Regulations of Haikou Municipality on the Administration of Urban Dog Raising

(The 11th meeting of the Standing Committee of the 14th Haikou Municipal People's Congress on February 28th, 2008 was approved by the 2nd meeting of the Standing Committee of the 4th Hainan Provincial People's Congress on March 28th, 2008. Announcement No.2 of the Standing Committee of Haikou Municipal People's Congress on April 28th, 2008 was promulgated, and it will come into force on September 65, 2008.)

Chapter I General Provisions

Article 1 These Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality in order to standardize the management of dog breeding in cities, safeguard the health and personal safety of citizens, and maintain social public order and city appearance and environmental sanitation.

Article 2 These Regulations shall apply to the management of raising dogs by residents in urban built-up areas of this Municipality. Before the implementation of these regulations, the specific scope of urban built-up areas shall be announced to the public by the municipal planning administrative department according to the present situation of urban planning. The specific scope of urban built-up areas has changed and should be re-announced to the public in due course.

Organs, military units, scientific research units, factories, warehouses and other units raise dogs for special needs, in accordance with relevant state regulations.

Article 3 The principle of restricting raising dogs shall be implemented in the urban built-up areas of this Municipality.

Dog management is implemented by combining the responsibility of government departments with the participation of grassroots organizations.

The principle of combining dog self-discipline with public supervision.

Article 4 The public security department is the administrative department in charge of raising dogs, responsible for the specific management of raising dogs, and organizing the implementation of these Regulations.

Animal husbandry and veterinary, animal health supervision, disease prevention and control and other departments shall be responsible for the supervision of dog epidemic prevention in accordance with the provisions of relevant laws and regulations and their respective responsibilities.

Urban management administrative law enforcement, environmental sanitation, industry and commerce, finance, prices, transportation, health, gardens, planning, real estate and other administrative departments shall, in accordance with the division of responsibilities, cooperate with the dog management.

Fifth street offices are responsible for guiding residents' committees, property owners' committees and other organizations to formulate civilized dog-raising conventions, and mediating and handling disputes caused by dog-raising according to law. The Convention on Civilized Dog Breeding can stipulate the time and area where dogs are forbidden to walk in this residential area.

In the urban built-up area, the villagers' committees that have not yet implemented the reform of the residents' committees shall, in accordance with the provisions of these regulations, do a good job in dog management within their respective jurisdictions.

Sixth to encourage industry associations, social organizations and other relevant enterprises and institutions to actively assist and participate in dog management.

Seventh dog owners should strengthen self-discipline management, consciously abide by the provisions on dog management, and raise dogs in a civilized manner.

Any unit or individual who finds any violation of the provisions of these regulations may complain or report to the administrative department of dog raising. The relevant administrative departments shall keep the complainant or informant confidential and give appropriate rewards as appropriate.

Article 8 It is forbidden to keep strong dogs and large dogs. The breed, height and length standards of dogs are prohibited, which shall be determined by the municipal animal husbandry and veterinary administrative department in conjunction with the municipal public security department, and announced to the public before the implementation of these regulations after approval by the Municipal People's government.

Blind people and severely disabled people who need to raise large guide dogs and support dogs may apply to the dog registration authority for approval.

Article 9 Dogs are prohibited in the following areas, except for the blind who raise guide dogs and the severely disabled who raise support dogs:

(1) Office service areas of institutions and hospitals (except pet hospitals);

(two) the teaching area and student dormitory area of the school (including kindergarten);

(three) the collective dormitory where the employees of this unit live together.

Chapter II Dog Breeding Registration

Article 10 Dogs shall be subject to quarantine, immunization and registration systems. Dogs that have not been quarantined, immunized and registered shall not be kept.

Eleventh residents in the urban built-up area of this Municipality shall register with the public security department of their place of residence and obtain a dog registration certificate and a dog license. Before registration, the dog quarantine certificate issued by the supervising agency for animal health shall be obtained, and the vaccine shall be injected according to the regulations, and the dog immunization certificate issued by the supervising agency for animal health shall be obtained.

Residents keep dogs, and each household is limited to 1 dog.

Dog registration follows the principle of convenience, and the public security department shall regularly provide one-stop convenience services such as quarantine, immunization and registration with the supervising agencies for animal health.

Those who come to this city to travel, visit relatives and friends, and carry dogs for more than 3 days shall go to the dog registration authority for the record, provide proof of identity, residence, dog quarantine and immunization, and abide by the relevant provisions of these regulations.

Twelfth residents to apply for a dog, shall meet the following conditions:

(1) Having a legal identity certificate;

(2) Having full capacity for civil conduct;

(3) Having a fixed residence and living in a single household.

