Measures of Wuhan Municipality on the Protection and Management of Ancient and Famous Trees

Article 1 In order to strengthen the protection and management of ancient and famous trees and maintain the style of historical and cultural cities, these Measures are formulated in accordance with the provisions of the Forest Law of People's Republic of China (PRC) and the Regulations on Urban Greening issued by the State Council, combined with the actual situation of this Municipality. Article 2 The term "ancient and famous trees" as mentioned in these Measures refers to rare and precious trees that are over 100 years old and have historical value or important commemorative significance.

These Measures shall apply to the protection and management of ancient and famous trees within the administrative area of this Municipality. Article 3 The municipal and district administrative departments of gardens and forestry (hereinafter referred to as the administrative departments of ancient and famous trees) shall be responsible for the protection and management of ancient and famous trees within their respective administrative areas in accordance with the division of responsibilities stipulated by the people's governments at the same level. Fourth administrative departments of ancient and famous trees should strengthen scientific research on the protection of ancient and famous trees, popularize the application of scientific research results, popularize protection knowledge and improve the level of protection management. Article 5 The administrative department of ancient and famous trees shall investigate and register the ancient and famous trees within their respective administrative areas, identify and classify them, establish archives, set up signs, delimit the scope of protection, formulate protection measures and determine the person responsible for protection and management. Sixth state-owned and collective-owned ancient and famous trees, in accordance with the following provisions to determine the responsibility for protection and management:

(a) the old and famous trees that grow in organs, organizations, military units, enterprises, institutions or forest areas, parks, scenic spots and temples shall be protected and managed by their units;

(2) The departments of railways, highways, water conservancy and flood control shall be responsible for the protection and management of ancient and famous trees growing within the land used by railways, highways, reservoirs and rivers;

(three) the ancient and famous trees growing in urban roads, streets and green spaces shall be protected and managed by the garden department;

(four) the ancient and famous trees growing in residential areas or urban residents' hospitals shall be protected and managed by the property management department or the street office;

(five) the ancient and famous trees growing on collectively owned land in rural areas shall be protected and managed by the village collective economic organizations or the people's governments of townships and towns.

The protection and management of ancient and famous trees are the responsibility of individuals.

Where the responsibility for the protection and management of ancient and famous trees is changed, the procedures for the transfer of the responsibility for protection and management shall be handled by the administrative department of ancient and famous trees. Seventh ancient and famous trees protection and management costs borne by the responsible person for protection and management; It is indeed difficult for the responsible person of protection and management to bear the cost of rescue and rejuvenation, and subsidies shall be given by the administrative department of ancient and famous trees. Article 8 The person responsible for the protection and management of ancient and famous trees shall, in accordance with the technical specifications, take the following measures to protect and manage ancient and famous trees:

(1) Improve soil and repair slope protection;

(2) Drought-resistant water and flood-proof drainage;

(3) applying fertilizer to rejuvenate and control pests and diseases;

(four) pruning, filling holes, fences, protective support.

Ancient and famous trees are damaged or weakened, and the responsible person for protection and management shall promptly report to the administrative department of ancient and famous trees, and carry out governance and rejuvenation according to the requirements of the administrative department of ancient and famous trees; The death of ancient and famous trees shall be confirmed by the administrative department of ancient and famous trees, and the cause and responsibility shall be found out before it can be handled. Ninth administrative departments of ancient and famous trees should regularly check the growth and protection of ancient and famous trees; If it is found that the growth is endangered, it shall put forward rescue measures and supervise the implementation. Tenth prohibit the following acts of damage to ancient and famous trees:

(1) Scratching nails, winding ropes, climbing trees and breaking branches, and peeling bark;

(2) using trunk as support;

(3) Picking fruits without authorization;

(four) digging holes, piling, dumping sewage or barbecue in the vertical projection coverage of the crown;

(five) the ground within two meters of the edge of the trunk is covered with cement or other building materials;

(6) Transplanting without authorization;

(7) logging;

(eight) other acts that damage ancient and famous trees. Eleventh production and living facilities hinder and endanger the growth of ancient and famous trees, the administrative department of ancient and famous trees shall order the relevant units or individuals to take measures within a time limit to eliminate the obstacles and hazards. Twelfth construction projects in the planning, design, construction and installation, should take evasive protection measures for ancient and famous trees. Avoidance protection measures shall be approved by the construction unit at the administrative department of ancient and famous trees; No construction is allowed without approval.

Under special circumstances, if it is really necessary to relocate ancient and famous trees, a proper relocation plan must be put forward. After being audited by the municipal administrative department of ancient and famous trees and approved by the municipal people's government, the construction will be organized in accordance with the relevant provisions on the transplantation of ancient and famous trees. Thirteenth units and individuals have the obligation to protect ancient and famous trees; Anyone who finds damage or destruction to ancient and famous trees has the right to dissuade, report and accuse. Fourteenth units and individuals that have made outstanding contributions to the protection and management of ancient and famous trees shall be commended and rewarded by the administrative department of ancient and famous trees. Fifteenth one of the following acts, the administrative department of ancient and famous trees shall be ordered to make corrections, compensate for the losses and impose a fine:

(a) in violation of the provisions of article eighth of these measures, impose a fine of 1000 yuan;

(two) in violation of the provisions of Item (1), Item (2) and Item (3) of Article 10 of these Measures, a fine of over 100 yuan shall be imposed;

(three) in violation of the provisions of Article 10 (4), (5) and (6) and Article 12 of these measures, a fine of more than 500 yuan 1000 yuan shall be imposed; Causing damage to ancient and famous trees, a fine of 2 to 3 times the amount of considerable loss shall be imposed; Causing the death of ancient and famous trees, a fine of 3 to 4 times the amount of considerable loss shall be imposed;

(four) in violation of the provisions of article tenth (seven) of these measures, a fine of 3 times to 5 times the amount of considerable loss shall be imposed.
