The term "residential property management" as mentioned in these Measures refers to the maintenance, repair and renewal of buildings, structures and equipment in residential areas, municipal, public, garden, sanitation, transportation, public security and other public facilities and environmental appearance management projects.
The term "owners' committee" as mentioned in these Measures is a mass autonomous organization that represents and safeguards the legitimate rights and interests of property owners and users of property and public facilities in residential areas. The owners' committee is elected by the owners and users of the property and public facilities in the residential area.
The term "household" as mentioned in these Measures refers to the owners and users of residential or non-residential houses. Article 4 Guangzhou Municipal Construction Committee (hereinafter referred to as the Municipal Construction Committee) shall be responsible for organizing the implementation of these Measures.
The industry management of residential property management is under the jurisdiction of the Municipal Construction Committee.
The competent department of district construction shall specifically implement the business guidance and management of property management in residential quarters within its jurisdiction. Fifth planning, land, housing management, municipal, landscape, sanitation, public utilities, power supply, industry and commerce, telecommunications, public security and other management departments (hereinafter referred to as professional management departments) and sub-district offices, within their respective functions and powers, coordinate in the property management of residential areas. Chapter II Handover Management of Residential Quarters Article 6 The handover management procedures can only be handled after the comprehensive acceptance of residential quarters is qualified. Seventh residential quarters under construction, residential quarters construction units must organize or entrust a qualified residential quarters property management unit (hereinafter referred to as the property company) for management in advance. Residential construction units must provide property buyers with the "Occupancy Management Convention" when handling the procedures for selling houses. Article 8 When the occupancy rate of residential quarters fails to pass the comprehensive acceptance of the completion of residential quarters, the construction unit of residential quarters must go through the property management procedures at the local construction department, and the construction unit or its entrusted property company signs a property management contract with the owners' committee; If the owners' committee is not established, the residential property management contract shall be signed with the district construction department, and the management shall be implemented according to the contract. Ninth through the comprehensive acceptance of residential areas and receive the "residential area (group) acceptance certificate" of residential areas, residential area construction units can rely on the community acceptance certificate, to the local community construction authorities to declare the transfer procedures.
For residential quarters that have gone through the transfer management procedures, the owners' committee and the property company shall sign a property management contract for residential quarters; If the owners' committee is not established, the district construction department and the property company shall sign the "Residential Property Management Contract" and implement the management according to the contract. The standard of the overall fund can be adjusted by the Municipal Construction Committee in conjunction with the municipal price department according to the changes in the price index.
The overall fund for the management of residential quarters shall be handed over to the competent department of construction in the district where the residential quarters are located by the construction unit of residential quarters at the time of handover management, and shall be earmarked for subsidies for the maintenance and management expenses of residential quarters. The specific measures for use shall be formulated separately by the Municipal Construction Committee. Article 13 The management rooms in residential quarters shall be equipped according to the following standards: the total construction area of commercial housing is 0. 15%, and the total construction area of management rooms is 0. 1%. The houses provided are rented to the property company for operation and use according to the rent of public houses, and the property rights belong to the residential construction unit. Fourteenth residential construction units from the date of transfer of management, no longer bear the management responsibility of residential areas, except for the responsibility of housing construction quality identified by the construction quality supervision department. Fifteenth property management companies to residential property management, the district construction administrative departments shall, according to the opinions of the owners' committee, organize relevant professional management departments to put forward rectification opinions within a time limit for existing problems. If the rectification is not completed within the time limit, the original residential property management contract can be terminated in advance, and the owners' committee will hire a property company to take over the property management of residential quarters. Chapter III Conditions and Business Scope of Property Management Company Article 16 A property management company is a business unit engaged in property management in residential areas and providing community services. Seventeenth property companies must have technical personnel with junior titles or above in construction, municipal administration, gardens, water and electricity, finance and other aspects. The registered capital is not less than 500,000 yuan.
The maintenance personnel of public facilities employed by the property management company must be the maintenance personnel who hold the employment certificate issued by the relevant professional management department.