Thirteenth dog owners to apply for dog registration, should take the dog to the identification agency determined by the public security department of the place of residence, and provide the following materials:

(1) A Registration Form for Applying for Dog, which is collected from the residence accreditation agency and truthfully filled in;

(2) Valid dog quarantine certificate and dog immunization certificate;

(3) Color digital photos of dogs;

(4) ID card and its copy;

(five) real estate license, housing lease contract and its copy or residence certificate issued by the residents' committee.

The recognized institution of the public security department shall, jointly with the animal husbandry and veterinary administrative department, do a good job in epidemic prevention in the recognized places.

Article 14 The public security department shall make a decision on whether to register or not within 10 working days from the date of accepting the application.

If the registration is granted, the public security department shall identify the institution to issue the dog registration certificate and the dog number plate uniformly produced by the registration authority, and feed back the registration information to the residents' committee where the dog owner lives, and the residents' committee shall publicize the registration information to the residents in this area; If registration is not granted, the public security department that accepts the application shall inform the applicant in writing and explain the reasons.

Fifteenth in any of the following circumstances, the registration authority shall not register:

(a) does not meet the application conditions for raising dogs;

(2) The type or standard of the dog to be bred does not meet the requirements;

(three) to apply for a dog in the forbidden area;

(four) to apply for a dog without obtaining a dog quarantine certificate or a dog immunization certificate;

(5) Other circumstances stipulated by laws and regulations.

Sixteenth it is forbidden to forge, alter, buy or sell or use, buy or sell forged or altered dog registration certificates and dog tags.

The dog registration made by cheating the registration authority with forged or altered dog quarantine certificate, dog immunization certificate or other means is invalid.

Seventeenth dog registration system of annual examination, annual examination by the registration authority. Dog breeders shall, from the second year of registration, go through the annual examination formalities with valid dog immunization certificate, dog registration certificate and other materials required by the registration authority within the time specified by the registration authority every year.

Article 18 Under any of the following circumstances, the registration authority shall determine that the annual examination is unqualified, cancel its dog registration, and cancel its dog registration certificate and dog license:

(a) the objective situation of dog owners and their dogs has changed, and they no longer meet the conditions for raising dogs;

(two) the dog immunization card expired, not according to the provisions of the re injection of dog immunization card;

(3) Other circumstances stipulated by laws and regulations.

Nineteenth dog owners should pay the annual management fee.

The annual dog management fee is collected by the public security department. The management fee is managed by two lines of revenue and expenditure, and is included in the financial budget management, which is mainly used for dog management such as dog epidemic prevention, dog registration and dog capture.

Twentieth dog owners register to raise dogs, and pay the management fee 300 yuan every year.

Breeding sterilized dogs will be charged half of the annual management fee.

The blind feeding guide dogs and the severely disabled feeding support dogs shall be exempted from the annual management fee.

Article 21 Where a dog owner transfers or donates a dog, the assignee shall go through the transfer registration at the institution recognized by the public security department of the place of residence with the transfer and donation agreement, identity certificate, residence certificate, original dog registration certificate and other materials. If the transferor (donor) and the transferee (recipient) do not live in the same district-level administrative region, the original dog registration certificate shall be recovered by the organ that handles the transfer registration and cancelled by the original registration authority.

Where the dog owner's place of residence changes, it shall, within 30 working days from the date of change, go through the registration of change at the institution recognized by the public security department of the new place of residence. If the change of residence and the original residence are not in the same district-level administrative region, the original dog registration certificate shall be recovered by the organ that handles the change registration and cancelled by the original registration authority.

In accordance with the provisions of the preceding two paragraphs, if the registration has been transferred or changed, the registration authority will no longer charge the dog management fee for that year.

Article 22 If a dog quarantine certificate, a dog immunization certificate, a dog registration certificate and a dog number plate are lost, the dog owner shall apply to the original issuing or registration authority for a replacement within 10 working days from the date of loss. Overdue retroactive, according to undocumented dog processing.

Article 23 If a dog dies or is lost, the dog owner shall return the dog immunization certificate, dog registration certificate and dog license of the dog owner to the original issuing authority for cancellation.

Chapter III Dog Management

Twenty-fourth engaged in dog breeding, sales, transportation, dog clinics, dog performances, competitions, exhibitions, exhibitions and other business activities, should comply with the provisions of relevant laws and regulations, and to the local district public security department for the record.

Twenty-fifth prohibit the establishment of dog farms in the built-up areas of this Municipality.

