Interim Measures of Guiyang Municipality on the Construction and Management of Public Welfare Agricultural Products Retail Network in Newly Built and Rebuilt Residential Areas (Revised in 2020)

Article 1 These Measures are formulated in accordance with relevant laws, regulations and national policies, combined with the actual situation of this Municipality, in order to strengthen the construction of public welfare agricultural products retail outlets in newly-built or rebuilt residential areas, facilitate citizens' lives, and ensure the sufficient supply and price stability of agricultural products in the whole city. Article 2 These Measures shall apply to the planning, construction and related management activities of newly-built or rebuilt retail outlets of public welfare agricultural products in residential areas of this Municipality.

The measures referred to in public welfare agricultural products retail outlets, refers to all kinds of retail forms invested by the government or built in cooperation with social funds, which strengthen the public welfare service function and sell agricultural products such as vegetables, fruits, meat, poultry and eggs, including public welfare fresh supermarkets, community vegetable markets and community vegetable shops. Article 3 The establishment of retail outlets for public welfare agricultural products shall follow the principles of reasonable total amount, scientific layout and convenience for the people and the people. Fourth people's governments at or above the county level shall incorporate the construction of public welfare agricultural products retail outlets into the national economic and social development plan of their respective administrative regions, and incorporate the special funds for the development of public welfare agricultural products retail outlets into the financial budget management. Article 5 The Municipal People's Government shall make overall planning, supervision, guidance and assessment on the planning, construction and management of public welfare agricultural products retail outlets in the city. The people's governments at the county level shall be responsible for the planning, construction and management of public welfare agricultural products retail outlets within their respective administrative areas. Article 6 The competent commercial department of the Municipal People's Government shall be responsible for the coordination, guidance, supervision and inspection of the planning and construction of public welfare agricultural products retail outlets in the city. The competent commercial department of the people's government at the county level shall be responsible for the management of public welfare agricultural products retail outlets within its jurisdiction.

The competent department of natural resources and planning shall be responsible for the planning and land management of the construction of public welfare agricultural products retail outlets according to law.

The competent department of housing and urban-rural construction shall be responsible for organizing, coordinating and supervising the construction, transfer and reception of public welfare agricultural products retail outlets in accordance with their duties.

Development and reform, finance, ecological environment, emergency and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the construction and management of public welfare agricultural products retail outlets.

Neighborhood offices and Township People's governments shall cooperate with the construction and management of public welfare agricultural products retail outlets within their respective jurisdictions. Seventh new residential areas, supporting the construction of public welfare agricultural products retail outlets, should be designed, constructed, accepted and delivered at the same time with the main project, and abide by the following provisions:

(a) the development and construction unit shall specify the location and construction scale of public welfare agricultural products retail outlets in the project construction plan;

(II) The competent department of natural resources and planning shall indicate the location, building scale and use of public welfare agricultural products retail outlets in the attached drawings of the construction project planning permit, and indicate the location, building scale and use in the real estate ownership certificate of public welfare agricultural products retail outlets. Article 8 The competent department of natural resources and planning shall, when providing planning conditions for newly-built or rebuilt residential land, incorporate the setting of public welfare agricultural products retail outlets into the planning and design conditions according to the layout plan prepared by the competent department of commerce, and announce the setting and construction requirements of public welfare agricultural products retail outlets determined by the planning conditions to the public when organizing the transfer of business land. Article 10 Before the implementation of these measures, the farmer's market built for public use shall not change its functional use, and if its owner cannot continue to operate according to its functional use, the department or institution designated by the Municipal People's Government shall negotiate and cooperate with it to build public welfare agricultural products retail outlets; If the coordination fails, the departments or institutions designated by the Municipal People's Government shall negotiate the repurchase at the cost price according to law to ensure its continuous operation. Eleventh new residential development projects, after the completion of natural resources and planning, housing and urban and rural construction, commerce and other relevant departments. When the development and construction unit organizes the completion acceptance, it shall participate in the acceptance of supporting public welfare agricultural products retail outlets.

Not in accordance with the planning requirements supporting the construction of public welfare agricultural products retail outlets, the relevant competent departments shall not handle the completion acceptance filing and other related procedures, and ordered the development and construction units to reorganize the completion acceptance after rectification. The competent department of commerce shall publish the contact information of complaints and reports, accept complaints and reports, deal with them in a timely manner, and feed back the handling situation to the complainant. Article 15 If the property owners and operators of public welfare agricultural products retail outlets are under any of the following circumstances, the competent commercial department shall order them to make corrections within a time limit. If they fail to make corrections within the time limit, they will be fined more than 5,000 yuan/kloc-0,000 yuan, and if they have illegal income, they will be fined more than 2 times and less than 3 times, but the maximum amount will not exceed 30,000 yuan:

(1) Failing to put the retail outlets of public welfare agricultural products into operation within the time limit stipulated in these Measures;

(two) to stop the operation of public welfare agricultural products retail outlets without justifiable reasons, which seriously affects the lives of residents.

Other illegal acts in violation of the provisions of these measures, laws, regulations and rules for administrative punishment, shall be punished according to law.
