Regulations of Tieling Municipality on the Administration of City Appearance and Environmental Sanitation

Chapter I General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation and create a clean, beautiful and civilized city environment, these Regulations are formulated in accordance with the Law on the Prevention and Control of Air Pollution in People's Republic of China (PRC), the Law on the Prevention and Control of Environmental Pollution by Solid Wastes in People's Republic of China (PRC) and the Regulations on the Management of City Appearance and Environmental Sanitation, in combination with the actual situation of our city. Article 2 These Regulations shall apply to the management of city appearance and environmental sanitation in urban built-up areas and other areas where urbanization management is implemented.

The scope of the urbanization management area shall be designated by the Municipal People's Government. Article 3 The management of city appearance and environmental sanitation shall follow the principles of unified leadership, graded responsibility, territorial management, professional management and mass management. Fourth city and county (city, district) people's government should strengthen the leadership, organization, coordination and supervision of city appearance and environmental sanitation management.

The people's governments of cities and counties (cities, districts) shall incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan, ensure the needs of the development of city appearance and environmental sanitation, and make the cause of city appearance and environmental sanitation adapt to the economic and social development of the city. Article 5 The municipal administrative department of city appearance and environmental sanitation shall be responsible for the management of city appearance and environmental sanitation in the whole city, coordinate, guide, supervise, inspect and evaluate the city appearance and environmental sanitation in urban built-up areas and other areas under urbanization management, and organize the implementation of these Regulations.

County (city, district) administrative department of city appearance and environmental sanitation, town people's government and sub-district offices shall be responsible for the management of city appearance and environmental sanitation within their respective jurisdictions.

The relevant administrative departments of the people's governments of cities and counties (cities, districts) shall, in accordance with their respective duties, do a good job in the management of city appearance and environmental sanitation. Article 6 The administrative punishment stipulated in these Regulations and the administrative coercive power related to administrative punishment shall be implemented by the administrative department of city appearance and environmental sanitation; Comprehensive administrative law enforcement shall be implemented by the comprehensive administrative law enforcement department of urban management according to law. Where laws and regulations provide otherwise, such provisions shall prevail.

The competent administrative department of city appearance and environmental sanitation may entrust its subordinate city appearance and environmental sanitation management institution to implement administrative punishment according to law. Seventh city and county (city, district) people's governments should strengthen the publicity of laws, regulations and knowledge of city appearance and environmental sanitation, enhance citizens' awareness of maintaining city appearance and environmental sanitation, and improve citizens' moral level.

Units and individuals have the obligation to maintain the city appearance and environmental sanitation, and have the right to discourage and report acts that damage the city appearance and environmental sanitation and damage environmental sanitation facilities.

All units and individuals shall respect the work of city appearance and environmental sanitation workers, and shall not hinder or obstruct them from performing their official duties.

Units and individuals that have made outstanding achievements in the work of city appearance and environmental sanitation shall be commended and rewarded by the people's governments of cities and counties (cities, districts) in accordance with relevant regulations. Chapter II Division of Duties Article 8 The duties of city appearance and environmental sanitation work shall be divided according to the following provisions:

(a) the city's primary and secondary roads, overpasses, footbridges and squares are responsible for the professional organization of city appearance and environmental sanitation;

(two) small streets, residential areas by the community (residents) committee, the property management unit is responsible for;

(three) the waters and rivers are in the charge of the management unit;

(4) Public places such as railway stations, long-distance bus stations, bus stops, parking lots, theaters, museums, stadiums (gymnasiums), parks, green spaces, scenic spots, etc. shall be in the charge of management units, business units or greening professional organizations;

(5) Shops, supermarkets, bazaars (including street markets, morning markets, night markets), hotels, restaurants and other places shall be specifically responsible by the property right units, start-up units, business units or competent departments;

(six) the health responsibility area of organs, organizations, schools, troops, enterprises and institutions shall be responsible for it;

(seven) commercial outlets, kiosks and other places by their operators;

(eight) railways, highways and their lines are responsible for the property rights units or business units;

(nine) the construction site shall be the responsibility of the construction unit, and the land for construction projects that have not yet started shall be the responsibility of the construction unit;

(ten) public toilets, garbage collection and transportation sites, garbage bins (boxes) and other environmental sanitation facilities by the city appearance and environmental sanitation professional organizations or property management units responsible for;

(eleven) the implementation of urbanization management of economic and technological development zones, high-tech development zones, new towns and other relatively independent functional areas, by the management unit.

If the person responsible for the management of the city appearance and environmental sanitation responsibility area is not clear, it shall be determined by the municipal administrative department of city appearance and environmental sanitation.

In violation of the provisions of this article, those who fail to perform the responsibility of city appearance and environmental sanitation shall be ordered to make corrections within a time limit, and individuals shall be fined from 50 yuan to 200 yuan, and units shall be fined from 200 yuan to Kloc-0/000 yuan. Ninth street units, individual operators to implement the city appearance and environmental sanitation contract responsibility system. The competent administrative department of city appearance and environmental sanitation or the people's government of a town or the sub-district office shall, in accordance with the provisions of the people's government of a city or county (city, district), sign a letter of responsibility with the responsible persons such as street-facing units and individual operators, clarify the management content and scope, and supervise the implementation.

The responsible person shall, in accordance with the provisions of the letter of responsibility, do a good job in city appearance and environmental sanitation.

The responsible person has the right to dissuade, stop or report to the administrative department of city appearance and environmental sanitation for acts that damage and destroy the city appearance and environmental sanitation in the area of responsibility for city appearance and environmental sanitation.

In violation of the provisions of the second paragraph of this article, if the responsible person fails to perform the responsibility of city appearance and environmental sanitation, it shall be ordered to make corrections within a time limit, and a fine of more than 50 yuan and less than 200 yuan shall be imposed on the individual, and a fine of more than 200 yuan 1000 yuan shall be imposed on the unit.
