Refers to the system in which a person whose whereabouts have been unknown for a certain period of time is declared as a missing person by the people's court upon the application of an interested party. (1) Subject conditions: Interested parties include spouses, parents, adult children, grandparents, grandparents, brothers and sisters, and citizens and legal persons who have civil rights and obligations with the declared missing person. (2) Object condition: 1. There is a fact that the whereabouts are unknown. In case of floods, earthquakes and wars. If you know that someone is somewhere, even if he hasn't come back for a long time, you can't think that he is missing. You must have been missing for two years. If the whereabouts are unknown during the war, the time of missing shall be counted from the end of the war. (3) Formal conditions. The application must be made in writing, and oral application is not allowed. It must be declared missing by the people's court according to legal procedures, and no unit or individual has this right.

Article 67 of the Civil Procedure Law of People's Republic of China (PRC), the people's court has the right to investigate and collect evidence from relevant units and individuals, and the relevant units and individuals may not refuse.
