Is it legal to pay property fees in advance?

It is legal to collect property fees in advance. This kind of behavior does not violate the law. The property fee is the fee that the owner must pay, but the standard of payment should be charged according to the actual situation of the community, so as to better handle the previous relationship between the two parties. It is a basic contractual obligation of the owner to pay the property management fee according to the agreement, and it is a breach of contract not to pay the property management fee without sufficient defense reasons.

Refusal to pay property fees includes:

1, the service quality provided by the property management company can't meet the standards agreed in the contract;

2, the property company without authorization to expand the scope of charges, raise fees, repeated charges;

3. The property management company increases the charging items without the consent of the owner. If the services provided by the property management company fail to meet the standards stipulated in the contract, the service quality is not in place. If the service quality does not match the charging price, the owners can directly negotiate with the property company through the owners' committee, or even hire other property companies to manage the community according to the contract.

Legal basis: Article 7 of the Regulations of People's Republic of China (PRC) Municipality on Property Management.

Owners shall perform the following obligations in property management activities:

(a) in accordance with the relevant provisions of the state to pay special maintenance funds;

(2) Pay the property service fee on time;

(3) Other obligations stipulated by laws and regulations.

Legal basis: Article 65 of the Regulations of People's Republic of China (PRC) Municipality on Property Management.

In violation of the property service contract, the owners fail to pay the property service fee within the time limit, and the owners' committee shall urge them to pay it within a time limit; If it fails to pay within the time limit, the realty service enterprise may bring a lawsuit to the people's court.
