The draft property law stipulates that the community owners' assembly has the right to change the property.
Residential property charges are subject to government guidance, and the benchmark price and floating range of charges are formulated by the municipal price department in conjunction with the real estate administrative department. The residential area where the owners' congress is established shall be implemented after the approval of the owners' congress or its authorized owners' committee and property management enterprises according to the benchmark price and floating range of property service charges set by various localities. If negotiation fails, the property management enterprise shall put forward opinions with reference to the local benchmark price and report them to the local price department for approval. If the owners' meeting is not established, the property management enterprise shall put forward opinions within the scope of local guiding standards and report them to the local price department in conjunction with the real estate administrative department for approval.
The charges for non-residential services such as office buildings, industrial zones, shopping malls (commercial ports) and hotels (hotels) shall be subject to market adjustment, and the charging standards shall be agreed upon by both parties in the contract.
: The property service fee is calculated according to the construction area specified in the real estate license, and the garage, storage room and basement that are not included in the construction area of the real estate license are not charged with the property management service fee.
Legal basis: Measures for the Administration of Property Service Charges Article 2 The term "property service charges" as mentioned in these Measures refers to the fees charged by property management enterprises to the owners for the maintenance, conservation and management of houses, supporting facilities and related sites, and for maintaining the environmental sanitation and order in relevant areas.
