Measures of Huizhou Municipality on the Construction and Management of Parking Lot

Chapter I General Provisions Article 1 In order to strengthen the planning, construction and management of parking lots in this Municipality, standardize parking order, alleviate the contradiction between supply and demand of parking lots, improve urban traffic order and improve urban quality, these Measures are formulated in accordance with the provisions of the Urban and Rural Planning Law of People's Republic of China (PRC) and the Road Traffic Safety Law of the People's Republic of China. Regulations of the People's Republic of China on the Implementation of the Road Traffic Safety Law and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the urban built-up areas within the administrative area of this Municipality and other areas where urbanization management is implemented. The scope of urban built-up areas and other urbanization management areas shall be delineated by the Municipal People's Government, the county people's government, Daya Bay Economic and Technological Development Zone and Zhong Kai High-tech Industrial Development Zone respectively. Article 3 The term "parking lot" as mentioned in these Measures refers to places where motor vehicles are parked, including public parking lots, special parking lots and road parking spaces.

Public * * * parking lots refer to places that provide parking services for the public except road parking berths, including independent public * * * parking lots and public * * * parking lots provided by construction projects as public * * * service facilities.

Dedicated parking lot refers to an internal parking lot that mainly provides parking services for specific objects.

Road parking spaces refer to places that are uniformly demarcated in urban roads according to law and provide temporary parking services for motor vehicles for the public.

The planning, construction and management of public passenger, freight and dangerous chemicals transport vehicle parking lots shall be implemented in accordance with the provisions of relevant laws and regulations, and these Measures shall not be applicable. Article 4 The planning, construction and management of parking lots shall adhere to the principles of government leading, social co-governance, market regulation and convenience for the masses. Article 5 The competent transportation department is the comprehensive coordination department for the management of the parking lot industry, responsible for formulating the development policies of the parking lot industry and guiding the standardized management of the parking lot and the industry management of the parking lot construction and maintenance; Responsible for the construction and management of parking information comprehensive management service platform.

The public security organs are responsible for the planning and adjustment of road parking spaces, and investigate and deal with illegal road parking.

The competent department of natural resources is responsible for organizing relevant departments to prepare special parking lot planning, handling the parking space index review when the construction project planning permits, and reviewing the design scheme of parking lot buildings and structures to ensure the land demand of public parking lots.

The competent department of housing and urban construction is responsible for the supervision and management of construction permit, quality and safety supervision, completion acceptance filing, fire protection design review and acceptance, and parking lot property management activities within the scope of duties.

The competent department of development and reform is the competent department of motor vehicle parking service charges, and is responsible for verifying the parking service charges that are included in the government guidance price or government pricing management.

The market supervision department is responsible for handling the use registration of mechanical parking equipment, supervising and managing mechanical parking equipment, and investigating price violations in parking lot business activities.

Fire rescue agencies are responsible for investigating and dealing with illegal destruction of fire rescue facilities and occupation of fire exits, guiding parking lots to delimit fire exit no-stop areas and setting fire exit signs.

Other departments shall, in accordance with their respective responsibilities, do a good job in the management of parking lots according to law. Sixth encourage and guide social capital to participate in the construction and management of parking lots, and promote the use of new three-dimensional high-rise parking lots, intelligent parking guidance systems, mechanical parking facilities and other intensive, intelligent and information-based parking management methods. Article 7 The government shall guide the establishment and promote the development of social organizations such as parking industry associations.

Social organizations such as parking lot industry associations carry out industry self-discipline management and industry service work under the guidance of transportation authorities. Chapter II Planning and Construction Article 8 The competent department of natural resources shall, in accordance with the national spatial planning, comprehensive transportation planning and transportation demand, work out special parking lot planning in conjunction with relevant units such as development and reform, public security, transportation, urban and rural housing construction, fire rescue, etc. After being approved by the people's government at the same level, it shall be incorporated into the regulatory detailed planning of urban land use through legal procedures.

The parking lot special planning shall specify the total supply of all kinds of motor vehicle parking spaces, parking lot layout, construction scale and construction standards, etc. Schools, hospitals, administrative centers, parks, scenic spots, large business districts, urban transportation hubs and other public places should focus on supporting the construction of parking lots. Article 9 The competent department of transportation shall, according to the special planning of parking lots, work out the annual construction plan of public parking lots in conjunction with relevant units such as development and reform, public security, finance, natural resources, urban and rural housing construction, fire fighting and rescue, and report it to the people's government at the same level for approval before implementation. Article 10 The municipal competent department of natural resources shall, in accordance with the relevant provisions of the state and the province, formulate and improve the standards for the allocation of parking facilities for urban new construction, renovation and expansion projects, and make timely adjustments according to the development and changes of urban traffic. Eleventh parking lot land supply should be included in the city and county state-owned construction land supply plan.

Idle land shall be recovered by the government after being disposed of according to law. If the planned use meets the requirements, the parking lot land can be given priority. Twelfth in the underground space of schools, squares, green spaces and other resources to build a public parking lot, it shall put forward the construction plan, and obtain the consent of the owner of the ground facilities. After the safety demonstration, the planning, land, fire control and other procedures shall be handled according to law.
