Measures for the Safety Management of Fireworks and Firecrackers in Tianshui City (202 1)

Article 1 In order to strengthen the safety management of fireworks and firecrackers, standardize the production, operation, transportation and discharge, prevent and reduce safety accidents and environmental pollution, and ensure the personal and property safety of the public and citizens, these Regulations are formulated in accordance with the People's Republic of China (PRC) Law on Safety in Production, the People's Republic of China (PRC) Law on Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the safety management of the production, operation, transportation and discharge of fireworks and firecrackers within the administrative area of this Municipality.

The term "fireworks" as mentioned in these Measures refers to fireworks products and civil black powder, pyrotechnics, fuses and other items used for the production of fireworks. Third fireworks safety management adhere to the principle of prevention first, territorial supervision, strict control and comprehensive management. Fourth production, management, transportation, holding fireworks and other large-scale fireworks display activities to implement the licensing system.

Without permission, no organization or individual may produce, operate or transport fireworks, or hold fireworks parties or other large-scale fireworks display activities. Article 5 The municipal emergency management, public security, market supervision, ecological environment, housing construction and other departments shall perform the duties of fireworks and firecrackers safety management according to law, and guide the fireworks and firecrackers safety management of relevant departments in counties and districts.

The county people's government leads the safety management of fireworks and firecrackers in the county, and establishes a comprehensive coordination mechanism for fireworks and firecrackers safety management with the participation of emergency management, public security, market supervision, ecological environment, urban management and other departments and units.

The county-level emergency management department is responsible for the safety supervision and management of fireworks production and operation, including the layout planning of fireworks retail operation, the review of safety conditions of fireworks retail premises, the issuance of fireworks retail operation (retail) licenses, the investigation and punishment of fireworks production and operation without permission or beyond the permitted scope, the investigation and punishment of fireworks operation that does not meet the national, industry standards and relevant regulations, and the inspection of fire safety of fireworks business premises. To prevent and dispose of fire accidents caused by the discharge of fireworks and firecrackers, organize the investigation of general safety accidents in the production and operation of fireworks and firecrackers according to the entrustment or authorization of the people's government at the county level, and guide the safety management of fireworks and firecrackers in towns and villages.

The county public security department is responsible for the safety management of fireworks and firecrackers, including permitting large-scale fireworks display activities such as fireworks transportation and fireworks evening, investigating and dealing with illegal storage, transportation and discharge of fireworks and firecrackers that affect social order, organizing the destruction and disposal of used fireworks and firecrackers and confiscated illegal fireworks and firecrackers, and carrying out daily inspections that restrict or prohibit the discharge of fireworks and firecrackers.

County-level market supervision departments are responsible for the quality supervision of fireworks and firecrackers, and investigate and deal with illegal acts of fireworks and firecrackers.

The county ecological environment department is responsible for the environmental quality monitoring during the fireworks display.

The county management department is responsible for investigating and dealing with illegal occupation of fireworks stalls and mobile occupation of roads to sell fireworks and firecrackers. Article 6 Township People's governments and sub-district offices shall incorporate the safety management of fireworks and firecrackers into the comprehensive management work at the grass-roots level, assist in the daily inspection of restricting or prohibiting the discharge of fireworks and firecrackers, and cooperate with relevant departments to do a good job in the safety management and law enforcement of fireworks and firecrackers. Seventh city, county, district fireworks safety management departments regularly organize fireworks safety management laws, regulations, rules and fireworks safety knowledge publicity and education every year, and guide the public to operate and set off fireworks according to law, safety and civilization.

Radio, television, newspapers, internet and other media regularly carry out public welfare publicity on the safe discharge of fireworks and firecrackers and changing customs every year.

Guardians of minors have the responsibility to educate minors about the safety of fireworks. Article 8 Township people's governments and sub-district offices shall guide village (neighborhood) committees and residential owners' committees (property service enterprises) to create law-abiding, safe, environmentally-friendly and civilized villages and communities (communities), and organize village (neighborhood) people to formulate and implement the convention on setting off fireworks and firecrackers in their residential areas. Ninth encourage organizations and individuals to report illegal production, operation and transportation of fireworks and firecrackers to emergency management, public security and other departments.

After receiving the report, emergency management, public security and other departments shall promptly accept it, take effective measures to deal with it, and inform the reporter of the result. If it belongs to the management responsibilities of other departments, it shall be handed over to the relevant departments in a timely manner and inform the informants. The reporting department shall keep confidential the informants.

The people's government at the county level shall establish a reward system for reporting illegal production, operation, transportation and fireworks. Tenth fireworks production, operation and transportation, as well as fireworks evening and other large-scale fireworks display activities, should fulfill the main responsibility of safety according to law. Eleventh production of fireworks and firecrackers, shall obtain a production license according to law, and strictly implement the national safety standards for fireworks and firecrackers production. Twelfth fireworks, shall obtain a business license in accordance with the law, and operate in the licensed business scope, validity and business premises.

Fireworks and firecrackers operators shall hang the original business license in a prominent position in the business (office) place, so as to achieve "one certificate and one store (point)", and the position marked in the business license must be consistent with the actual business position. A wholesale operator shall store a copy of the business (wholesale) license in a warehouse.

It is forbidden to rent, lend, transfer, buy, sell, falsely use or use forged business licenses for fireworks and firecrackers.
