facilities of a construction project must be constructed at the same time as the main project.
Funds used for the construction of air pollution prevention and control facilities shall not be misappropriated or misappropriated. Article 10 Before a construction project is put into use, the construction unit must apply to the environmental protection department for acceptance of air pollution prevention and control facilities. Only after the acceptance is qualified can the main project be put into use. Eleventh units and individual industrial and commercial households that discharge pollutants into the atmosphere must submit a pollutant discharge registration form to the environmental protection department, and can only discharge after approval.
When the type, quantity and concentration of discharged pollutants need to be significantly changed, it must be declared 15 days before the change. If it is a sudden major change, it must be declared within 3 days after the change. Twelfth air pollution prevention and control facilities must maintain normal operation. In any of the following circumstances, it must be approved by the environmental protection department:
(a) need to suspend operations;
(two) need to transfer, dismantle or idle;
(three) need to be transformed and updated.
After receiving the application, the environmental protection department shall make a reply to Item (1) of the preceding paragraph within 24 hours; If it falls under the provisions of items (2) and (3) of the preceding paragraph, it shall give a reply within 10 days from the date of receiving the application. Failing to reply within the time limit shall be deemed as consent. Thirteenth units and individual industrial and commercial households shall not discharge pollutants into the atmosphere in excess of the prescribed discharge standards, and if they exceed the prescribed discharge standards, they must pay the excessive sewage charges to the environmental protection department in accordance with the regulations.
The use of sewage charges, in accordance with the principle of living within our means, earmarking, and not participating in local system sharing, shall be allocated by the financial department according to the plan of the environmental protection department to control air pollution. Article 14 Units that exceed the prescribed discharge standards and cause serious pollution shall be proposed by the environmental protection department in accordance with the management authority, submitted to the people's government at the same level for decision, ordered to be treated within a time limit, and accepted by the environmental protection department for inspection and acceptance.
For individual industrial and commercial households that exceed the prescribed emission standards and cause serious air pollution, the environmental protection department shall make a decision on treatment within a time limit and order it to be treated within a time limit, and the environmental protection department shall accept it. Article 15 Units that cause air pollution accidents or may cause air pollution accidents due to unexpected events must immediately take emergency measures, notify the units and individuals that may be harmed by pollution, and report to the environmental protection department; Units that cause air pollution accidents must report the time, place, accident type, quantity of pollutants discharged, economic losses and casualties to the environmental protection department within 48 hours after the accident; After the accident is identified, it shall report the cause, process, harm, measures taken, treatment results, remaining problems and preventive measures of the accident in writing to the environmental protection department, and attach relevant supporting documents. Sixteenth environmental protection department supervision and management personnel, the sewage units and individuals to carry out supervision and inspection according to law, shall produce certificates issued by the environmental protection department at or above the municipal level. Seventeenth units and individuals that discharge pollutants into the atmosphere must accept the supervision and inspection of the environmental protection department and truthfully provide relevant information and materials.
Supervisors and inspectors shall keep technical secrets and business secrets for the units and individuals under inspection.
