Measures of Wuhan Municipality on the Administration of Elevator Safety

Chapter I General Provisions Article 1 In order to strengthen elevator safety management and ensure the safety of people's lives and property, these measures are formulated in accordance with the Law of the People's Republic of China on the Safety of Special Equipment and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the production (including manufacture, installation, renovation and maintenance), use, maintenance, inspection and testing of elevators and related safety supervision and management activities within the administrative area of this Municipality.

The elevators mentioned in these Measures include manned (cargo) elevators, escalators and moving sidewalks. The specific scope is determined according to the catalogue of special equipment and the safety technical specifications of special equipment stipulated by the state. Article 3 The municipal and district people's governments (including the administrative committees of development zones, scenic spots and chemical zones, the same below) shall strengthen their leadership over elevator safety work, incorporate elevator safety work into the assessment scope of the responsibility system for production safety, urge relevant departments to perform their supervision and management duties according to law, and coordinate and solve problems existing in elevator safety supervision and management in a timely manner.

Neighborhood offices (Township People's governments) shall urge the elevator use management unit to be responsible for discovering and reporting the hidden dangers in the safe use of elevators in this area; Supervise the implementation of the elevator social supervisor system; Organize and coordinate the owners' committee to raise funds for elevator maintenance, renovation and renewal. Article 4 The municipal and district (including development zones, scenic spots and chemical zones, the same below) special equipment safety supervision and management departments shall supervise and manage the elevator safety within their respective jurisdictions.

The construction administrative department is responsible for the design review of elevator specifications and quantity configuration in the building, as well as the supervision and management of elevator shaft, machine room, pit, monitoring room and other building quality; Before the elevator is handed over to the use management unit, supervise the construction unit to perform the elevator safety management duties.

Housing security and housing management departments are responsible for guiding and supervising the property service enterprises entrusted as elevator management units to perform elevator management duties according to law; Guide and supervise them to establish separate accounts for the daily operation and maintenance expenses of residential elevators, which are earmarked for special purposes; Handle and use special residential maintenance funds according to law for the maintenance, renovation and renewal of residential elevators.

The public security department is responsible for establishing an elevator emergency rescue platform, doing a good job in elevator fault emergency rescue, and sharing information with the special equipment supervision and management department.

Planning, safety supervision, industry and commerce, price and other administrative departments shall, in accordance with their respective duties, do a good job in elevator safety supervision and management. Article 5 Special equipment industry associations shall establish industry self-discipline mechanism, promote the construction of industry credit system, provide elevator safety publicity, technical training and safety evaluation services, collect and publish elevator maintenance time, reference price and other industry information, promote elevator safety liability insurance, strengthen industry exchanges and promote the healthy development of the industry. Sixth encourage elevator production, use, maintenance and other units to buy elevator safety liability insurance. Chapter II Production Article 7 An elevator production unit shall obtain a production license for special equipment according to law, conduct production activities in accordance with relevant national standards and safety technical specifications, and be responsible for the quality of the elevators produced. Article 8 The elevator manufacturing unit shall provide the elevators that leave the factory with design documents, product quality certificates, installation, use and maintenance instructions and other relevant technical data and documents that meet the requirements of safety technical specifications, and set up product nameplates, safety warning signs and their descriptions in a prominent position of the elevators. Article 9 An elevator manufacturing unit shall perform the following obligations:

(a) a clear warranty period, during the warranty period, elevator quality problems, free maintenance or replacement of related parts;

(two) to provide necessary elevator spare parts, technical training and other technical assistance to the elevator use management unit;

(three) in the follow-up investigation and understanding of the safe operation of the elevator, it is found that there are hidden dangers in the elevator, and it shall put forward suggestions for improvement to the use management unit;

(4) If the elevator has signs that endanger safety due to design and manufacture, it shall immediately stop production and take the initiative to recall, inform the use management unit in time, and report to the municipal special equipment safety supervision and management department. Tenth elevator installation, renovation and maintenance, must be carried out by the manufacturing unit or its entrusted units with corresponding qualifications. The entrusted unit shall not entrust or entrust the elevator installation, renovation and maintenance business in disguised form.

If the original manufacturing unit has cancelled or no longer has the manufacturing license of the corresponding type of elevator, after obtaining the consent of the elevator owner, the use management unit may entrust a unit with corresponding qualifications to carry out renovation or maintenance. Where the transformation is implemented, the transformation unit shall inspect and debug the elevator in accordance with the requirements of safety technical specifications, issue a quality certificate, replace the nameplate of the elevator product, indicate the name of the transformation unit, license number and transformation date on the nameplate and quality certificate of the elevator, and be responsible for the safety performance of the elevator; Repair, the repair unit shall be responsible for the quality of elevator repair.

The installation, modification and major repair of elevators must be subject to the supervision and inspection of special equipment inspection institutions in accordance with the requirements of safety technical specifications. An elevator that has not been supervised and inspected or that fails to pass the supervision and inspection shall not be delivered for use. Eleventh elevator installation, renovation and maintenance units shall inform the district special equipment safety supervision and management department of the time, place and content of the proposed construction before construction. The district special equipment safety supervision and management department shall urge the elevator installation, renovation and maintenance units to declare to supervise and inspect their elevators.
