Measures for the Administration of Architectural Decoration in Henan Province

Chapter I General Provisions Article 1 In order to strengthen the management of architectural decoration activities, standardize the market order, and ensure the quality and safety of architectural decoration projects, these measures are formulated in accordance with the provisions of the Construction Law of People's Republic of China (PRC), the Regulations on Quality Management of Construction Projects and other laws and regulations, and in combination with the actual situation of this province. Fifth provincial construction administrative departments are responsible for the supervision and management of building decoration activities in the province, and their subordinate decoration management institutions are specifically responsible for the daily work of supervision and management of decoration activities.

The administrative department in charge of decoration determined by the people's governments of cities and counties (cities, districts) under the provincial jurisdiction is responsible for the supervision and management of building decoration activities within their respective administrative areas.

Urban and rural planning, real estate, fire protection, environmental protection, industrial and commercial management, quality and technical supervision and other departments shall, in accordance with their respective responsibilities, do a good job in supervision and management related to building decoration activities. Sixth decoration industry associations should strengthen industry self-discipline, carry out industry services, standardize industry behavior, accept architectural decoration consultation and complaints, and coordinate to solve decoration disputes. Chapter II * * * Same Provisions Article 7 Units engaged in the design, construction and supervision of architectural decoration shall obtain corresponding qualification certificates according to law and undertake projects within the scope permitted by their qualification grades.

Construction units engaged in building decoration shall obtain safety production licenses according to law. Article 8 Professional and technical personnel engaged in architectural decoration design, construction and supervision shall obtain corresponding qualification certificates according to law and practice within the scope permitted by the qualification certificates.

For the types of jobs that the state implements the vocational qualification certificate system, the employees shall undergo professional training, and the assessment and appraisal institutions established according to law shall carry out the assessment and appraisal of vocational skills and obtain the vocational qualification certificate according to law; Construction personnel engaged in special types of work shall also obtain special operation certificates according to law. Ninth architectural decoration design units shall carry out decoration design in accordance with the mandatory standards for engineering construction, and be responsible for the design quality.

Building decoration construction units shall carry out construction in accordance with the engineering design drawings and construction technical standards, and be responsible for the construction quality.

Building decoration supervision units shall, in accordance with laws, regulations and relevant technical standards, design documents and decorative renovation contract, assume supervision responsibility for project quality. Article 10 The materials and equipment used in building decoration shall conform to the relevant national design requirements, product quality, energy-saving and harmful substance limit and combustion performance control standards, and shall be accompanied by product quality inspection certificate and product name, specification, model, name and address of manufacturer indicated in Chinese.

It is forbidden to use building decoration materials and equipment that are unqualified in quality, explicitly eliminated by the state or do not meet the relevant national standards for indoor environmental pollution control and energy conservation. Eleventh building decoration construction units must be in accordance with the engineering design requirements, construction technical standards and contract, inspection of building materials and equipment, unqualified shall not be used. Twelfth decorative buildings and structures of the construction unit, the owners and users (hereinafter referred to as the decoration), shall sign a building decoration renovation contract with the construction unit according to law. The contract shall include the following main contents:

(a) the name, address and contact information of the decorator and the building decoration construction unit;

(two) the basic situation of the decoration project and the way of contracting;

(three) the name, brand, model, specification, grade and quantity of the main materials used for decoration;

(4) Commencement and completion dates;

(five) the project price, payment method and time limit;

(six) the project quality requirements and acceptance methods;

(seven) the scope and duration of the warranty;

(eight) the liability for breach of contract and the way to resolve disputes. Thirteenth buildings and structures in any of the following circumstances, shall not be decorated:

(a) the quality of the main structure of new buildings and structures is unqualified;

(two) the original buildings and structures have structural safety hazards. Fourteenth in the building decoration activities prohibit the following acts:

(a) without the original design unit or the design unit with the corresponding qualification grade, changing the main body and load-bearing structure of the building without authorization;

(2) Dismantling and refitting pipeline gas facilities by themselves;

(three) the demolition of building facilities or components related to fire safety;

(four) damage to the original energy-saving facilities of the building;

(5) Changing rooms or balconies without waterproof requirements into bathrooms and kitchens;

(6) occupying public places or damaging public parts and facilities;

(seven) due to the change of buildings, structures and supporting facilities, the basic rights and interests of other users and residents are infringed;

(eight) other acts that affect the safety of building structure and use.
