When a property company collects parking fees, it has the obligation to manage vehicles. Damage to the vehicle requires compensation from the property management company. The services provided by property management for residential parking are mainly divided into the following three categories:

1, the first category is management services. That is, it provides management services such as parking lot cleaning, lighting and fire fighting facilities, but it does not provide vehicle storage services, which is irresponsible for vehicle safety and the fees are relatively low.

2. The second category is hosting services. Have the obligation to keep the vehicle, the vehicle has the responsibility of safety, the obligation of compensation, and the charge is high.

3. The third category is management and hosting services. That is, taking into account certain custody obligations, there is a certain liability for compensation for vehicle theft and damage. At present, there are no relevant laws and regulations to make clear provisions on the collection of parking space management fees. The collection of parking space management fees is an agreement between the owner and the property management company. Whether and when the property management company can collect the parking space management fee depends on the agreed situation. If there is a clear agreement between the two parties in the contract, and the property management parking space really needs to pay the corresponding manpower and material resources, this part of the fee can be charged with the approval of the price department. Parking management fees and property management fees are similar in nature. Legally speaking, property management fees or parking management fees need to be signed with the owners (terms of service), and a contractual relationship has been formed in law. The owner paid the fee because he got a series of services provided by the property management, and the property management did not fulfill the agreed obligations. As the counterpart of the contract, the owner has the right to refuse to pay the management fee.

Legal basis: Article 76 of the Road Traffic Safety Law of the People's Republic of China stipulates that if a motor vehicle accident causes personal injury or property loss, the insurance company shall make compensation within the liability limit of compulsory motor vehicle third party liability insurance; The insufficient part shall be liable for compensation in accordance with the following provisions:

(1) In case of a traffic accident between motor vehicles, the party at fault shall be liable for compensation; If both parties are at fault, they shall share the responsibility according to their respective fault proportions.

(two) motor vehicles and non-motor vehicle drivers and pedestrians have traffic accidents, and the non-motor vehicle drivers and pedestrians are not at fault, and the motor vehicle party shall be liable for compensation; If there is evidence that non-motor vehicle drivers and pedestrians are at fault, the liability for compensation of the motor vehicle party shall be appropriately reduced according to the degree of fault; If the motor vehicle party is not at fault, it shall be liable for compensation not exceeding 10%. The loss of traffic accidents is caused by non-motor vehicle drivers and pedestrians deliberately colliding with motor vehicles, and the motor vehicle party is not liable for compensation.