It is forbidden to engage in dog trading in public places other than dog farms and dog trading places.

Article 26 No unit or individual may mistreat dogs. Dog owners are not allowed to abandon dogs.

Twenty-seventh dog owners should strengthen the care of dogs, not to infringe upon the legitimate rights and interests of others, not to affect the normal life of others, not to damage the public health environment.

Article 28 Dog owners shall carry dog registration certificates, wear dog tags for dogs, and abide by the following provisions (except for blind people carrying guide dogs and severely disabled people carrying disabled dogs):

(a) must be led by a person with full capacity for civil conduct;

(two) the dog must be tethered, and the length of the tether shall not exceed 65438 0.5 meters;

(three) dog owners should promptly remove dog feces;

(4) Dogs are prohibited from entering public places such as organs, service areas, teaching areas, restaurants, shopping malls, waiting rooms, dance halls, theaters, libraries, exhibition halls, bathing places, gymnasiums, and other places designated by the Municipal People's Government according to management needs.

(five) dogs are not allowed to take buses, ferries and other large and medium-sized public transport; When taking a small taxi with a dog, the driver's consent shall be obtained;

(6) When taking a dog in an elevator, effective safety and health protection measures should be taken, such as putting a muzzle on the dog or putting the dog in a dog cage or dog bag;

(seven) should avoid others, especially the elderly, the disabled, pregnant women and children.

Twenty-ninth dog barking affects the normal work and rest of others, the dog owner should take effective measures to stop it.

Article 30. If a dog injures a person, the dog owner shall immediately send the injured person to a medical and disease control institution for wound treatment, patient rescue and vaccination, and the medical expenses shall be paid in advance by the dog owner. Those who cause personal injury or property damage to others shall bear the responsibility according to law. Dog owners should also immediately send the injured dog to a dog shelter for quarantine and then dispose of it.

Article 31 If a registered dog gives birth to a puppy, the dog owner shall dispose of it by himself or send it to a dog shelter within 45 days from the date of the puppy's birth.

Article 32 The public security department is responsible for catching stray dogs and abandoned dogs. Administrative units such as urban management administrative law enforcement departments, animal husbandry and veterinary administrative departments and animal health supervision institutions shall, in accordance with their duties, assist the public security departments in catching stray dogs and abandoned dogs.

Article 33 The public security department shall set up a kennel to be responsible for the adoption, lien, inspection and disposal of dogs caught according to law and abandoned dogs sent by citizens, legal persons and other organizations. Dog shelter institutions shall be equipped with professional and technical personnel, kennels and necessary equipment and facilities that meet the needs.

Animal husbandry and veterinary administrative departments should do a good job in quarantine, immunization and epidemic prevention of dog shelters according to their duties.

The public security department may, according to the management needs, entrust relevant trade associations, social organizations or other enterprises and institutions to carry out dog shelter work.

Thirty-fourth stray dogs, abandoned dogs and lost dogs housed in dog shelters shall be declared unclaimed within 7 working days from the date of receiving them, and shall be treated as dog owners. If a dog owner loses his dog, he shall inquire or claim it from the dog receiving institution within 5 working days from the date of losing the dog.

Thirty-fifth any unit or individual shall not arbitrarily discard the dead dog. If a dog dies of natural causes, the dog's corpse shall be put into an animal corpse collection container, which shall be collected and processed by environmental health workers. The dead or unidentified dog carcasses must be disposed of in accordance with the provisions of the animal husbandry and veterinary administrative department.

Animal carcass collection containers shall be set up reasonably by the environmental sanitation management department according to the actual situation.

The animal husbandry and veterinary administrative department shall establish a harmless treatment station for dogs or animals, and carry out harmless treatment for dog carcasses.

Thirty-sixth any unit or individual who finds that a dog has or is suspected of having a canine epidemic disease shall immediately report to the supervising agency for animal health in the area under its jurisdiction; Anyone who is found to be suffering from or suspected of suffering from rabies and other infectious diseases shall immediately report to the disease prevention and control institutions in the jurisdiction.

Chapter IV Legal Liability

Thirty-seventh public security departments, administrative organs and their staff in any of the following circumstances, their competent departments or higher authorities shall order them to make corrections; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If damage is caused, it shall be liable for compensation according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Failing to perform management duties such as quarantine, immunization and registration according to law;

(2) Failing to investigate and deal with illegal acts, resulting in serious consequences;

(three) the illegal exercise of powers, damage the legitimate rights and interests of others;

(four) other acts of abuse of power, dereliction of duty, favoritism.

