Measures of Yinchuan Municipality on the Administration of Residential Special Maintenance Funds
The term "residential special maintenance funds" as mentioned in these Measures refers to the funds earmarked for the maintenance, renewal and transformation of commercial housing, after-sale public housing and facilities and equipment after the expiration of the warranty period.
The * * * part of the house as mentioned in these Measures refers to the * * * part shared by the owner of a single house or the owner of a single house and its connected non-residential owners according to the laws, regulations and the house sales contract, and generally includes: the foundation, load-bearing walls, columns, beams, floors, roofs, outdoor walls, hallways, stairwells, corridors, etc.
The measures referred to in * * facilities and equipment refers to the ancillary facilities and equipment used by residential owners or residential owners and related non-residential owners according to laws, regulations and house sales contracts, generally including elevators, antennas, lighting, fire-fighting facilities, green spaces, roads, street lamps, ditches, pools, wells, non-operating parking garages, public cultural and sports facilities and facilities and equipment used in * * * rooms. Third residential special maintenance funds management should follow the principles of special account storage, earmarking, national decision-making, and government supervision. Article 4 The municipal housing security department is the administrative department in charge of special maintenance funds for residential buildings in municipal districts, responsible for the deposit, management and use of special maintenance funds for residential buildings, and its subordinate Yinchuan Property Management Office (hereinafter referred to as the Municipal Property Office) is specifically responsible for the daily management of special maintenance funds for residential buildings.
The municipal finance department is responsible for supervising the management and use of special maintenance funds for residential buildings. Chapter II Deposits Article 5 The owners of the following properties shall deposit special maintenance funds for their houses in accordance with the provisions of these Measures:
(a) residence, except that it is jointly owned by the owners and does not use parts and facilities with other properties;
(2) Non-residential buildings in residential quarters or non-residential buildings connected with single residential structures outside residential quarters.
If the property listed in the preceding paragraph belongs to the sold public housing, the selling unit shall deposit the special maintenance fund for the housing in accordance with the provisions of these Measures. Article 6 The municipal housing security department shall entrust a commercial bank as a special account management bank for residential special maintenance funds within the municipal area, and open a special account for residential special maintenance funds in the special account management bank. Article 7 A bank entrusted to open a special residential maintenance fund account shall sign a fund supervision agreement with the municipal housing security department. The special account for residential maintenance funds shall be set up in the property management area as a unit, and a sub-account shall be set up according to the house number. Article 8 The owners of commercial residential and non-residential houses shall deposit special maintenance funds for houses according to the construction area of their own properties, and the first special maintenance funds for houses shall be deposited in the special maintenance fund account for houses according to the following standards:
(1) The amount of the first-phase special maintenance fund per square meter of the elevator-free residence is 40 yuan;
(2) The amount of the first special maintenance fund for non-residential houses, houses with elevators and villas per square meter of construction area is 50 yuan.
The deposit standard of the first-phase residential special maintenance fund listed in the preceding paragraph shall be adjusted in a timely manner according to the actual situation of this Municipality, and announced in a timely manner after approval by the Municipal People's Government. Ninth sale of public housing, in accordance with the following provisions of the deposit of residential special maintenance funds:
(1) The owner shall deposit the special maintenance fund for the house according to the construction area of the property owned by him, and the amount of the first special maintenance fund for the house per square meter of construction area shall be 2% of the local housing reform cost price;
(two) units selling houses shall, in accordance with the sales price of houses without elevators of 20% and the sales price of houses with elevators of 30%, draw special maintenance funds for houses at one time from the sales price. Article 10 In the property management area, the construction unit promises in the property sales contract or other written forms that the supporting houses owned by the owners will not pay the special residential maintenance funds for the planned property service houses, public facilities and equipment houses, equipment overhead floors and non-motor vehicle garages. Within the property management area, owners of other non-residential properties, such as garages shared by all owners, shall deposit special residential maintenance funds in accordance with the provisions of Article 8 of these Measures, and the special account management bank shall set up a sub-account with the door number or parking space number as the unit. Eleventh the first phase of residential special maintenance funds shall be deposited in accordance with the following terms and procedures:
(1) When the commercial housing buyer signs a commercial housing sales contract with the development and construction unit, the purchaser shall transfer the first-phase residential special maintenance fund in full to the residential special maintenance fund account. The specific procedures are as follows:
1, the development and construction unit shall, after obtaining the Pre-sale Permit for Commercial Housing or selling the house in the development project, apply to the Municipal Property Management Office for special residential maintenance funds and deposit them in the account for the record;
2, the city property office issued a notice of deposit of special maintenance funds to the development and construction units (hereinafter referred to as the notice of deposit);
3. The development and construction unit will hand over the deposit notice to the purchaser, and the purchaser will deposit the first phase of residential special maintenance funds in full with the deposit notice to the special account management bank;
4. The special account management bank issues a deposit certificate to the purchaser.
(two) the owner of the public housing that has been sold shall deposit the first phase of the special maintenance fund of the house into the special maintenance fund account of the house or hand it over to the selling unit for deposit into the special maintenance fund account of the house before going through the housing reform formalities. Public housing units selling houses shall, within 30 days from the date of receiving the payment for selling houses, deposit the extracted residential special maintenance funds into the residential special maintenance fund account.
