Regulation of property law on pipeline wells

The property is responsible for the management of pipeline wells. Pipe shaft is used to arrange vertical equipment pipes in buildings. The more complex and advanced buildings need more supporting systems, besides basic water supply, power supply and drainage pipes, there are also functions such as telephone, cable TV, monitoring and ventilation. The front end of the valve in the management well belongs to the property management, and the back end of the valve belongs to the owner. In addition, if a single pipe is connected in series, the property is responsible for connecting the wall pipes in series, that is, the public standpipe, and the owner is responsible for connecting the standpipe to the radiator.

If the pipeline shaft is a public pipeline, the property can be locked, and the property has the following responsibilities:

1. Property maintenance management: A property management enterprise shall carry out maintenance and technical management on the properties it manages according to the national property management standards, including house safety and quality management, house maintenance technical management, house maintenance and construction management;

2. Property equipment management. Property equipment to be managed mainly includes water supply and drainage equipment, gas equipment, heating equipment, ventilation equipment and electrical equipment.

3. Property environmental management: Property management companies have the obligation to manage the environment of residential quarters, so that it can meet the standards set by the state, including pollution prevention, environmental cleaning and environmental greening.

4. Property management safety: Property companies should take various measures to ensure the personal and property safety of owners and users of houses, manage the public security of the community, manage the fire safety of the community, and manage the vehicles and personnel entering and leaving the community.

5. Liaise with the government and public institutions on public facilities.

Article 51 of the Regulations on Property Management

Water supply, power supply, gas supply, heating, communication, cable television and other units shall bear the responsibility for the maintenance and conservation of relevant pipelines and facilities and equipment within the property management area according to law.

If the units specified in the preceding paragraph temporarily occupy or dig roads and sites due to maintenance, they shall promptly restore the original state.

Article 938 of the Civil Code of People's Republic of China (PRC)

The contents of the realty service contract generally include service items, service quality, service fee standards and collection methods, use of maintenance funds, management and use of service places, service term, service handover and other terms.

The public service commitment made by the property service provider in favor of the owner is an integral part of the property service contract.

The realty service contract shall be in written form.