Thirty-eighth in violation of the provisions of the provisions of article eighth, breeding dogs and large dogs, shall be ordered by the public security department; If it is not handled within the time limit, the dogs will be confiscated and each dog will be fined 2000 yuan.

Article 39 Dogs that have not been quarantined and immunized in violation of the provisions of Articles 10 and 11 of these regulations shall be ordered by the supervising agency for animal health to be quarantined and immunized within a time limit, and each dog shall be fined in 500 yuan; Failing to carry out quarantine and immunization within the time limit, the supervising agencies for animal health shall confiscate their dogs.

Fortieth in violation of the provisions of Article 10 and Article 11 of these regulations, those who raise dogs without obtaining the dog registration certificate shall be fined by the public security department in 500 yuan and ordered to register within a time limit; Failing to register within the time limit, the dogs will be confiscated, and a fine of more than 2000 yuan 1000 yuan will be imposed on each dog.

In violation of the provisions of the second paragraph of article eleventh of this Ordinance, the public security department shall order it to make corrections within a time limit; If it fails to change within the time limit, the dogs will be confiscated and a fine of 2000 yuan will be imposed on each dog.

Article 41 Anyone who, in violation of the provisions of Article 16 of these regulations, forges, alters, buys or sells counterfeit, forged or altered dog registration certificates and dog licenses shall be confiscated and cancelled by the public security department, and his illegal income shall be confiscated, and he shall also be fined 1000 yuan to 2,000 yuan; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 42 In violation of the provisions of Article 17, Article 19, Article 20 and Article 21 of these regulations, under any of the following circumstances, the dog shall be confiscated by the registration or annual inspection organ, the dog registration certificate shall be cancelled, and a fine of 500 yuan to 60,000 yuan shall be imposed:

(1) Failing to handle the annual review as required;

(two) failing to pay the annual dog management fee according to the regulations;

(three) the transfer or change of registration is not handled according to the regulations.

Forty-third in violation of the provisions of article twenty-sixth, abuse and abandonment of dogs, given a warning by the public security department or impose a fine of 500 yuan.

Forty-fourth in violation of the provisions of article twenty-third and article twenty-eighth, shall be punished according to the following provisions:

(a) in violation of the provisions of article twenty-third, did not return the dog registration certificate and dog license.

If the original issuing authority cancels, the public security department shall impose a fine from 50 yuan to 200 yuan;

(II) in violation of the provisions of Item (3) of Article 28, failing to remove the dog feces in time, which affects the urban environmental sanitation, the environmental sanitation administrative department shall order the dog-carrier to immediately remove the dog feces, and may impose a fine of more than 65,438,000 yuan in 50 yuan;

(three) in violation of the provisions of article twenty-eighth (five), the public transport management institution shall order it to make corrections and impose a fine of more than 50 yuan and less than 200 yuan;

(four) in violation of other provisions of article twenty-eighth, the public security department shall order it to make corrections and impose a fine of more than 50 yuan and less than 200 yuan.

Under any of the circumstances specified in Items (2) to (4) of the preceding paragraph, causing serious impact or refusing to correct after being ordered to do so, the public security department shall confiscate its dog and cancel its dog-raising registration certificate.

Article 45 If, in violation of the provisions of Article 29 of these regulations, barking affects the normal work and rest of others without stopping it, the public security department shall order it to stop barking and impose a fine of 100 yuan; If the measures taken cannot effectively stop the barking of dogs and seriously affect the normal work and rest of others, the public security department shall confiscate their dogs and cancel their dog-raising registration certificate.

Those who let dogs intimidate others or drive dogs to hurt others shall be punished in accordance with the provisions of the Public Security Punishment Law.

Article 46 Whoever, in violation of Article 35 of these regulations, arbitrarily discards the corpse of a dog shall be ordered by the competent administrative department of environmental sanitation to make corrections, and a fine of more than 50 yuan 100 yuan shall be imposed; Refuses to make corrections, shall be handled by the competent administrative department of environmental sanitation according to law, and the handling expenses shall be borne by the dog breeder.

Those who fail to deal with the dead dogs or dogs with unknown causes in accordance with the provisions on animal epidemic prevention shall be punished in accordance with the relevant provisions of the state.

Forty-seventh dog owners in violation of the provisions of this Ordinance, the dog was confiscated and the dog registration certificate was cancelled according to law, and the application for dog registration was filed within 2 years, but it was not approved.

Chapter V Supplementary Provisions

Article 48 The Municipal People's Government shall be responsible for the interpretation of the problems in the specific application of these Regulations.

Article 49 These Regulations shall come into force on September 6, 2008.
