Regulations of Ningxia Hui Autonomous Region on Property Management
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the houses and their supporting facilities, equipment and related sites in the property management area by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area. Article 3 The real estate administrative department of the people's government at or above the county level or the department responsible for property supervision and management (hereinafter referred to as the real estate administrative department) shall be responsible for the supervision and management of property management activities within their respective administrative areas.
Environmental protection, price, planning, public security, civil affairs and other relevant administrative departments shall, according to their respective responsibilities, do a good job in the supervision and management of property management areas.
Neighborhood offices and township (town) people's governments, under the guidance of real estate administrative departments, are specifically responsible for organizing and guiding the establishment of owners' congress and the change of owners' committee, supervising owners' congress and owners' committee to perform their duties according to law, mediating management disputes between owners, owners' committee and property service enterprises, and coordinating property management. Chapter II Pre-property Management Article 4 Before selling the house, the construction unit shall divide the property management area according to the scope of the red line map determined in the construction land planning permit, facilities and equipment, building scale, residential construction and other factors, and make it clear in the house sales contract.
The main supporting facilities, equipment and related sites of the property shall be divided into a property management area. Residential and non-residential facilities and equipment can be used separately and independently, and can also be divided into different property management areas. Fifth all kinds of supporting buildings, facilities and equipment in the property management area, the construction unit shall carry out the construction in strict accordance with the planning, design specifications and engineering standards of the relevant residential quarters of the state and the autonomous region. Article 6 The construction unit shall allocate property service rooms for newly-built residential properties. The configuration of the realty service room shall meet the following requirements:
(a) the construction area of less than fifty thousand square meters, calculated at not less than four thousandths of the total construction area, at least one hundred and twenty square meters;
(two) the construction area of more than fifty thousand square meters, in addition to four thousandths of fifty thousand square meters, the excess part is not less than two thousandths of the standard configuration;
(three) located in the first to second floor above the ground, with basic decoration and water, heating, electricity, lighting, ventilation and other functions, can be directly put into use.
Property service houses belong to all owners, and no unit or individual may transfer, mortgage or change their use.
The planning administrative department shall, when handling the planning permission and acceptance, review the planning and design indicators such as the construction area, location and configuration of the property service room. The real estate administrative department shall check the configuration of the real estate service room when handling the record of real estate surveying and mapping results. Article 7 Before the owners and the owners' congress select and employ the realty service enterprise, the construction unit shall select and employ the prophase realty service enterprise through bidding according to law, sign the prophase realty service contract and conduct prophase realty management. The term of preliminary property services is generally not more than two years.
The construction unit shall bear the responsibility of the early property service. Property that has been completed but not yet sold or handed over to the property buyer, the property service fee shall be borne by the construction unit.
When the construction unit sells the house, the prophase realty service contract shall be taken as an annex to the house sales contract. Article 8 The construction unit may invite the prophase realty service enterprise to put forward suggestions related to realty management on matters such as supporting facilities construction and equipment operation management.
When the construction unit organizes the project completion acceptance and household acceptance, it shall notify the prophase realty service enterprise to participate.
The construction unit shall, within 30 days from the date of comprehensive acceptance of the residential area, go through the management procedures for receiving professional operating facilities and equipment with relevant professional business units, and assist the property buyer to sign service contracts for water supply, power supply, gas supply and heating with relevant professional business units respectively. Article 9 When handling the preliminary property acceptance formalities, the construction unit shall hand over the property service premises and the following materials to the preliminary property service enterprise:
(a) the division of property management areas;
(two) a copy of the construction land planning permit and the construction project planning permit and the attached drawings;
(three) the completion acceptance report and completion site plan, single building, structure, equipment completion drawings, supporting facilities, underground pipe network project completion drawings, fire acceptance and other completion acceptance materials;
(four) the factory random data of facilities and equipment (including factory certificate), technical data such as installation, acceptance, use, maintenance and regular inspection, as well as operation and maintenance records;
(five) property quality warranty documents and property use documents;
(6) A list of owners;
(seven) other information required for property management.
The construction unit shall specify the pool area and * * * part scope of the property in the "Residential User Manual" and write it into the "House Sales Contract".
The prophase realty service enterprise shall, when the prophase realty service contract is terminated or dissolved, hand over the realty service premises and the above information to the owners' committee.
