Regulations of Shenyang Municipality on Property Management (revised on 20 18)
District and county (city) real estate departments are responsible for the supervision and management of property management activities within their respective jurisdictions.
Public security, civil affairs, finance, land planning, environmental protection, construction, urban management, urban management administrative law enforcement, water conservancy, quality supervision, civil air defense, industry and commerce, price and other relevant competent departments shall, according to their respective responsibilities, do a good job in property management according to law. Fifth street offices and Township People's governments shall perform the following duties of property management:
(1) Organizing the establishment of the preparatory group for the first owners' meeting;
(two) to guide and assist the establishment of the owners' congress and the election of the owners' committee;
(three) to guide, support and supervise the owners' congress and the owners' committee to carry out their daily work;
(four) to coordinate and guide the property management of old residential areas;
(five) to coordinate the relationship between property management and community management services, and to mediate disputes between owners, owners' committees, property users, property service enterprises and construction units in property management activities;
(six) other duties as prescribed by laws and regulations.
Neighborhood (village) committees shall assist neighborhood offices and township people's governments in doing a good job in property management. Article 6 Trade associations of realty service enterprises shall strengthen self-discipline management, standardize trade behaviors, strengthen the training of employees, coordinate and resolve trade disputes, and promote the healthy and orderly development of the industry. Chapter II Early Property Management Article 7 The term "early property management" as mentioned in these Regulations refers to the property management implemented by the construction unit before the owners and the owners' meeting select the property service enterprise. Article 8 A residential property construction unit shall employ a property service enterprise through bidding according to law. A property management area should be invited for bidding as a whole.
If the number of bidders is less than three or the construction area does not exceed 30,000 square meters, it can be selected by agreement with the approval of the district/county (city) real estate department where the property is located. Article 9 Where a construction unit selects a realty service enterprise to engage in prophase realty management, it shall, before 10 of the tender announcement or invitation to bid, handle the tender filing with the district/county (city) real estate department where the property is located, and provide the following information:
(a) the business license and qualification certificate of the construction unit;
(two) opinions on the division of property management areas;
(3) tender documents;
(4) Temporary management statute;
(5) Other materials as prescribed by laws and regulations.
The temporary management regulations formulated by the construction unit shall not violate relevant laws and regulations, and shall not infringe upon the legitimate rights and interests of property buyers. Article 10 The construction unit shall sign a written preliminary realty service contract with the realty service enterprise selected, and the contract period shall not exceed three years. Within fifteen days from the date of signing the preliminary realty service contract, the construction unit shall report the preliminary realty service contract to the district/county (city) real estate department where the property is located for the record. Eleventh new property water supply, gas supply, heating, power supply, drainage, communications, cable television, fire protection, roads, greening, property management rooms, parking spaces and other supporting buildings and facilities and equipment in accordance with the law after the comprehensive acceptance, the construction unit can handle the property delivery procedures with the property buyer.
If the construction unit delivers the newly-built property that does not meet the delivery conditions to the buyer, it shall bear the corresponding responsibilities and bear the prophase property service fees. Twelfth in accordance with the provisions of the property has been delivered to the owner, the property service fee shall be borne by the owner; For undelivered or completed but unsold properties, the property service fee shall be fully borne by the construction unit. If the construction unit and the property buyer agree to reduce the property service fee, the reduction fee shall be borne by the construction unit. Thirteenth construction units shall cooperate with the property service enterprises to do a good job in property inspection, and hand over the following information to the property service enterprises 20 days before the on-site inspection:
(a) the completion of the general plan, single building, structure, equipment completion drawings, supporting facilities, underground pipe network project completion acceptance data;
(2) Technical data such as installation, use and maintenance of facilities and equipment (including random data);
(three) water supply, power supply, gas supply, heating, communications, cable television and other licensing documents;
(four) property quality warranty documents and property use documents;
(five) information on the transfer of property rights of facilities and equipment handled by the construction unit and professional business units;
(6) A list of owners;
(seven) list of all kinds of buildings, structures, facilities and equipment in the property management area;
(eight) other information necessary for inspection.
If all the materials listed in the preceding paragraph are not handed over, the construction unit shall make a detailed list of the materials that have not been handed over, and make a written commitment to make up the specific time limit.
